Common use of Restoration of Position Clause in Contracts

Restoration of Position. In case the Trustee shall have proceeded to enforce any rights under this Indenture by sale or otherwise and such proceedings shall have been discontinued or shall have been determined adversely to the Trustee, then, and in every such case to the extent not inconsistent with such adverse decree, the Authority, the Trustee and the Noteholders shall be restored to their former respective positions and the rights hereunder in respect to the Trust Estate, and all rights, remedies and powers of the Trustee and of the Noteholders shall continue as though no such proceeding had been taken.

Restoration of Position. In case the Trustee shall have proceeded to enforce any rights under this Indenture by sale or otherwise otherwise, and such proceedings shall have been discontinued discontinued, or shall have been determined adversely to the Trustee, then, then and in every such case to the extent not inconsistent with such adverse decree, the AuthorityCorporation, the Trustee and the Noteholders Registered Owners shall be restored to their former respective positions and the rights hereunder in respect to the Trust Estate, and all rights, remedies remedies, and powers of the Trustee and of the Noteholders Registered Owners shall continue as though no such proceeding had been taken.

In case the Trustee shall have proceeded to enforce any rights right under this Indenture Mortgage by sale foreclosure, sale, entry or otherwise otherwise, and such proceedings shall have been discontinued or abandoned for any reason or shall have been determined adversely to the Trusteeadversely, then, and in every such case to the extent not inconsistent with such adverse decreecase, the Authority, Company and the Trustee and the Noteholders shall be restored to their former respective positions and the rights hereunder in with respect to the Trust Estate, and all rights, remedies and powers of Mortgaged Property subject to the Trustee and of the Noteholders shall continue as though no such proceeding had been takenlien hereof.
