RECOVERY ONLY ONCE. The Buyer is not entitled to recover more than once in respect of any one matter giving rise to a loss or liability under this Agreement.
RECOVERY ONLY ONCE. No Liability shall attach to the Seller in respect of any Claim to the extent that the same loss has been recovered by the Purchaser under any other Warranty or term of this agreement or any other document entered into pursuant hereto and accordingly the Purchaser may only recover once in respect of the same loss.
RECOVERY ONLY ONCE. Buyer is not entitled to recover more than once in respect of any one matter or loss giving rise to a Claim.
RECOVERY ONLY ONCE. No person may recover more than once under Section 6.15 or this Article IX in respect of any Loss.
RECOVERY ONLY ONCE. 7.1 Payment of any claim shall pro tanto satisfy and discharge the amount payable in respect of any other claim which is capable of being made in respect of the same loss giving rise to such claim.
7.2 The Vendor shall not be liable in respect of any claim to the extent that the subject of the claim has been or is made good or is otherwise compensated for without cost to the Purchaser.
RECOVERY ONLY ONCE. The Company is not entitled to recover more than once in respect of any one matter giving rise to a Relevant Claim.
RECOVERY ONLY ONCE. The Buyer is not entitled to recover more than once in respect of the same fact (or set of related facts) or matter (or set of related matters) giving rise to a General Warranty Claim.
RECOVERY ONLY ONCE. The Buyer and anyone deriving title from the Buyer on or after Completion is not entitled to recover to the extent there has previously been a recovery in respect of a particular Relevant Claim and, for the avoidance of doubt, no liability shall attach to RBS for any Relevant Claim to the extent the same loss occasioned to the Buyer or any Buyer's Group Undertaking or any other person deriving title from the Buyer or any such Buyer's Group Undertaking has been recovered pursuant to clause 2.3 and/or Schedule 11.
RECOVERY ONLY ONCE. The Buyer is not entitled to recover more than once in respect of any one matter giving rise to a Claim (other than with respect to the Tax Indemnities, but provided always, for the avoidance of doubt, that (a) the Seller’s liability shall be limited in accordance with quantum set out in paragraph 1.2.2 of this Schedule 9; and (b) the Buyer shall not be liable to indemnify the Seller twice in respect of the same Loss for instance, where such Loss is incurred by a Group Company and through such Group Company, the same Losses are incurred by the Buyer).
