Responsibility for Loss. If, despite Client’s efforts, Client suffers any damage or loss as a result of Client’s failure to comply with its data security obligations, and regardless of whether such damage or loss results from the activities of Client’s employees, agents, subcontractors or any unaffiliated third party, any such loss or damage shall be the sole responsibility of Client.
