Require the Permanent Conservation of Acquired or Restored Critical Habitat or Open Space. The Commission shall require that, as soon as is practical, any lands acquired or restored with the use of funds generated by the Commission for the purpose or purposes of critical habitat be permanently preserved through placing an appropriate deed restriction, conservation easement or other like encumbrance that perpetually protects the resources of and on the property. The deed restriction, conservation easement or other like encumbrance shall be held by a third party entity approved of by a vote of the Commission.
