Responsibilities of Members. Members shall have the following responsibilities under this Agreement. (a) The board of supervisors of each member county shall appoint a representative and one alternate representative to the Board of Directors, pursuant to Article 7. (b) Each member shall appoint an officer or employee of the member to be responsible for the risk management function for that member and to serve as a liaison between the member and PRISM for all matters relating to risk management. (c) Each member shall maintain an active risk control program, and shall consider and act upon all recommendations of PRISM concerning the reduction of unsafe practices. (d) Each member shall maintain its own claims and loss records in each category of liability covered by an insurance program of PRISM in which the member is a participant, and shall provide copies of such records to PRISM as directed by the Board of Directors or Executive Committee, or to such other committee as directed by the Board of Directors or Executive Committee. (e) Each member shall pay premiums and premium surcharges due to PRISM as required under Article 14. Penalties for late payment of such premiums and/or premium surcharges shall be as determined and assessed by the Board of Directors. After withdrawal, cancellation, or termination action under Articles 20, 21, or 23, each member shall pay promptly to PRISM any additional premiums due, as determined and assessed by the Board of Directors under Articles 22 or 23. Any costs incurred by PRISM associated with the collection of such premiums or other charges, shall be recoverable by PRISM. (f) Each member shall provide PRISM such other information or assistance as may be necessary for PRISM to develop and implement insurance programs under this Agreement. (g) Each member shall cooperate with and assist PRISM, and any insurer of PRISM, in all matters relating to this Agreement, and shall comply with all Bylaws, and other rules by the Board of Directors. (h) Each member shall have such other responsibilities as are provided elsewhere in this Agreement, and as are established by the Board of Directors in order to carry out the purposes of this Agreement.

(c) Each Member shall maintain its own set of records, including a loss log, in all categories of risk covered by each Program in which it participates to insure accuracy of the reduction Authority’s loss reporting system, unless it is no longer deemed necessary by the Board of unsafe practicesDirectors.
(d) Each member Member shall maintain pay its own claims and loss records in each category of liability covered by an insurance program of PRISM in which the member is a participantContribution, and any adjustments thereto, and any Assessments within the specified period set forth in the invoice, or as otherwise may be set forth herein or in the Bylaws. After withdrawal or termination, each Former Member or its successor shall provide copies pay promptly to the Authority its share of such records to PRISM any additional Contribution, adjustments or Assessments, if any, as directed required of it by the Board of Directors under Article 21 or Executive Committee, 22 of this Agreement or to such other committee as directed by the Board of Directors or Executive CommitteeBylaws.
(e) Each member shall pay premiums and premium surcharges due to PRISM as required under Article 14. Penalties for late payment of such premiums and/or premium surcharges shall be as determined and assessed by the Board of Directors. After withdrawal, cancellation, Member or termination action under Articles 20, 21, or 23, each member shall pay promptly to PRISM any additional premiums due, as determined and assessed by the Board of Directors under Articles 22 or 23. Any costs incurred by PRISM associated with the collection of such premiums or other charges, shall be recoverable by PRISM.
(f) Each member Former Member shall provide PRISM the Authority with such other information or assistance as may be necessary for PRISM the Authority to develop and implement insurance programs carry out the Programs under this AgreementAgreement in which the Member or Former Member participates or has participated.
(gf) Each member Member or Former Member shall in any and all ways cooperate with and assist PRISM, the Authority and any insurer of PRISMthe Authority, in all matters relating to this Agreement, Agreement and shall covered claims.
(g) Each Member or Former Member will comply with all Bylaws, rules and other rules regulations adopted by the Board of Directors.
(h) Each Member shall remain a member shall have such other responsibilities as are provided elsewhere in this Agreement, and as are established by the Board good standing of Directors in order to carry out the purposes of this AgreementCSDA.

