Referral To NERSA. Subject to clause 26.3 (Expedited Dispute Resolution), either Party may, with the written agreement of the other Party, refer any Dispute to the NERSA for mediation in accordance with the Act and the Code(s) but, in the absence of such written agreement, either Party may refer such Dispute forthwith to arbitration in accordance with clause 26.4 (Arbitration). If the Parties agree to mediation on any Dispute but such mediation fails within [30 (thirty)] days of such referral or such longer period as agreed between them, then either Party may following the expiry of such period refer such Dispute to arbitration in accordance with clause 27.4 (Arbitration)
