Collection Equipment. A. Any and all vehicles used by Franchisee to perform solid waste collection services shall be inspected annually and meet all requirements related to health and safety, specifications, vehicle inspections, certification and covered load requirements of EGMC Title 30, Sections 30.50.060, 070, and 080. B. Franchisee shall submit a vehicle inventory of Franchisee’s vehicles triennially, as required by EGMC Section 30.50.070 (B), which shall include but not be limited to, vehicle number, year, make, model, capacity, and vehicle identification number (VIN). Franchisee’s vehicle inventory shall be submitted in a form and manner approved by the City. C. Franchisee shall maintain a current list of its vehicles and shall submit to City an amended vehicle inventory upon request of the City or upon any changes in the inventory, such as new or replacement vehicles, as required by EGMC Section 30.50.070 (D). D. Collection Vehicle Size Limitations / Overweight Vehicle Charge. Franchisee may not use any Collection vehicle for Collection Service in violation of weight limitations set forth in Applicable Law. Franchisee may be assessed liquidated damages as set forth in Exhibit C as a result of exceeding the total overweight vehicle rate of ten percent (10%) annually, during the term of the Contract. The overweight vehicle rate will be calculated as the total number of overweight collection vehicle instances during each month, divided by the total number of collection vehicle loads transported during the same corresponding month. Prior to collecting administrative charges for overweight vehicles, the City shall afford Franchisee a reasonable opportunity to provide the Contract Administrator documentation of the extraordinary circumstance that caused the overweight vehicles. Extraordinary circumstances in this particular case include, but may be limited to, heavy rains or high winds that caused excess Organic Recyclable Material to be generated, rain to accumulate in open Collection Containers, or normal Collection routes to be delayed or shortened to extreme weather conditions. The City shall have authority to consider Franchisee's documentation and uphold and collect the assessed charge, to reduce the charge, or waive and dismiss the charge. The CITY shall also have the authority to waive charges in advance of an anticipated, or in response to and actual, emergency event.
Collection Equipment. The Contractor shall have on hand at all times and in good working order such equipment as shall permit the Contractor to adequately and efficiently perform the contractual duties specified in this Agreement. Upon execution of this Agreement and annually thereafter, the Contractor shall provide, in a format specified by the Contract Administrator, a list of the equipment to be used by the Contractor to provide services relating to this Agreement. Solid Waste and Recycling Collection equipment shall be of the enclosed loader packer type, or other equipment that meets industry standards and is approved by the Contract Administrator, unless otherwise provided within this Agreement. All Equipment shall be kept in good repair, appearance and in a sanitary, clean condition at all times. The County has the right to inspect collection equipment during collection routes. Equipment utilized for Collection of Recyclable Materials shall be clearly identified for that purpose. The Contractor shall have available reserve equipment which can be put into service within two (2) hours of any breakdown and a prompt notifications shall be provided to County staff. Such reserve equipment shall correspond in size and capacity to the equipment used by the Contractor to perform the contractual duties. If the public road or public right-of-way in the Service Area is substandard, as specifically designated by the Contract Administrator, in writing, the Contractor must provide lightweight equipment to service these roads (i.e., gross vehicle weight not to exceed 15 tons). Service on these substandard roads shall be a minimum of one combined Solid Waste and Vegetative Waste Collection and one separate Recycling Collection per week. In the event that Solid Waste designated to be disposed of at the Resource Recovery Facility has to be disposed of at the a landfill, the Contractor shall make arrangements to keep tires separated from other Solid Waste. The Contractor's vehicles, roll-off Containers, dumpsters and other equipment must be clearly identified with the name, phone number of the company's local office and equipment number on each side of the equipment and the equipment identification number shall also be on the front and rear of each vehicle. The Contractor shall allow commercial customers to select either top loading or side loading 6 and 8 cu. yd. dumpsters and shall provide the type requested by the commercial customer. Collection Equipment. The Contractor shall provide an adequate number of vehicles for regular collection services. All vehicles and other equipment shall be kept in good repair, appearance, and in a sanitary condition at all times. Each vehicle shall have clearly visible on each side the identity and telephone number of the Contractor.

All vehicles and other equipment shall be maintained and operated in full compliance with all federal, state, and local laws, kept in good repair, appearance, and in a sanitary condition at all times. In the event any of Contractor’s equipment leaks fuel or other fluids onto City streets or alleys, Contractor will take all reasonable steps necessary to remediate such spills.

