Common use of Quiet Enjoyment Clause in Contracts

Quiet Enjoyment. Landlord covenants that, if Tenant is not in default hereunder, Tenant shall at all times during the Term peaceably and quietly have, hold and enjoy the Premises without disturbance from Landlord, subject to the terms of this Lease and to the rights of the parties presently or hereinafter secured by any deed of trust or mortgage against the Building.

Quiet Enjoyment. Landlord covenants thatand agrees that Tenant will quietly hold, if Tenant is not in default hereunder, Tenant shall at all times during the Term peaceably and quietly have, hold occupy and enjoy the Premises without disturbance from Landlordduring the Term, subject to the terms and conditions of this Lease free from molestation or hindrance by Landlord or any person claiming by, through or under Landlord, if Tenant pays all Rent as and to the rights when due and keeps, observes and fully satisfies all other covenants, obligations and agreements of the parties presently or hereinafter secured by any deed of trust or mortgage against the BuildingTenant under this Lease.

Quiet Enjoyment. Landlord covenants and agrees with Tenant that, if upon Tenant is not in default performing all of the covenants and provisions on Tenant’s part to be observed and performed under this Lease (including payment of Rent hereunder), Tenant shall at all times during have the Term peaceably right to use and quietly have, hold and enjoy occupy the Premises without disturbance from Landlord, in accordance with and subject to the terms and conditions of this Lease as against all persons claiming by, through or under Landlord. This covenant shall be binding upon Landlord and to the rights its successors only during its or their respective periods of the parties presently or hereinafter secured by any deed ownership of trust or mortgage against the Building.

Quiet Enjoyment. The Landlord covenants thatwith the Tenant that if the Tenant pays the Annual Rent, if Tenant is not Additional Rent and all other sums reserved herein and observes and performs the covenants, conditions and agreements set out in default hereunderthis Lease, the Tenant shall at all times and may peaceably possess and enjoy the Leased Premises during the Term peaceably and quietly have, hold and enjoy the Premises without interruption or disturbance from the Landlord, subject to the terms of this Lease and to the rights of the parties presently or hereinafter secured by any deed of trust or mortgage against the Building.

Quiet Enjoyment. Landlord covenants and agrees with Tenant that, if upon Tenant is not in default hereunderpaying the Rent required under this Lease and performing all of the covenants and provisions on Tenant’s part to be observed and performed under this Lease, Tenant shall at all times during the Term Term, peaceably and quietly have, hold and enjoy the Premises without disturbance from Landlord, subject to the terms of in accordance with this Lease and to the rights of the parties presently or hereinafter secured without interference by any deed persons lawfully claiming by or through Landlord. The foregoing covenant is in lieu of trust any other covenant express or mortgage against the Buildingimplied.

Quiet Enjoyment. Landlord covenants that, if and agrees with Tenant is not in default hereunderthat upon Tenant paying the Rent and performing its other covenants and conditions under this Lease, Tenant shall at all times during have the Term peaceably and quietly have, hold and enjoy quiet possession of the Premises without disturbance from for the term of this Lease as against any persons or entities lawfully claiming by, through or under Landlord, subject subject, however, to the terms of this Lease and to the rights of the parties presently or hereinafter secured by any deed of trust or mortgage against the BuildingEncumbrance.

Quiet Enjoyment. Landlord covenants that, if Tenant is not in default hereunder, and agrees that Tenant shall at all times during have the Term right to peaceably and quietly have, hold and enjoy the Premises without disturbance from Leased Property for the Term, free of hindrance or molestation by Landlord or anyone claiming by, through or under Landlord, subject to the terms so long as no Event of this Lease and to the rights of the parties presently or hereinafter secured by any deed of trust or mortgage against the BuildingDefault is continuing.