(b) Each Member shall consider all recommendations of FRMS concerning unsafe practices and/or hazard mitigation, and each Member participating in the Workers’ Compensation Coverage Program shall implement and maintain an injury and illness prevention program as required by the California Labor Code within ninety (90) days of inception into program.
(c) Each member benefits program Member shall maintain an active its own set of records, including a loss log, in all categories of risk control programcovered by each Coverage Program in which it participates to assure accuracy of FRMS’ loss reporting system, and shall consider and act upon all recommendations unless it is deemed no longer necessary by the Board of PRISM concerning the reduction of unsafe practices.Directors;
(d) Each member Member participating in the Workers’ Compensation Program shall maintain its own report job- related accidents or illnesses to the appropriate claims and loss records in each category administrator as soon as practicable after notification of liability covered by an insurance program of PRISM in which the member is a participantaccident or illness, and no later than 48 hours after notification, shall provide copies of such records to PRISM as directed use the format specified by the Board of Directors or Executive Committeeclaims administrator when making job- related accident reports, or and make any other required notifications to such other committee as directed by the Board of Directors or Executive Committee.government agencies, including Cal-OSHA, when required;

(g) Each member Member or Former Member shall in any and all ways cooperate with and assist PRISM, FRMS and any insurer of PRISMFRMS, in all matters relating to this Agreement, Agreement and covered Claims;
(h) Each Member or Former Member shall comply with all Bylaws, rules, regulations and other rules operating policies and procedures adopted by the Board of Directors.
(h) Each member shall have such other responsibilities as are provided elsewhere in this Agreement, and as are established by the Board of Directors in order to carry out the purposes of this Agreement.

(g) Each member Member shall cooperate with and assist PRISMthe Authority in the pursuit of recoveries for losses covered by a joint protection program, including assigning its right to recover subrogated amounts, and if necessary, executing a written agreement to effect such assignment.
(h) Each Member shall in any and all ways cooperate with and assist the Authority, and any insurer of PRISMa joint protection program, in all matters relating to this AgreementAgreement and covered losses, and shall will comply with all Bylawsbylaws, rules and other rules by the Board of Directors.
(h) Each member shall have such other responsibilities as are provided elsewhere in this Agreement, and as are established regulations adopted by the Board of Directors and Executive Committee.
(i) Each Member shall actively participate in order to carry out the purposes of this AgreementAuthority’s Risk Management Evaluation and Loss Control Action Plan (LossCAP) programs.

13.5 Each Member shall promptly pay its own claims and loss records in each category of liability covered by an insurance program of PRISM in which the member is a participantAssessment, Reassessment, and shall provide copies of such records any readjusted amount promptly to PRISM as directed by the Board of Directors or Executive Committee, or to such other committee as directed by the Board of Directors or Executive Committee.
(e) Each member shall pay premiums and premium surcharges due to PRISM as required under Article 14. Penalties for late payment of such premiums and/or premium surcharges shall be as determined and assessed by the Board of DirectorsAgency when due. After withdrawal, cancellation, withdrawal or termination action under Articles 20, 21, or 23termination, each member Member shall pay promptly to PRISM the Agency its share of any additional premiums due, as Reassessment and accrued interest at a rate determined and assessed by the Board Board, when and if required of Directors under Articles 22 or 23. Any costs incurred it by PRISM associated with the collection of such premiums or other charges, shall be recoverable by PRISMBoard.
(f) 13.6 Each member Member shall provide PRISM the Agency with such other information or assistance as may be necessary for PRISM the Agency to develop and implement insurance programs under carry out the provisions of this Agreement.
(g) 13.7 Each member Member shall in any and all ways cooperate with and assist PRISMthe Agency, and any insurer of PRISMthe Agency, in all matters relating to this AgreementAgreement and covered losses, and shall will comply with all Bylaws, policies, procedures and other rules Member Standards as adopted or amended by the Board of Directors.
(h) Each member 13.8 All members shall cooperate with the Agency and assist with any investigations, settlement discussions, defense or prosecution of suits, and cooperate and assist the Agency in enforcing any right of contribution, indemnity, or subrogation in which the Agency may have such other responsibilities as are provided elsewhere in an interest by virtue of a payment made pursuant to the Bylaws, this Agreement, or the Coverage Agreement. Members shall also assist the Agency and attend hearings and trials as are established by well as secure and give evidence and obtain the Board attendance of Directors witnesses. Further, the members shall undertake appropriate due diligence and concur in order exercising all things reasonably practicable to carry out avoid or diminish any loss of or damage to the purposes of property insured under this Agreementagreement.
