Reliance on a System. Each Participant acknowledges and agrees that: (i) the Message Content provided by, or through, its System is drawn from numerous sources, and (ii) it can only confirm that, at the time Message Content is Transacted, the information and Message Content Transacted are an accurate representation of data contained in, or available through, its System. Nothing in this Agreement shall be deemed to impose responsibility or liability on a Participant related to the clinical accuracy, content or completeness of any Message Content provided pursuant to this Agreement. The Participants acknowledge that other Participants’ Digital Credentials may be activated, suspended or revoked at any time or the Participant may suspend its participation; therefore, Participants may not rely upon the availability of a particular Participant’s Message Content.
Reliance on a System. Each Participating Agency acknowledges and agrees that (i) the data provided to the Data Integration Hub is drawn from numerous sources; (ii) the data is specific to the point in time when drawn, and (iii) it can only confirm that, at the time of the data Transmittal, the data is an accurate representation of data contained in, or available through, the Data Integration Hub. Nothing in the DSA shall be deemed to impose responsibility or liability on a Participating Agency related to the clinical accuracy, content or completeness of any data provided pursuant to the Data Integration Hub. Furthermore, Data Recipient may not rely upon the availability of a particular Participating Agency’s data.
Reliance on a System. Participants may not rely upon the availability of a particular Participant’s Health Data, if such Health Data is provided as part of the particular service to which Participant is subscribed.

Nothing in this Agreement shall be deemed to impose responsibility or liability on a Party related to the clinical accuracy, content or completeness of any Message Content provided pursuant to this Agreement. Each Party acknowledges that neither it nor its Participant Members may rely upon the availability of Message Content from the other Party.

Participant acknowledges and agrees that at the time an eICR is Transmitted, the information and such eICR Transmitted are an accurate representation of data contained in, or available through, its System. Nothing in this Agreement shall be deemed to impose responsibility or liability on Participant related to the clinical accuracy, content or completeness of any eICR provided pursuant to this Agreement. Patient Care. Participant, if he/she/it is a Health Care Provider, shall be responsible for all decisions and actions taken or not taken involving patient care, utilization management, and quality management for his/her/its respective patients and clients. APHL, by virtue of executing this Agreement, does not assume any role in the care of any patient and will not be responsible for any decision or action involving patient care. Carrier Lines. Transmission of eICRs is to be provided over various facilities and communications lines, and information shall be transmitted over local exchange and Internet backbone carrier lines and through routers, switches, and other devices (collectively, “carrier lines”) owned, maintained, and serviced by third-party carriers, utilities, and Internet service providers, all of which may be beyond the Parties’ control. Provided a Party uses reasonable security measures no less stringent than those directives, instructions, and specifications contained in this Agreement and the Specifications, the Parties assume no liability for or relating to the integrity, privacy, security, confidentiality, or use of any information while it is transmitted over those carrier lines, which are beyond the Parties’ control, or any delay, failure, interruption, interception, loss, transmission, or corruption of any eICR or other information attributable to transmission over those carrier lines which are beyond the Parties’ control. Use of the carrier lines is solely at the Parties’ risk and is subject to all Applicable Law. No Warranties. Nothing in this Agreement shall be deemed to impose responsibility or liability on a Participant related to the clinical accuracy, content or completeness of any Data provided pursuant to this Agreement. The Participants acknowledge that other Participants may be added or terminated as participants in the NHIN at any time; therefore, Participants may not rely upon the availability of a particular Participant’s Data.

Each Participant acknowledges and agrees that (i) the information provided through its System is drawn from numerous sources and commingled on its System, and (ii) it can only confirm that the information and Test Data provided is an accurate reproduction of the data that is contained in its System. Each Participant shall be solely responsible for communicating, and shall communicate, the contents of this Section 16.01

The Participants acknowledge that other Participants’ Digital Credentials may be activated, suspended or revoked at any time or the Participant may suspend its participation; therefore, Participants may not rely upon the availability of HIE Data.
Reliance on a System. Participant may not rely upon the availability of a particular Participant’s Health Data. Participant is responsible for developing and maintaining backup procedures to be used in the event of a failure or unavailability of the Network, and is responsible for implementing any such backup procedures, as determined necessary by Participant.