FRANCHISEE shall submit a Commercial Solid Waste Vehicle Inventory Form of FRANCHISEE’s vehicles, as required in SCC section 6.20.245, which shall include but not be limited to, vehicle number, year, make, model, capacity, and vehicle identification number (VIN). FRANCHISEE is required to submit its Commercial Solid Waste Vehicle Inventory Form annually as part of its FRANCHISEE Application for COUNTY Franchise. FRANCHISEE’S Commercial Solid Waste Vehicle Inventory Form shall be approved by the COUNTY. C. FRANCHISEE shall maintain a current list of its vehicles and shall submit to COUNTY Director an amended FRANCHISEE Commercial Solid Waste Vehicle Inventory Form, upon request of COUNTY, if such changes occur throughout the term of the Agreement, as required in SCC section 6.20.255, prior to commencing the provision of services under this Agreement.

All Equipment shall be kept in good repair, appearance and in a sanitary, clean condition at all times. Recovered Materials collection equipment shall be the McNeilus or ▇▇▇▇ split body rear loader (one compartment for paper products; one compartment for other Recovered Material), and must be compatible for unloading at the designated RMPF or transfer station. In the event a compacting vehicle is used for the collection of Recovered Materials, compaction pressure may not exceed 50 pounds per square inch for the commingled non-paper Recovered Materials to avoid glass breakage. Equipment utilized for the collection of Recovered Materials shall be clearly identified for that purpose. The Contractor shall have available reserve equipment which can be put into service within two (2) hours of any breakdown. Such reserve equipment shall correspond in size and capacity to the equipment used by the Contractor to perform the contractual duties. Contractor shall notify the Contract Administrator or his designee by phone within two hours of any equipment breakdown. If the public road or public right-of-way in the Service Area is substandard, as specifically designated by the Contract Administrator, in writing, the Contractor must provide lightweight equipment to service these roads.
Collection Equipment. 28 All collection equipment used by CONTRACTOR in the performance of 29 services under this Agreement shall be of high quality.

For Waste Material collection, all vehicles and other equipment shall be kept in good repair and appearance at all times. Collection Equipment. Contractor, at its sole cost and expense, agrees to furnish all trucks, equipment, machines, and labor which are reasonably necessary to adequately, efficiently, and properly collect and transport Garbage from accounts serviced by Contractor in accordance with this Agreement. No trucks assigned to this Agreement shall be older than an age of ten (10) years. Due to street size variations in City, Contractor shall provide equipment that will accommodate such public streets and alleys. Special collections shall be made using appropriate equipment. Contractor shall, if necessary, hand-clean all spillage resulting from its collection activities. Damage caused by collection equipment such as spillage, broken curbs or sidewalks, and ruts off pavement shall promptly be repaired or replaced at Contractor’s expense in the case of negligence. Contractor shall be responsible for damage to curbs, sidewalks or paved surfaces caused by the weight of Contractor’s vehicles. All motor vehicles used in performance of the obligations herein created shall be clearly marked with Contractor’s name, telephone number, and unit number legible from one hundred fifty feet (150’). No advertising, except the company logo, shall be permitted on vehicles without prior City approval. All collection equipment shall be maintained in a safe and working condition throughout the term of this Agreement. Such vehicles shall be maintained through a regular preventative maintenance program and painted as often as necessary to preserve and present a well-kept appearance. Garbage collection vehicles and Recycling collection vehicles shall be clearly distinguishable from one another. In the event that one vehicle is used to serve the other purpose, a clearly visible sign should be affixed to the vehicle to inform residents that the Refuse or Recycling Materials are going to the proper place. Contractor shall furnish City a list of all equipment to be used fulfilling this Agreement and shall update that list as may be requested by City. City may inspect Contractor’s vehicles at any reasonable time that does not interfere with Contractor’s operations ensure compliance of equipment with this Agreement; provided, however, that Contractor shall have no obligation to assemble vehicles for any such inspection. Vehicles are to be washed on the inside and sanitized with a suitable disinfectant and deodorant a minimum of once a month. B. FRANCHISEE shall submit a Franchisee commercial solid waste vehicle inventory of FRANCHISEE’s vehicles, as required in CITY Code section 13.24.110 or as otherwise amended, and shall include but not limited to, vehicle number, year, make, model, capacity, and vehicle identification number (VIN). FRANCHISEE is required to submit the Franchisee commercial solid waste vehicle inventory annually as part of its Franchise Application or Franchise Renewal Application. C. If FRANCHISEE’s vehicle inventory has changed between the application or renewal application date and the effective date of this agreement, FRANCHISEE must submit to Solid Waste Manager an amended inventory, as required in CITY Code section 13.24.180 or as otherwise amended, prior to commencing the provision of services under this Agreement.
