Common use of Release of Claims as Condition Clause in Contracts

Release of Claims as Condition. The Company's obligation to pay the separation allowance and provide all other benefits and rights (including equity vesting) referred to in this Agreement shall be conditioned upon the Executive having delivered to the Company an executed full and unconditional release of claims against the Company, its parent entities, affiliates, employee benefit plans and fiduciaries, officers, employees, directors, agents and representatives satisfactory in form and content to the Company's counsel.

Release of Claims as Condition. The Company's ’s obligation to pay the separation allowance and provide all other benefits and rights (including equity vesting) referred to in this Agreement Section 6 (other than Accrued Payments) and in Section 3(C) above shall be conditioned upon the Executive having delivered to the Company an executed separation agreement and full and unconditional release (that is not subject to revocation) of claims against the Company, its parent entities, affiliates, employee benefit plans and fiduciaries, officers, employees, directors, agents and representatives satisfactory in form and content to the Company's ’s counsel.
