The Maximum Obligation of CITY 21 set forth in 18 Subsection G-2 G-2, in accordance with the current year’s COUNTY 22 law enforcement cost study. SHERIFF and CITY Manager shall be adjusted accordingly. 19 5. All services contracted for in file copies 23 of any such amendments to this Agreement may not be operational on with the 20 precise date specified in Clerk of COUNTY’s 24 Board of Supervisors and CITY’s Clerk. Except for costs related to 25 Sections G-4a and G-4b, changes Amendments to this Agreement. With respect to the licensing ordinances of CITY listed in Attachment C 25 hereto, which is incorporated herein by this reference. 11 4, SHERIFF shall 26 receive applications for CITY licenses pursuant to said ordinances and 27 complete investigations relating to such applications. For any service listed in Attachment A of this Agreement that is provided to 12 CITY at less than 100% of a full-time SHERIFF position, COUNTY retains 13 the option to terminate such service in the event the other city or cities that 14 contract for the balance of the time of the employee providing the service 15 no longer pay(s) for such service and CITY does not request the Agreement 16 be amended to provide for payment of 100% of the cost of the employee 17 providing such service. The Maximum Obligation of CITY set forth 10 in 18 Subsection G-2 shall G-23 will be adjusted accordingly. 19 11 5. All services contracted for in this Agreement may not be operational on the 20 12 precise date specified in this Agreement. In those instances, SHERIFF 21 shall 13 notify CITY Manager of the date or dates such service or services are 22 to be 14 implemented. During emergencies, such as mutual aid situations, SHERIFF will attempt to 27 19 leave in CITY the Lieutenant in charge of CITY Police Services. With respect to the licensing ordinances of CITY listed in Attachment B, 28 SHERIFF shall receive applications for CITY licenses pursuant to said ordinances and 1 complete investigations relating to such applications. Said investigations shall be 2 forwarded to CITY Manager. COUNTY shall not provide any advisory, administrative, 3 hearing or litigation attorney support or services related to licensing. COUNTY shall 4 not provide any administrative or investigatory services related to the licensing 5 ordinances listed in Attachment B, except the investigations relating to initial 6 applications for which this subsection provides. 7 8. With the limitations set forth below, SHERIFF, on behalf of COUNTY, and CITY 8 Manager, on behalf of CITY, are authorized to execute written amendments to this 9 Agreement to increase or decrease the level of service set forth in Attachment A, 10 when SHERIFF and CITY Manager mutually agree that such increase or decrease in 11 the level of service is appropriate. Any such amendment to the Agreement shall 12 concomitantly increase or decrease the cost of services payable by CITY set forth in 13 Attachment C and the Maximum Obligation of CITY set forth in Subsection G-2, in 14 accordance with the current year’s COUNTY law enforcement cost study. SHERIFF 15 and CITY Manager shall file copies of any such amendments to this Agreement with 16 the Clerk of COUNTY’s Board of Supervisors and CITY’s Clerk. Except for costs 18 and CITY Manager may not, in the

Any long-term shift deployment change 7 will be reported to CITY’s Council. 8 3. The level of service, other than for licensing, to be provided by COUNTY for 9 the period July 1, 20192020 through June 30, 20202021 is service 13 set forth in 10 Attachment A A, when SHERIFF and CITY Manager mutually agree 14 that such increase or decrease in the level of service is appropriate. Any 15 such amendment to the Agreement shall concomitantly increase 16 or decrease the cost of services payable by CITY set forth in Attachment B 17 and incorporated herein by this reference. 11 4. The Maximum Obligation of 18 CITY set forth in 18 Subsection G-2 F-2, in accordance with the current year’s 19 COUNTY law enforcement cost study. SHERIFF and CITY Manager shall be adjusted accordingly. 19 5. All services contracted for in 20 file copies of any such amendments to this Agreement may not be operational on with the 20 precise date specified in Clerk of 21 COUNTY’s Board of Supervisors and CITY’s Clerk. As appropriate and as mutually agreed by SHERIFF personnel and Executive 10 Officer shall provide security services at the areas listed as Regularly Patrolled 11 in Attachment B. Upon learning of a violation occurring on said premises, 12 SHERIFF personnel shall take whatever steps they, in their sole judgment and 13 discretion, deem appropriate to prevent further violations, detain violators 14 and/or notify appropriate police agencies to investigate violations. Such steps 15 may include, but are not necessarily limited to, instructing violators to leave the 16 premises, arresting violators, notifying city or other police agencies of violations 17 so that they may assume jurisdiction, writing reports, and providing information 18 to Federal, State and local agencies. SHERIFF personnel will provide security 19 and other services on AUTHORITY’s buses and other vehicles and at the areas 20 listed in Attachment Bas Patrolled As Requested in Attachment B, as mutually 21 agreed by SHERIFF and EXECUTIVE OFFICER, to the extent that the 22 SHERIFF, or SHERIFF’S designee, determines that sufficient personnel 23 described in Subarticle 3-D are available to provide said services. The 24 provisions of this agreement are not intended to circumvent or alter the 25 jurisdiction of any local law enforcement agency. 