Common use of Requests for Medical Statements Clause in Contracts

Requests for Medical Statements. If the Appointing Authority believes that the nurse has abused or is abusing sick leave, nurses using leave under this Article may be required to furnish a statement from a medical practitioner upon the request of an Appointing Authority. If the Appointing Authority has reason to believe the nurse is not fit to work or has been exposed to a contagious disease which endangers the health of other nurses, clients, or the public, the Appointing Authority may also request a statement from a medical practitioner. Such statement shall indicate the nature and the expected duration of the illness or disability. The abuse of sick leave shall constitute just cause for disciplinary action.
