Common use of Remedial Work Clause in Contracts

Remedial Work. Notwithstanding any previous test or certification, the Authority Engineer mayinstruct the Contractor to: (a) remove from the Site and replace any Plant or Materials which are not inaccordance with the provisions of this Agreement; (b) remove & re-execute any work which is not in accordance with the provisions ofthis Agreement and the Specification and Standards; and (c) execute any work which is urgently required for the safety of the Railway Project, whether because of an accident, unforeseeable event or otherwise; provided thatin case of any work which is required on account of a Force Majeure Event, the provisions of Clause 19.6 shall apply.
