Common use of Repair and classification Clause in Contracts

Repair and classification. The Borrower shall procure that each Owner shall keep the Ship owned by it in a good and safe condition and state of repair: (a) consistent with first-class ship ownership and management practice; (b) so as to maintain the highest class with a first-class classification society which is a member of IACS acceptable to the Agent free of overdue recommendations and conditions of such classification society; and (c) so as to comply with all laws and regulations applicable to vessels registered at ports in the relevant Approved Flag State or to vessels trading to any jurisdiction to which the Ship may trade from time to time, including but not limited to the ISM Code, the ISPS Code, the ISM Code Documentation and the ISPS Code Documentation.

The Borrower shall procure that each Owner shall keep the Ship or Ships (as the case may be) owned by it in a good and safe condition and state of repair: (a) consistent with first-class ship ownership and management practice; (b) so as to maintain the highest that Ship’s class with a first-class classification society which is a member of IACS acceptable to the Agent free of overdue recommendations and conditions of such classification societyaffecting that Ship’s class with its Classification Society; and (c) so as to comply with all laws and regulations applicable to vessels registered at ports in the relevant Approved Flag State jurisdiction in which the Ship is registered, or to vessels trading to any jurisdiction to which the that Ship may trade from time to time, including but not limited to the ISM Code, Code and the ISPS Code, the ISM Code Documentation and the ISPS Code Documentation.

The Borrower shall procure that each Owner shall keep the Ship owned by it in a good and safe condition and state of repair: (a) consistent with first-class ship ownership and management practice; (b) so as to maintain the highest class classification set out opposite each Ship in Schedule 5 with a first-class classification society which is a member of IACS and acceptable to the Agent free (acting on the instructions of overdue recommendations and conditions of such classification societythe Majority Lenders); and (c) so as to comply with all laws and regulations applicable to vessels registered at ports in the relevant applicable Approved Flag State or to vessels trading to any jurisdiction to which the Ship may trade from time to time, including but not limited to the ISM Code, Code or the ISPS Code, the ISM Code Documentation and the ISPS Code Documentation.

The Borrower shall procure that each the Owner shall keep the Ship owned by it in a good and safe condition and state of repair: (a) consistent with first-class ship ownership and management practice; (b) so as to maintain the highest class Containership - AUT-UMS, free of overdue recommendations and conditions, with a first-class Bureau Veritas classification society which is a member of IACS and acceptable to the Agent free of overdue recommendations and conditions of such classification societyLender; and (c) so as to comply with all laws and regulations applicable to vessels registered at ports in the relevant applicable Approved Flag State or to vessels trading to any jurisdiction to which the Ship may trade from time to time, including but not limited to the ISM Code, the ISPS CodeISM Code Documentation, the ISM ISPS Code Documentation and the ISPS Code Documentation.

Repair and classification. The Borrower shall procure that each Owner shall keep the Ship owned by it in a good and safe condition and state of repair: (a) consistent with first-class ship ownership and management practice; (b) so as to maintain the Ship with the highest class available for vessels of the same type, age and specification as the Ship with a first-class classification society which is a member Lloyd’s Register of IACS acceptable to the Agent Shipping free of overdue outstanding recommendations and conditions of such classification societysociety affecting the Ship’s class; and (c) so as to comply with all laws and regulations applicable to vessels registered at ports in the relevant Approved Flag State or to vessels trading to any jurisdiction to which the Ship may trade from time to time, time including but not limited to the ISM Code, the ISPS Code, Code and the ISM Code Documentation and the ISPS Code Documentation.

The Borrower shall procure that each Owner shall keep the Ship owned by it in a good and safe condition and state of repair: (a) consistent with first-class ship ownership and management practice; (b) so as to maintain the highest class with a applicable to vessels of the same age, type and specification as such Ship at (or such other first-class classification society which is a member of IACS acceptable to the Agent Agent) free of overdue recommendations and conditions of such classification societyconditions; and (c) so as to comply with all laws and regulations applicable to vessels registered at ports in where the relevant Approved Flag State Ship is registered or to vessels trading to any jurisdiction to which the Ship may trade from time to time, including but not limited to the ISM Code, the ISPS Code, the ISM Code Documentation and the ISPS Code Documentation.

The Borrower shall procure that each Owner shall keep the Ship owned by it in a good and safe condition and state of repair: (a) consistent with first-class ship ownership and management practice; (b) with a classification society (being a member of the International Association of Classification Societies) acceptable to the Lenders so as to maintain the highest class for its type with a first-class such classification society which is a member of IACS acceptable to the Agent free of any material overdue recommendations and conditions of such classification societyconditions; and (c) so as to comply with all laws and regulations applicable to vessels registered at ports in the relevant Approved Flag State or to vessels trading to any jurisdiction to which the Ship may trade from time to time, including but not limited to the ISM Code, Code and the ISPS Code, the ISM Code Documentation and the ISPS Code Documentation.