Quiet Enjoyment. Landlord covenants that, if Tenant is not in default hereunder, and agrees that Tenant shall at all times have the right to peaceful and quiet enjoyment and occupancy of the Premises during the Term peaceably and quietly have, hold and enjoy the Premises without disturbance from LandlordTerm, subject to the terms and conditions of this Lease free from molestation or hindrance by Landlord or any Person claiming by, through or under Landlord, if Tenant pays all Rent as and to the rights when due and keeps, observes and fully performs all other covenants, obligations and agreements of the parties presently or hereinafter secured by any deed of trust or mortgage against the BuildingTenant under this Lease within all applicable notice, grace and cure periods.

Quiet Enjoyment. Landlord covenants that, to control its activities and personnel such that if and so long as Tenant is not pays the rent and performs the covenants contained in default hereunderthis Lease, Tenant shall at all times during the Term peaceably and quietly have, hold and enjoy the Premises without disturbance from Landlordpeaceably and quietly, subject to the terms provisions of this Lease and to the rights of the parties presently or hereinafter secured by any deed of trust or mortgage against the BuildingLease.

Quiet Enjoyment. Landlord covenants thatand agrees that the Tenant upon paying the Fixed Base Rent, if Tenant is not in default hereunderadditional rent and all other charges herein provided for and performing and fulfilling the covenants, Tenant agreements, and conditions of this Lease on the Tenant's part to be performed and fulfilled, shall at all times during the Term peaceably and quietly havehold, hold occupy and enjoy the Premises during the Term without disturbance from hindrance or molestation by the Landlord or any person (s) claiming under the Landlord, subject subject, however, to the terms and conditions of this Lease and to the rights of the parties presently or hereinafter secured by any deed of trust or mortgage against the BuildingLease.

Quiet Enjoyment. Landlord covenants that, and agrees that if Tenant and so long as there is not in default no Event of Default hereunder, Tenant shall at all times during the Term peaceably lawfully and quietly havehold, hold occupy and enjoy the Demised Premises without disturbance from hindrance or molestation by Landlord or by anyone claiming by, through or under Landlord, subject to the terms Permitted Encumbrances, covenants, agreements, terms, provisions and conditions of this Lease and to the rights of the parties presently or hereinafter secured by any deed of trust or mortgage against the BuildingLease.

Quiet Enjoyment. Landlord covenants thatand agrees that Tenant, if Tenant is not in default hereunderupon paying the Rent and all other charges hereunder provided for and observing and keeping all covenants, Tenant agreements and conditions of this Lease on its part to be observed and kept, shall at all times during the Term peaceably and quietly have, hold have and enjoy the Leased Premises without disturbance from Landlord, subject to during the terms term of this Lease and without hindrance or molestation by anyone claiming by or through Landlord, subject, however, to the rights exceptions and conditions of the parties presently or hereinafter secured by any deed of trust or mortgage against the Buildingthis Lease.

Quiet Enjoyment. 7.1 Landlord covenants thatthat Tenant, if Tenant is not in default hereunderon paying the Rents herein provided and keeping, Tenant performing and observing the covenants, agreements and conditions herein required of Tenant, shall at all times during the Term peaceably and quietly have, hold and enjoy the Premises without disturbance from Landlordfor the Term aforesaid, subject subject, however, to the terms of this Lease and to the rights of the parties presently or hereinafter secured by any deed of trust or mortgage against the BuildingLease.

Quiet Enjoyment. Landlord covenants that, that if Tenant is not in default hereundershall pay Rent and perform all of the terms and conditions of this Lease to be performed by Tenant, Tenant shall at all times during the Term peaceably and quietly have, hold occupy and enjoy possession of the Premises without disturbance from molestation or hindrance by Landlord or any party claiming through or under Landlord, subject to the terms provisions of this Lease and any Mortgage to which this Lease is subordinate and easements, conditions and restrictions of record affecting the rights of the parties presently or hereinafter secured by any deed of trust or mortgage against the BuildingLand.

