Responsibilities of the Employee. As a condition of employment, employees must abide by the terms of this policy and must notify the Employer in writing of any conviction of a violation of a criminal drug statute occurring in the workplace no later than five calendar days after such a conviction. (1) The employee must notify his/her supervisor that his/her drug or medication (either prescribed or over-the-counter), may affect or impair his/her judgment or job performance or safety.. Violations of this requirement may result in disciplinary action. (2) The employee or job applicant must notify the laboratory of any administrative or civil action planned as a result of a positive test within five working days from receipt of notification. (3) The Employee has the right to contest the result of a positive drug test, in writing, within five working days of being notified in writing of the positive test result.
