Refusal to Submit to a Fit For Duty or Drug Test and the Consequences of Positive Results. No employee Fit For Duty or substance test will be conducted without the employee’s consent. If an employee; 1. Refuses to consent to a Fit For Duty or drug test, the employee discipline up to and including discharged 2. Consents to a drug test and the test results are positive; the employee will be counseled and is subject to termination. The employee’s prior employment record and impact of current behavior will be considered in determining the appropriate course of action.

  • Exclusive Negotiations The State will not bargain collectively or meet with any employee organization other than MSEA-SEIU with reference to terms and conditions of employment of employees covered by this Agreement.