Quiet Enjoyment. Landlord covenants thatthat Tenant, if Tenant is not in default hereunderupon paying the Basic Rent and all other sums and charges herein provided for and observing and keeping all covenants, Tenant agreements and conditions of this Lease on its part to be observed and kept, shall at all times quietly have and enjoy the Property during the Term peaceably and quietly have, hold and enjoy the Premises without disturbance from Landlordby anyone claiming by, subject through or under Landlord subject, however, to the terms exceptions, reservations, and conditions of this Lease and to the rights of the parties presently or hereinafter secured by any deed of trust or mortgage against the BuildingLease.

Quiet Enjoyment. Landlord covenants thatand agrees with Tenant that it has good right to lease said Leased Premises, if and upon Tenant is not in default hereunderpaying all Basic Rent, additional rent and all other charges which may become due under this Lease and observing and performing all of the terms, covenants and conditions on Tenant’s part to be observed and performed, Tenant shall at all times during the Term may peaceably and quietly have, hold hold, occupy and enjoy the Leased Premises without disturbance from Landlord, subject to the terms of and all rights under this Lease and to the rights of the parties presently without hindrance or hereinafter secured disturbance by any deed of trust Landlord or mortgage against the Buildinganyone claiming by, through or under Landlord.

Landlord covenants thatthat Tenant, if Tenant is not in default hereunderpaying the rent reserved herein, Tenant and performing all of the other terms, covenants and conditions on its part to be performed, shall at all times during the Term and may peaceably and quietly have, hold and enjoy the Demised Premises without disturbance from Landlordfor the use and purpose stated in this Lease or for such other similar purposes as the Commissioner of Citywide Administrative Services may determine, subject to the terms of the introductory paragraph of this Lease and to the rights of the parties presently or hereinafter secured by any deed of trust or mortgage against the Buildingpreceding Article 1.

Quiet Enjoyment. Landlord covenants that, if and agrees with Tenant is not in default hereunderthat upon Tenant paying the rent required under this Lease and paying all other charges and performing all of the covenants and provisions on Tenant’s part to be observed and performed under this Lease, Tenant shall at all times during the Term may peaceably and quietly have, hold and enjoy the Premises without disturbance from Landlord, subject to the terms of in accordance with this Lease and to the rights of the parties presently without hindrance or hereinafter secured molestation by any deed of trust Landlord or mortgage against the Buildingits employees or agents.

Quiet Enjoyment. The Landlord covenants thatwith the Tenant that if the Tenant duly and punctually pays the Rent hereby reserved, if Tenant is not in default hereunderand duly and punctually performs the covenants herein on its part contained, Tenant shall at all times during the Term peaceably and quietly have, hold and enjoy the Premises without disturbance from Landlordit will, subject to the terms of this Lease Lease, peaceably possess and to enjoy the rights of Premises for the parties presently Term hereby granted without any interruption or hereinafter secured by disturbance from the Landlord or any deed of trust other person or mortgage against the Buildingpersons lawfully claiming by, from, or under it, except as set out in this Lease.

Quiet Enjoyment. Landlord covenants that, if that so long as Tenant is shall perform the obligations of Tenant contained in this Lease and shall not be in default hereunderin the performance of any of such obligations, Landlord shall take no action or fail to take any action that would deny Tenant shall at all times during and its permitted subtenants, licensees, successors and assigns the Term peaceably right to freely, peaceably, and quietly have, hold and enjoy full and exclusive use and enjoyment of the Premises without disturbance from LandlordPremises, subject to the terms of this Lease Section 1.1 and to the rights of the parties presently or hereinafter secured by any deed of trust or mortgage against the BuildingSection 1.3.

Quiet Enjoyment. Landlord covenants that, if Tenant is not in default hereunderthat during the Term, Tenant shall at all times during the Term peaceably will have quiet and quietly have, hold and enjoy peaceable possession of the Premises without disturbance from by, through and under Landlord, subject to the terms terms, covenants, conditions and provisions of this Lease Lease, and to the rights of the parties presently or hereinafter secured by any deed of trust or mortgage against the BuildingLandlord will not disturb such possession except as expressly provided in this Lease.

