Repayments received by a lender. Any amount received by a lender under a life insurance contract that is part of a split-dollar life insurance arrange- ment is treated as though the amount had been paid to the borrower and then paid by the borrower to the lender. Any amount treated as received by the bor- rower under this paragraph (m) is sub- ject to other provisions of the Internal Revenue Code as applicable (for exam- ple, sections 72 and 101(a)). The lender must take the amount into account as a payment received with respect to a split-dollar loan, in accordance with paragraph (k) of this section. No amount received by a lender with re- spect to a split-dollar loan is treated as an amount received by reason of the death of the insured.

  • Commitment of Current Revenues Only In the event that, during any term hereof, the Commissioners Court does not appropriate sufficient funds to meet the obligations of County under this Agreement, County may terminate this Agreement upon ninety (90) days written notice to Company. County agrees, however, to use reasonable efforts to secure funds necessary for the continued performance of this Agreement. The parties intend this provision to be a continuing right to terminate this Agreement at the expiration of each budget period of County. Agreements for the acquisition, including lease of real or personal property under Tex. Loc. Govt. Code §271.903: In the event that, during any term hereof, the Commissioner’s Court does not appropriate sufficient funds to meet the obligations of County under this Agreement, County may terminate this Agreement upon ninety (90) days written notice to Company, County agrees, however, to use a best efforts attempt to obtain and appropriate funds for payment of the Agreement.
