2. For the purposes of this Schedule, the term “Operating costs” means expenditures incurred to finance the reasonable and Training under Part B necessary expenses incurred by the MOLSP, and Regional Social Welfare Offices for the operation, administration and maintenance of the Project, including travel, rent of premises, office supplies, books, communication costs, reasonable bank charges, printing and publications (electronic and paper), translations, notary services, consumables and other expenditure items agreed by the Bank throughout the life of the Project.
3. Notwithstanding the provisions of paragraph 1 above, no withdrawals shall be made in respect of payments made for expenditures prior to the date of this Agreement.
4. The Bank may require withdrawals from the Loan Account to be made on the basis of statements of expenditure for expenditures under contracts for: (i) goods, works and services (other than consultants’ services) costing less than $500,000 equivalent per contract; (ii) services of individual consultants costing less than $200,000 equivalent per contract; (iii) services of consulting firms under contracts costing less than $200,000 equivalent per contract; (iv) training, study tours and Operating Costs; and (v) Subventions for Modernization of Local Social Welfare Offices, all under such terms and conditions as the Bank shall specify by notice to the Borrower.
5. The Borrower may request withdrawals from the Loan Account to be made on the basis of reports to be submitted to the Bank in form and substance satisfactory to the Bank, such reports to include the FMR and any other information as the Bank shall specify by notice to the Borrower (Report-based Disbursements). 4. Withdrawals for expenditures under contracts for the procurement of goods estimated to cost less than $5,000,000 may be permitted by the Bank upon the basis of statements of expenditure under such terms and conditions as the Bank shall specify.
5. No withdrawal shall be made and no commitment shall be entered into to pay amounts to or on the order of the Borrower in respect of expenditures to be financed out of the proceeds of the Loan after the aggregate of the proceeds of the Loan withdrawn from the Loan Account and the total amount of such commitments shall have reached the equivalent of $35,000,000, unless the Bank shall be satisfied, after an exchange of views as described in Section 3.01 of this Agreement based on evidence satisfactory to the Bank: (a) with the progress achieved by the Borrower in the carrying out of the Program, and (b) that the actions described in Schedule 4 to this Agreement have been taken.
6. If, after the exchange of views described in paragraph 5 above, the Bank shall have given notice to the Borrower that the progress achieved and actions taken are not satisfactory and, within 90 days after such notice, the Borrower shall not have achieved progress and taken actions satisfactory to the Bank, then the Bank may, by notice to the Borrower, cancel the unwithdrawn amount of the Loan or any part thereof. 7. expenditures under a contract in respect of which the Bank determines that corrupt or fraudulent practices were engaged in by representatives of the Borrower or of a beneficiary of the Loan during the procurement or execution of such contract, without the Borrower having taken timely and appropriate action satisfactory to the Bank to remedy the situation.
1. The following table sets forth the Principal Payment Dates of the Loan and the percentage of the total principal amount of the Loan payable on each Principal Payment Date (Installment Share). If the proceeds of the Loan shall have been fully withdrawn as of the first Principal Payment Date, the principal amount of the Loan repayable by the Borrower on each Principal Payment Date shall be determined by the Bank by multiplying: (a) the total principal amount of the Loan withdrawn and outstanding as of the first Principal Payment Date; by (b) the Installment Share for each Principal Payment Date, such repayment amount to be adjusted, as necessary, to deduct any amounts referred to in paragraph 4 of this Schedule, to which a Currency Conversion applies. 2. If the proceeds of the Loan shall not have been fully withdrawn as of the first Principal Payment Date, the principal amount of the Loan repayable by the Borrower on each Principal Payment Date shall be determined as follows:
(a) To the extent that any proceeds of the Loan shall have been withdrawn as of the first Principal Payment Date, the Borrower shall repay the amount withdrawn and outstanding as of such date in accordance with paragraph 1 of this Schedule.
(b) Any withdrawal made after the first Principal Payment Date shall be repaid on each Principal Payment Date falling after the date of such withdrawal in amounts determined by the Bank by multiplying the amount of each such withdrawal by a fraction, the numerator of which shall be the original Installment Share specified in the table in paragraph 1 of this Schedule for said Principal Payment Date (the Original Installment Share) and the denominator of which shall be the sum of all remaining Original Installment Shares for Principal Payment Dates falling on or after such date, such repayment amounts to be adjusted, as necessary, to deduct any amounts referred to in paragraph 4 of this Schedule, to which a Currency Conversion applies.
(a) Withdrawals made within two calendar months prior to any Principal Payment Date shall, for the purposes solely of calculating the principal amounts payable on any Principal Payment Date, be treated as withdrawn and outstanding on the second Principal Payment Date following the date of withdrawal and shall be repayable on each Principal Payment Date commencing with the second Principal Payment Date following the date of withdrawal.