Quiet Enjoyment. Landlord covenants that, if Tenant is not in default hereunder, and agrees that Tenant shall at all times lawfully and quietly hold, occupy and enjoy the Demised Premises (subject to the provisions of this Lease) during the Term peaceably and quietly have, hold and enjoy the Premises without disturbance from Landlord, subject to the terms of this Lease and to the rights of the parties presently hindrance or hereinafter secured molestation by Landlord or by any deed of trust person or mortgage against the Buildingpersons claiming under Landlord.

Quiet Enjoyment. So long as no Event of Default exists, Landlord covenants that, if Tenant is not in default hereunder, and agrees that Tenant shall at all times during the Term peaceably and quietly have, hold and enjoy the Premises without disturbance for the Term free from claims by, through or under Landlord, subject to all of the terms provisions of this Lease and to the rights of the parties presently or hereinafter secured by any deed of trust or mortgage against the BuildingMaster Lease.

Quiet Enjoyment. Subject to the terms of this Lease, Landlord covenants that, that if Tenant is not in default hereundertimely (a) pays all Annual Rent and other charges provided for herein, (b) performs all of its obligations provided for herein, and (c) observes all of the other provisions hereof, then Tenant shall at all times during the Term peaceably and quietly have, hold and enjoy the Premises Property, without interruption or disturbance from by Landlord, subject to the terms of this Lease and to the rights of the parties presently or hereinafter secured by any deed of trust anyone claiming through or mortgage against the Buildingunder Landlord.

Quiet Enjoyment. Landlord covenants thatthat Tenant, if Tenant is not in default hereunderon paying the rents, Tenant the Tenant’s contribution and performing all of Tenant’s obligations pursuant to this Lease, shall at all times during the Term peaceably peacefully and quietly have, hold and enjoy the Leased Premises throughout the Term without disturbance from hindrance or molestation by anyone claiming by or through Landlord, subject subject, however, to the terms exceptions, reservations and conditions of this Lease and to the rights of the parties presently or hereinafter secured by any deed of trust or mortgage against the BuildingLease.

Quiet Enjoyment. Subject to the terms of this Lease, Landlord covenants that, that if Tenant is not in default hereundertimely (a) pays all Rent and other charges provided for herein, (b) performs all of its obligations provided for herein, and (c) observes all of the other provisions hereof, then Tenant shall at all times during the Term peaceably and quietly have, hold and enjoy the Premises Premises, without interruption or disturbance from by Landlord, subject to the terms of this Lease and to the rights of the parties presently or hereinafter secured by any deed of trust anyone claiming through or mortgage against the Buildingunder Landlord.

Quiet Enjoyment. The Landlord covenants that, if and agrees with Tenant is not in default that as long as the Tenant keeps and performs all of the covenants and conditions to be performed by Tenant hereunder, Tenant shall at all times during the Term peaceably and quietly have, hold and enjoy the Premises without disturbance from Landlord, subject to the terms term of this Lease Agreement Tenant shall have quiet and to the rights undisturbed and continued possession of the parties presently or hereinafter secured by Premises, free from any deed of trust or mortgage claims against the BuildingLandlord and all persons claiming under, by or through the Landlord.

Landlord covenants that, if that upon Tenant is not in default hereunderpaying the rent required under this Lease and paying all other charges and performing all of the covenants and provisions on Tenant’s part to be observed and performed under this Lease, Tenant shall at all times during the Term and may peaceably and quietly have, hold and enjoy the Premises without disturbance from Landlord, subject to the terms of in accordance with this Lease and to the rights of the parties presently or hereinafter secured by any deed of trust or mortgage against the BuildingLease.

Landlord covenants thatthat Tenant, if Tenant is not upon paying the Basic Rent and the Additional Charges provided for in default hereunderthis Lease, Tenant and upon performing and observing all of the terms, covenants, conditions and provisions of this Lease on Tenant's part to be kept, observed and performed, shall at all times quietly hold, occupy and enjoy the Leased Premises during the Term peaceably and quietly havewithout hindrance, hold and enjoy the Premises without disturbance from ejection or molestation by Landlord or any party lawfully claiming through or under Landlord, subject to the terms of this Lease and to the rights of the parties presently or hereinafter secured by any deed of trust or mortgage against the Building.

