Common use of RESIGNATIONS AND REINSTATEMENTS Clause in Contracts

RESIGNATIONS AND REINSTATEMENTS. Full-time employees who have resigned from their position may be reinstated within one (1) year from the date of such resignation to the position from which they resigned if then vacant, or to any vacant position to which they are eligible for transfer or reassignment. Full-time employees so reinstated shall be paid the salary for the position to which they were reinstated and re-credited with benefits from their previous hire date. Reinstated employees shall not be entitled to any retroactive pay increase or benefits which occurred when they were in a resigned status. It is understood and agreed that reinstatement shall be at the sole discretion of the Employer, whose decision shall not be subject to the grievance procedures herein.
