Common use of Repair and classification Clause in Contracts

Repair and classification. Each Borrower shall keep the Ship owned by it in a good and safe condition and state of repair: (a) consistent with first-class ship ownership and management practice; (b) so as to maintain the highest class free of overdue recommendations and conditions, with a classification society which is a member of IACS and acceptable to the Agent; and (c) so as to comply with all laws and regulations applicable to vessels registered at ports in the applicable Approved Flag State or to vessels trading to any jurisdiction to which that Ship may trade from time to time, including but not limited to the ISM Code and the ISPS Code.

Each Ship Owning Borrower shall keep the Ship owned by it in a good and safe condition and state of repair: (a) consistent with first-class ship ownership and management practice; (b) so as to maintain the highest class notation available for ships of a similar type and specification free of overdue recommendations and conditions, with a classification society which is a member of IACS and acceptable conditions save to the Agentextent agreed by the Lender in writing; and (c) so as to comply with all laws and regulations applicable to vessels registered at ports in the applicable Approved Flag State Bahamas or to vessels trading to any jurisdiction to which that the Ship owned by it may trade from time to time, time including but not limited to the ISM Code and the ISPS Code.

Each Borrower shall keep the Ship owned by it in a good and safe condition and state of repair: (a) consistent with first-class first‑class ship ownership and management practice; (b) so as to maintain the highest class free of overdue recommendations and conditions, with a first class classification society (which is a member of IACS and acceptable to the AgentLender) free of overdue recommendations and conditions affecting class; and (c) so as to comply with all laws and regulations applicable to vessels registered at ports in under the applicable Approved Flag State or to vessels trading to any jurisdiction to which that Ship may trade from time to time, including but not limited to the ISM Code and the ISPS Code, and shall provide evidence acceptable to the Lender, upon the Lender's request, that its Ship maintains such class.