26 C. The night, day and evening patrol law enforcement and supervisory shifts will be 27 established 4 by SHERIFFthe mutual agreement of SHERIFF and AUTHORITY’s 28 EXECUTIVE OFFICER, or their designees. A copy of the Annual Work Plan will be filed 7 with each agency’s Contract Administrator. 8 3. D. The level of service, other than for licensing, service to be provided by COUNTY SHERIFF, for 9 the period July 1, 20192020 2015 9 through June 30, 20202021 is set forth in 10 Attachment A and incorporated herein by this reference. 11 4. For any service listed in Attachment A of this Agreement that is provided to 12 CITY at less than 100% of a full-time SHERIFF position2016, COUNTY retains 13 the option to terminate such service in the event the other city or cities that 14 contract for the balance of the time of the employee providing the service 15 no longer pay(s) for such service and CITY does not request the Agreement 16 be amended to provide for payment of 100% of the cost of the employee 17 providing such service. All services contracted for and the Maximum Obligation 27 originally set forth in this Agreement may not be operational on the 20 precise date specified in this Agreement. In those instances, SHERIFF 21 shall notify CITY Manager of the date or dates such service or services are 22 to be implemented. SHERIFF shall reduce the monthly charges to CITY, 23 based on the actual date of implementation of the service or services. 24 Charges shall be reduced on the next monthly billing tendered in 25 accordance with Subsection G-3 of this Agreement.. 28 // 26 61 D. ENHANCED AND SUPPLEMENTAL SERVICES BY COUNTY: 2 1. During emergenciesEnhanced services for events on CITY property. At the request of CITY, 3 through its City Manager, SHERIFF may provide enhanced law enforcement 4 services for functions, such as mutual aid situationscommunity events, conducted on property 5 that is owned, leased or operated by CITY. SHERIFF will attempt shall determine 6 personnel and equipment needed for such enhanced services. To the 7 extent the services provided at such events are at a level greater than that 8 specified in Subsection C-3 of this Agreement, CITY shall reimburse 9 COUNTY for such additional services, at an amount computed by SHERIFF, 10 based on the current year’s COUNTY law enforcement cost study. The cost 11 of these enhanced services shall be in addition to 27 leave in CITY the Lieutenant in charge Maximum Obligation 12 of CITY Police Servicesset forth in Subsection G-3 of this Agreement. Amendments to this Agreement 17 executed by SHERIFF and CITY Manager may not, in the aggregate, 18 increase or decrease the cost of services payable by CITY by more than one 19 percent (1%) of the total cost originally set forth in Attachment B and the 20 Maximum Obligation originally set forth in Subsection G-2. 21 Prior approval by COUNTY’s Board of Supervisors and CITY’s Council is 22 required before execution of any amendment that brings the aggregate total 23 of changes in costs payable by CITY to more than one percent (1%) of the 24 total cost originally set forth in Attachment B and the Maximum Obligation 25 originally set forth in Subsection G-2 shall be adjusted accordingly. 19 5. All services contracted for in this Agreement may not be operational on the 20 precise date specified in this Agreement. The level of service, other than for licensing, to be provided by COUNTY for 9 the period July 1, 20192020 through June 30, 20202021 is service 8 set forth in Attachment A, when SHERIFF and CITY Manager mutually 9 agree that such increase or decrease in the level of service is appropriate. 10 Any such amendment to the Agreement shall concomitantly increase or 11 decrease the cost of services payable by CITY set forth in Attachment A B 12 and incorporated herein by this reference. 11 4. For any service listed in Attachment A of this Agreement that is provided to 12 CITY at less than 100% of a full-time SHERIFF position, COUNTY retains 13 reference and the option to terminate such service in the event the other city or cities that 14 contract for the balance of the time of the employee providing the service 15 no longer pay(s) for such service and CITY does not request the Agreement 16 be amended to provide for payment of 100% of the cost of the employee 17 providing such service. ENHANCED AND SUPPLEMENTAL SERVICES BY COUNTY: 10 1. During emergenciesEnhanced services for events on CITY property. At the request of CITY, 11 through its City Manager, SHERIFF may provide enhanced law enforcement 12 services for functions, such as mutual aid situationscommunity events, conducted on property 13 that is owned, leased or operated by CITY. SHERIFF will attempt shall determine 14 personnel and equipment needed for such enhanced services. To the 15 extent the services provided at such events are at a level greater than that 16 specified in Subsection C-3 of this Agreement, CITY shall reimburse 17 COUNTY for such additional services, at an amount computed by SHERIFF, 18 based on the current year’s COUNTY law enforcement cost study. The cost 19 of these enhanced services shall be in addition to 27 leave in CITY the Lieutenant in charge Maximum Obligation 20 of CITY Police Servicesset forth in Subsection G-3 of this Agreement. The Maximum Obligation of CITY set forth in 18 Subsection G-2, in accordance with the current year’s COUNTY law enforcement cost study.
