Common use of Replacement of Carts Clause in Contracts

Replacement of Carts. Contractor’s employees must take care to prevent damage to Carts 1301 by unnecessary rough treatment. However, any Cart damaged by the Contractor must be replaced by 1302 Contractor, at Contractor's expense, within five (5) Work Days at no cost or inconvenience to the Service 1303 Recipient. 1304 10.05.1 Upon notification to Contractor by City or a Service Recipient that the Service 1305 Recipient’s Cart(s) has been stolen or damaged beyond repair through no fault of Contractor, Contractor 1306 must deliver a replacement Cart(s) to such Service Recipient within five (5) Work Days. Within five (5) Work 1321 Days of notification by the City or a Service Recipient of the need for such repairs, Contractor must repair 1322 the Cart or if necessary, remove the Cart for repairs and deliver a replacement Cart to the Service Recipient.

If any such changes are adopted after the Cart or if necessaryEffective Date that results in Contractor being required to replace Collection Containers after they have been replaced in accordance with the replacement schedule in Exhibit 12 but, remove the Cart before they have been fully depreciated, Contactor will be eligible for repairs and deliver a replacement Cart to the Service Recipientadditional compensation in accordance with Section 4.09.

Contractor CONTRACTOR must 1307 maintain records documenting all Cart replacements occurring and report through the Waste Reporting 1308 System monthlyon a monthly basis. 8.20.2.2. 1309 10.05.2 Each Service Recipient is entitled to the replacement of one (1) damaged by no fault of Service Recipient, lost, destroyed, or 1310 stolen Cart every ten (10) years during the life of this Agreement at no cost to the Service Recipient. Except 1311 in the case of a Cart that must be replaced because of damage caused by Contractor CONTRACTOR or in the case where 1312 Contractor CONTRACTOR elects to replace a Cart rather than repair it on-site, Contractor CONTRACTOR will be compensated for the cost 1313 of those replacements in excess of one (1) per type of Cart per Service Recipient every ten (10) years during the term of the 1314 Agreement, in accordance with the “Cart Exchange” Service Rate set forth in Exhibit 1, or as may be 1315 adjusted by the City CITY from time to time as provided under this Agreement. 8.20.2.3. 1317 CONTRACTOR understands and agrees that this provision is intended to be applied on a per Cart type, individual Service Recipient basis and accordingly each Service Recipient could receive 1318 up to three (3) replacement Carts, one (1) of each type, every ten (10) years during the term of the contractAgreement. 8.20.2.4. 1319 10.05.4 Repair CONTRACTOR must comply with CalRecycle container requirements as they may apply during the term of Garbagethis Agreement. If any such changes are adopted after the Effective Date that results in CONTRACTOR being required to replace containers before they have been fully depreciated, Recycling and Organic Waste Carts. Contractor is responsible 1320 CONTACTOR will be eligible for the repair of Carts, including but not be limited to, hinged lids, wheels and axles. Within five (5) Work 1321 Days of notification by the City or a Service Recipient of the need for such repairs, Contractor must repair 1322 the Cart or if necessary, remove the Cart for repairs and deliver a replacement Cart to the Service Recipientadditional compensation in accordance with this Agreement.
