Reduction in Force List Sample Clauses
A Reduction in Force List clause defines the process and criteria for identifying employees who may be subject to layoff or termination during workforce reductions. Typically, this clause outlines how employees are selected for inclusion on the list, such as by seniority, job performance, or specific roles, and may require the employer to provide advance notice or severance benefits to affected individuals. Its core practical function is to ensure transparency and fairness in the layoff process, minimizing disputes and providing a clear framework for both employers and employees during organizational downsizing.
Reduction in Force List. The Board will develop and provide the Association with a RIF list of potentially affected teachers which will be based on the following criteria:
1. Limited contract teachers shall be reduced by using the following order:
a. Certification/licensure; then
b. Evaluation results; then
c. If the evaluation results are “comparable” as defined in paragraph 3 below, seniority in the district as established by the final seniority list in March of that year.
2. Continuing contract teachers may be reduced only after all limited contract teachers of the same certification, by using the following order:
a. Certification/licensure; then
b. Evaluation results; then
c. If the evaluation results are “comparable” as defined in paragraph 3 below, seniority in the district as established by the final seniority list in March of that year.
3. During the term of this contract, classroom teachers and non- classroom teachers with summative evaluation ratings of Accomplished, Skilled, or Developing will be considered to have “comparable” evaluation results. A classroom teacher will not be assigned an Ineffective rating for purposes of “comparable” evaluation results until that teacher has two (2) full years of student growth data available for that teacher and received two (2) consecutive years of an ineffective summative rating. A non- classroom teacher’s summative rating is based solely on their overall performance rating.
Reduction in Force List. Employees selected for suspension of contract shall immediately be placed upon a Reduction in Force (RIF) list compiled from the seniority lists provided in Section 1.03 I. Employees non-renewed for performance reasons shall not appear on this list. An employee whose name appears on the RIF list shall be offered re- employment when a position becomes available for which he/she is certified. Employees on the RIF list shall be offered re-employment to positions for which he/she is certified based on OTES evaluation, if evaluations are comparable then in the order of seniority at the time he/she is suspended. No new employees shall be employed by the Board while there are employees on the RIF list who are certified for any opening of a teaching position.
Reduction in Force List. Within fifteen (15) days after the Board sends out suspension notices, it shall prepare, post and send to the Association President a Reduction in Force List. The Reduction in Force List shall state:
A. All positions in each area of certification/licensure affected by the reduction in force:
B. The names and length of continuous service of all teachers within each affected area of certification/licensure; and
C. Whether or not the teacher was suspended. Copies of this list shall also be sent to each teacher on suspension. The list shall be kept current and updated copies shall be sent to the Association President and to each teacher on suspension.

2. The names of teachers whose contracts are suspended in a reduction in force will be placed on a recall list for up to 24 months from the date of the reduction.
