Common use of REJECTION OF DEFECTIVE EQUIPMENT Clause in Contracts

REJECTION OF DEFECTIVE EQUIPMENT. If the completed installation / equipment or any portion thereof, after it is taken over, is found to be defective or fails to fulfill the intent of the specifications, the firm shall on receipt of a written notice from the Engineer – in – charge, forthwith make good the defective installation / equipment. Should the firm fail to rectify the defects / make good the defective installation / replace the equipment at no extra cost, within a stipulated time mentioned in the written notice, department may get the work done at the risk and expenses of the firm.
