Common use of Restoration to Work After Clause in Contracts

Restoration to Work After. a Leave of Absence For up to one (1) year, a driver on unpaid leave of absence may return to the run s/he held at the time the driver began the leave. After one (1) year, the District cannot guarantee restoration to the same route the driver had before the leave, but if the run the driver had before his/her leave was driven by a substitute during the regular driver’s absence, the regular driver will be restored to his/her old route. If no regular route exists upon the driver’s return, the driver, if he/she has seniority, may bump the least senior regular driver. If the driver cannot bump or chooses not to do so, he/she will be placed on a preferred eligible list for the next available regular route.
