Common use of Reserve Data Clause in Contracts

Reserve Data. The natural gas reserve estimates of the Company Parties as of as of September 30, 2013 and December 31, 2011 and 2012 contained in the most recent Preliminary Prospectus are derived from reports that have been prepared by either (a) Netherland, Xxxxxx and Associates, Inc. or (b) Xxxxxx & Company, Inc., as set forth and to the extent indicated therein; and such estimates fairly reflect, in all material respects, the oil and natural gas reserves of the Company Parties, at the dates indicated therein and are in accordance, in all material respects, with Commission rules and guidelines that are currently in effect for oil and gas producing companies applied on a consistent basis throughout the periods covered.

XxxXxxxxxxx or (b) Xxxxxx & Xxxxx Xxxxx Company, Inc.L.P., as set forth and to the extent indicated therein; and such estimates fairly reflect, in all material respects, the oil and natural gas reserves of the Company Partiesand its subsidiaries, at the dates indicated therein and are in accordance, in all material respects, with Commission rules and guidelines that are currently in effect for oil and gas producing companies applied on a consistent basis throughout the periods covered.
