Responsibility for Loss. If, despite Customer efforts, Customer suffers any damage or loss as a result of Customer’s failure to comply with its data security obligations, and regardless of whether such damage or loss results from the activities of Customer’s employees, agents, subcontractors or any unaffiliated third party, any such loss or damage shall be the sole responsibility of Customer.