Quiet Enjoyment. Landlord covenants that, if so long as Tenant is not in default hereunderpays all Rents hereunder when due and keeps and performs all of its covenants under this Lease, Tenant shall at all times during the Term peaceably and quietly have, hold have and enjoy the Premises without disturbance from hindrance or molestation by Landlord, subject to the terms of this Lease and to the rights of the parties presently or hereinafter secured by any deed of trust or mortgage against the BuildingLease.

Quiet Enjoyment. Landlord covenants and agrees that, if Tenant is not in default hereundersubject to terms, covenants and conditions of this Lease, Tenant shall at and may, upon observing and complying with all times during the Term terms, covenants and conditions of this Lease, peaceably and quietly have, hold and enjoy occupy the Premises without hindrance, disturbance from or ejection by Landlord, subject to the terms of this Lease and to the rights of the parties presently or hereinafter secured by any deed of trust or mortgage against the Building.

Quiet Enjoyment. Landlord covenants thatand agrees that Tenant, if Tenant is not in default hereunderupon paying the Rent herein provided for and observing and keeping the covenants, Tenant agreements and conditions on its part to be kept, shall at all times during the Term peaceably lawfully and quietly havehold, hold occupy and enjoy the Premises during the Lease without disturbance from hindrance or interruption by Landlord or anyone claiming by, through or under Landlord, subject to the terms of this Lease and to the rights of the parties presently or hereinafter secured by any deed of trust or mortgage against the Building.

Quiet Enjoyment. Landlord covenants that, if Tenant is not in default hereunder, and agrees that Tenant shall and may, at all times during the Term Term, peaceably and quietly have, hold hold, occupy and enjoy the Premises without disturbance from LandlordPremises, subject to the terms of this Lease and to the rights of the parties presently or hereinafter secured by any deed of trust or mortgage against the BuildingLease.

Quiet Enjoyment. Landlord covenants that, if Tenant is not in default and agrees that so long as no Event of Default exists hereunder, Tenant shall at all times during the Term peaceably and may peacefully and quietly have, hold and enjoy occupy the Premises without disturbance Leased Property free of any interference from Landlord or any Person claiming by, through or under Landlord; subject, subject however, and nevertheless to the terms terms, provisions and conditions of this Lease Agreement and to the rights of the parties presently or hereinafter secured by any deed of trust or mortgage against the BuildingPermitted Encumbrances.

Quiet Enjoyment. Landlord covenants thatthat Tenant will quietly hold, if Tenant is not in default hereunder, Tenant shall at all times during the Term peaceably and quietly have, hold occupy and enjoy the Premises without disturbance from Landlordduring the Term, subject to the terms and conditions of this Lease and to Lease, free from molestation or hindrance by Landlord or any person claiming by, through or under Landlord, so long as no Event of Default on the rights part of the parties presently or hereinafter secured by any deed of trust or mortgage against the BuildingTenant shall be continuing under this Lease.

SECTION 16.1 Landlord covenants that, if that so long as this Lease is in effect and Tenant is not pays the rents and performs the covenants and conditions contained in default hereunderthis Lease, Tenant shall at all times during the Term peaceably and quietly have, may peacefully hold and enjoy the Demised Premises without disturbance from Landlordduring the Term subject, subject however, to the terms of this Lease and to the rights of the parties presently or hereinafter secured by any deed of trust or mortgage against the BuildingLease.

Landlord covenants that, if and agrees with Tenant is not in default hereunderthat upon Tenant paying rent and other monetary sums due under the Lease and performing its covenants and conditions, Tenant shall at all times during the Term and may peaceably and quietly have, hold and enjoy the Premises without disturbance from Landlordfor the term, subject however to the terms of this the Lease and to the rights of any of the parties presently aforesaid ground leases, mortgages or hereinafter secured by any deed deeds of trust or mortgage against the Buildingdescribed above.