(b) Notwithstanding the provisions of sub-paragraph (a) of this paragraph 3, if at any time the Bank shall adopt a due date billing system under which invoices are issued on or after the respective Principal Payment Date, the provisions of such sub- paragraph shall no longer apply to any withdrawals made after the adoption of such billing system.
4. Notwithstanding the provisions of paragraphs 1 and 2 of this Schedule, upon a Currency Conversion of all or any portion of the withdrawn principal amount of the Loan to each Category and an Approved Currency, the percentage amount so converted in said Approved Currency that shall be repayable on any Principal Payment Date occurring during the Conversion Period, shall be determined by the Bank by multiplying such amount in its currency of expenditures for items denomination immediately prior to said Conversion by either: (i) the exchange rate that reflects the amounts of principal in said Approved Currency payable by the Bank under the Currency Hedge Transaction relating to said Conversion; or (ii) if the Bank so to be financed determines in each Category: Amount accordance with the Conversion Guidelines, the exchange rate component of the Screen Rate.
5. If the principal amount of the Loan Allocated % withdrawn and outstanding from time to time shall be denominated in more than one Loan Currency, the provisions of (Expressed this Schedule shall apply separately to the amount denominated in Expenditures Category Dollar Equivalent) each Loan Currency, so as to be Financedproduce a separate amortization schedule for each such amount.

2. For the purposes of this Schedule:
(a) the term "foreign expenditures" means expenditures in the currency of any country other than that of the Guarantor for goods or services supplied from the territory of any country other than that of the Guarantor; and
(b) the term "local expenditures" means expenditures in the currency of the Guarantor or for goods or services supplied from the territory of the Guarantor.
3. The Bank may require withdrawals from the Loan Account to be made on the basis of statements of expenditure for such expenditures for goods, works and services under contracts not exceeding $50,000 equivalent, under such terms and conditions as the Bank shall specify by notice to the Borrower. The objectives of the Project are: (a) to increase agricultural productivity through the promotion of appropriate technological packages at the farm level, (b) to increase rural income through the creation of off-farm job opportunities in farm-related enterprises; and (c) at the institutional level, to strengthen the capacity of the Borrower as a rural financial institution, encourage wider participation by banking institutions in the financing of rural investments and improve coordination among agencies responsible for the provision of agricultural services in the areas of credit, marketing and technology transfer. The Project consists of the following parts, subject to such modifications thereof as the Borrower and the Bank may agree upon from time to time to achieve such objectives: Part A: On-farm Technological Improvement Provision by the Borrower and the Participating Banks to Beneficiaries of the foreign exchange (under Sale Option and/or under Sub-loans) required for financing the procurement of agricultural inputs, machinery, equipment, components and spare parts. Part B: Rural Based Investment Provision by the Borrower and the Participating Banks to Beneficiaries of the foreign exchange (under Sale Option and/or under a Sub-loan) required for the carrying out of (a) Investments in agriculture-based activities, such as extraction, agro-processing, post- harvest activities, fish farming and dairying, and (b) Investments in agriculture-related services such as handling, storage, transport, other marketing activities, information and technology dissemination and veterinary. 1. Provision to the Borrower of expert services to upgrade its planning, auditing and lending capacities, including its capacity to assess the environmental impact of investments submitted for its financing.
2. Preparation and implementation by the Borrower of a training program for its staff (including staff of BDACs and village banks) and the staff of the Participating Banks in key areas of their operations.
3. Carrying out of studies of rural financial markets and rural savings.
4. Formulation and implementation by the Borrower of a staff rationalization plan to ensure, through streamlining, retraining and redeployment, compatibility of the staffing of the Borrower with its operational needs.
5. Establishment or upgrading of about 20 village banks.
6. Implementation of a Pilot Program to facilitate the use of proven agricultural technology, including (a) upgrading of the facilities and staffing of three RRES so as to ensure their operation as effective links between farmers and agents for agricultural services in the areas of research, extension, credit and input supply, and (b) strengthening the link between the above RRES and extension services through the formation of 33 Extension Information and Demonstration Units (EIDUs), to be staffed by appropriate specialists in technology transfer, and (c) provision of training. (a) Withdrawals made within two calendar months prior to any Principal Payment Date shall, for the purposes solely of calculating the principal amounts payable on any Principal Payment Date, be treated as withdrawn and outstanding on the second Principal Payment Date following the date of withdrawal and shall be repayable on each Principal Payment Date commencing with the second Principal Payment Date following the date of withdrawal.
