Redemption due to Financial Hardship. In Alberta, Ontario, British Colombia and Nova Scotia, the contractholder may request redemption, in whole or in part, of the value of the contract associated with the SSQ LIF and request that it be paid in a lump sum or a series of payments, by making a written request for a release of all or part of the money due to financial hardship in order to obtain the latter’s written consent in accordance with applicable pension legislation. The application must be accompanied by all required documentations as specified in the applicable pension legislation. In Nova Scotia, the request must only be made to the superintendent of pensions. In Ontario, British Columbia and in Alberta, the request must only be made to SSQ in writing by means of the administrative form prescribed for this purpose under the terms of applicable pension legislation, then SSQ will determine if the request is in compliance with the pension legislation. SSQ proceeds with payment within 30 days of receipt of the duly completed request. In Ontario, the contractholder must include along with the redemption application, a written statement from the eligible spouse confirming the spouse’s consent to the redemption made under such circumstances, in accordance with applicable pension legislation, by filling out the Forms approved under this legislation. This consent is not required if the contractholder declares not having a spouse, if there is separation from bed and board on the date the redemption application is signed, or if the contractholder provides a statement certifying that the contributions invested in the SSQ LIF do not originate, directly or indirectly, from pension benefit credits related to any employment of his. The consent of the contractholder’s current spouse is also not required when the contract premiums associated with the SSQ LIF originates from retirement benefits of the contractholder’s ex-spouse as a result of the dissolution of their marriage or conjugal relationship. The application must also be accompanied by a signed statement indicating that it is understood that any funds released under the redemption shall not be exempt from execution, seizure or attachment, contrary to the exemptions provided for in this sense under applicable pension legislation.   • Financial Hardship Must include verification appropriate to the circumstance and must demonstrate a loss of income that has occurred since the cancellation deadline as stated in Section III C. The Licensee must submit a copy of the current academic year financial aid award summary for evaluation. Students must show that they have exhausted all viable options, including taking out student loans before a consideration to cancel is made.

  • Changes Due to a Life Event After the initial enrollment period and outside of any open enrollment period, an employee may elect to change health or dental coverage (including adding or canceling coverage) and any applicable employee contributions in the following situations (as long as allowed under the applicable provisions, regulations, and rules of the federal and state law in effect at the beginning of the plan year). The request to change coverage must be consistent with a change in status that qualifies as a life event, and does not include changing health or dental plans, which may only be done under the terms of Section 5A above. Any election to add coverage must be made within thirty (30) days following the event, and any election to cancel coverage must be made within sixty (60) days following the event. (An employee and a retired employee may add dependent health or dental coverage following the birth of a child or dependent grandchild, or following the adoption of a child, without regard to the thirty (30) day limit.) No such notice of redemption will be given earlier than sixty calendar days prior to the earliest date on which the Issuer or a Guarantor would be obligated to pay such Additional Amounts if a payment in respect of such Notes or the Guarantee were then due. Prior to the publication or mailing of any notice of redemption of the Notes as described above, the Issuer or a Guarantor shall deliver to the Trustee an opinion of an independent legal counsel of recognized standing stating that the Issuer or a Guarantor would be obligated to pay Additional Amounts due to the changes in tax laws, treaties or regulations or in the application or official interpretation thereof. The Trustee shall accept such opinion as sufficient evidence of the satisfaction of the conditions precedent set forth above, in which event it will be conclusive and binding on the Holders.

  • Redemption for tax reasons The Issuer may redeem the Notes in whole, but not in part, at any time at their Early Redemption Amount, together, if appropriate, with accrued but unpaid interest to (but excluding) the date fixed for redemption under this Condition 6(b), if the Issuer shall determine that as a result of any change in, or amendment to, the laws (or any regulations or rulings promulgated thereunder) of the jurisdiction in which the Issuer is incorporated or any political subdivision or any authority thereof or therein having power to tax, or any change in the application or official interpretation of such laws, regulations or rulings, which change or amendment becomes effective on or after the Issue Date of the Notes, the Issuer would be required to pay Additional Amounts, as provided in Condition 7, on the occasion of the next payment due in respect of the Notes. Notice of intention to redeem Notes will be given at least once in accordance with Condition 16 not less than 30 days nor more than 60 days prior to the date fixed for redemption under this Condition 6(b), provided that no such notice of redemption shall be given earlier than 90 days prior to the effective date of such change or amendment and that at the time notice of such redemption is given, such obligation to pay such Additional Amounts remains in effect. From and after any redemption date, if moneys for redemption of Notes shall have been made available for redemption on such redemption date, such Notes shall cease to bear interest, if applicable, and the only right of the holders of such Notes and any Coupons appertaining thereto shall be to receive payment of the Early Redemption Amount and, if appropriate, all unpaid interest accrued to (but excluding) such redemption date.

  • Transfer Due to Divorce If all or any part of your Xxxx XXX is awarded to your spouse or former spouse in a divorce or legal separation proceeding, the amount so awarded will be treated as the spouse’s Xxxx XXX (and may be transferred pursuant to a court-approved divorce decree or written legal separation agreement to another Xxxx XXX of your spouse), and will not be considered a taxable distribution to you. A transfer is a tax-free direct movement of cash and/or property from one Xxxx XXX to another.

  • Recurring Disabilities (a) Employees who return to work after being absent because of illness or injury, and within five (5) consecutive scheduled days of work again become unable to work because of the same illness or injury are considered to still be within the original Short Term Plan period as defined in Section 1.2(a).