Landlord hereby covenants thatthat Tenant shall peaceably and quietly have, if hold, and enjoy the Premises for the full term hereby granted, including any extension thereof, free from molestation, eviction, or disturbance by Landlord or by any other person claiming through Landlord, provided Tenant is not in default hereunder, Tenant shall at all times during of the Term peaceably and quietly have, hold and enjoy the Premises without disturbance from Landlord, subject to the terms of this Lease and that Landlord has good right to the rights of the parties presently or hereinafter secured by any deed of trust or mortgage against the Buildingmake this Lease.

Quiet Enjoyment. Landlord covenants thatthat Tenant, if upon paying the rent reserved and on performing all of the terms, covenants and conditions hereof on the part of Tenant is to be performed, and not in being in, default hereunderunder any of the terms of this Lease, Tenant shall at all times during the Term peaceably peacefully and quietly have, hold and enjoy the Premises without disturbance from Landlord, (subject to the terms of this Lease and to the rights of the parties presently any and all Mortgages) against all persons claiming any interest therein by, through or hereinafter secured by tinder Landlord, but not as against any deed of trust or mortgage against the Buildingother person.

Quiet Enjoyment. Landlord covenants that, if that so long as Tenant continues to pay rent and is not otherwise in default hereundercompliance with the terms of this Lease, Tenant shall at all times during the Term Term, peaceably and quietly have, hold and enjoy the Premises without any disturbance from the Landlord or from any other person claiming through Landlord, subject to the terms of this Lease and to the rights of the parties presently or hereinafter secured by any deed of trust or mortgage against the Building.. Landlord covenants thatand agrees that Tenant, if Tenant is not in default hereunderupon making all of Tenant’s payments of Rent as and when due under the Lease, Tenant and upon performing, observing and keeping the covenants, agreements and conditions of this Lease on its part to be kept, shall at all times peaceably and quietly hold, occupy and enjoy the Property during the Term peaceably and quietly have, hold and enjoy the Premises without disturbance from Landlordof this Lease, subject to the terms and provisions of this Lease and to the rights of the parties presently or hereinafter secured by any deed of trust or mortgage against the BuildingLease.

Quiet Enjoyment. Landlord covenants that, if and agrees with Tenant is not in default hereunderthat upon Tenant paying the Rent and performing its other covenants and conditions under this Lease, Tenant shall at all times during have the Term peaceably and quietly have, hold and enjoy quiet possession of the Premises without disturbance from for the term of this Lease as against any persons or entities lawfully claiming by, through or under Landlord, subject subject, however, to the terms of this Lease and to the rights of the parties presently or hereinafter secured by any deed of trust or mortgage against the Buildingencumbrance.

Quiet Enjoyment. Landlord covenants thatwarrants that Tenant, if Tenant is not in default hereunderupon paying the rents and other charges herein provided, Tenant and performing each and every covenant hereof, shall at all times during the Term peaceably and quietly havehold, hold occupy and enjoy the Leased Premises without disturbance throughout the Term hereof peacefully and quietly, free from Landlord, subject to the terms of this Lease and to the rights of the parties presently molestation or hereinafter secured hindrance by any deed of trust person holding under or mortgage against the Buildingthrough Landlord.

Landlord covenants thatand agrees with Tenant that upon Tenant paying rent and other monetary sums due under the Lease, if Tenant is not in default hereunderperforming its covenants and conditions under the Lease and upon recognizing purchaser as Landlord pursuant hereto, Tenant shall at all times during the Term and may peaceably and quietly have, hold and enjoy the Premises without disturbance from Landlordfor the term, subject subject, however, to the terms of this the Lease and to the rights of any of the parties presently aforesaid ground leases, mortgages or hereinafter secured by any deed deeds of trust or mortgage against the Buildingdescribed above.