(b) Notwithstanding the provisions of sub-paragraph (a) of this paragraph 3, if at any time the Bank shall adopt a due date billing system under which invoices are issued on or after the respective Principal Payment Date, the provisions of such sub- paragraph shall no longer apply to any withdrawals made after the adoption of such billing system.
4. (1) Sub-Loans 9,400,000 100With respect to the Borrower’s 2002 budget approved by the Borrower’s legislative branch and dated December 5, 2001 (Law No. 27573), at least 95% under Part Aof amounts allocated to education, culture, health, sanitation and social assistance were executed and the allocations for said sector functions in the Borrower’s 2003 budget approved by the Borrower’s legislative branch and dated December 5, 2002 were established at levels higher than their 2002 executed amounts as adjusted in real terms.
(2) Investments With respect to the Borrower’s 2002 budget approved by the Borrower’s legislative branch and dated December 5, 2001, the total aggregate allocation for all PSPs was executed as planned and for each of said PSP, under Part A performance did not exceed 50% of the Project 500,000 100% initial allocation.
(3) Consultants' Services In the Borrower’s 2004 budget submitted for approval to the Borrower’s legislative branch on August 30, 2003, measures are proposed to prevent diversion of funds from the PSPs to civil service payrolls and Training under Part B benefits.
(4) In 2002, A Trabajar was adequately targeted, an evaluation report on said program was carried out, publicly debated and published and a separate study on the impact of the Project 100,000 100wages paid under A Trabajar Rural was carried out.
(5) The Borrower’s law related to programmatic transfers of resources to sub- national governments establishing adequate rules for the decentralization of food programs was submitted to Borrower’s legislative branch for its approval, and in the Borrower’s 2004 budget submitted for approval to the Borrower’s legislative branch on August 30, 2003 allocations are proposed to distribute the food-aid funding according to a pro-poor formula.
(6) A Ministerial Resolution was approved and published in order to give DGAES responsibility over pension policy making.
(7) The Borrower’s legislative branch has approved and published two laws in order to create a pension assistance contribution and to improve the current Cédula Viva pension system.
(8) During 2002, SIS exceeded target coverage agreed with the Bank and the Borrower’s 2004 budget submitted for approval to the Borrower’s legislative branch on August 30, 2003 prohibits the diversion of funds assigned to primary and secondary care in favor of higher complexity care.
(9) The Borrower’s administrative treatment of human resources in education has been substantially improved and covers 51% TOTAL 10,000,000==========of teachers for the unified payroll system.
(10) The Borrower is developing a hardship and merit incentives system through: (a) a pilot program currently under implementation with an agreed design structure and baseline in order to monitor and evaluate hardship and merit incentives for 1,000 rural teachers including detailed indicators; and (b) the first report of a study to design new merit incentives applicable to the education sector has been delivered.
(11) The Borrower has carried out, presented and publicly discussed a report on a pilot system to assess users’ satisfaction in relation to selected services of the PSPs and the Borrower’s Law on transparency and access to public information, (Ley No 27806 dated April 24, 2003 as modified ) and its related regulations were approved and published.
(12) The Borrower has made SIAF available through an internet portal “Consulta Amigable” which provides information on the Borrower’s budget for all public programs as well as data on actual spending and physical progress achieved for PRONAA, SIS and A Trabajar

2. Notwithstanding the provisions of paragraph 1 above, no withdrawals shall be made in respect of payments made for expenditures prior to the date of this Agreement, except that withdrawals, in an aggregate amount not exceeding $40,000,000, may be made in respect of Category 1 set forth in the table in paragraph 1 of this Schedule on account of payments made for expenditures before that date but after December 1, 2005.
3. The Bank may require withdrawals from the Loan Account to be made on the basis of statements of expenditure for expenditures under contracts for: (2a) Investments goods and works costing less than $25,000,000 equivalent per contract; (b) services of individual consultants costing less than $50,000 equivalent per contract; and (c) services of consulting firms under Part A contracts costing less than $200,000 equivalent per contract, all under such terms and conditions as the Bank shall specify by notice to the Borrower.
4. The Borrower may request withdrawals from the Loan Account to be made on the basis of reports to be submitted to the Bank in form and substance satisfactory to the Bank, such reports to include the FMR and any other information as the Bank shall specify by notice to the Borrower (Report-based Disbursements). 2. For the purposes of this Schedule, the term “Incremental operating costs” means reasonable expenditures incurred by the Project Management Unit for rental of office space, utilities, communications, consumables, staff travel (including per diem), remuneration of contractual support staff, but excluding staff salaries and Training honoraria (which expenditures would not have been incurred absent the Project).
