RESTRICTIONS UPON USE. 37.1 It is expressly understood that no portion of the demised premises shall be used as, by or for (i) a bank, trust company, savings bank, industrial bank, savings and loan association or personal loan bank (or any branch office or public accommodation office of any of the foregoing), or (ii) a public stenographer or typist, barb▇▇ ▇▇▇p, beauty shop, beauty parlor or shop, telephone or telegraph agency, telephone or secretarial service, messenger service, travel or tourist agency, employment agency, public restaurant or bar, commercial document reproduction or offset printing service, public vending machines, retail, wholesale or discount shop for sale of merchandise, retail service shop, labor union, school or classroom, governmental or quasi-governmental bureau, department or agency, including an autonomous governmental corporation, an advertising agency, a firm whose principal business is real estate brokerage, or a company engaged in the business of renting office or desk space.
RESTRICTIONS UPON USE. The Yahoo Brand Features shall not be presented or used:
A. in a manner that could be reasonably interpreted to suggest editorial content has been authored by, or represents the views or opinions of, Yahoo or any Yahoo personnel;
B. in a manner that is misleading, defamatory, libelous, obscene or otherwise objectionable, in Yahoo's reasonable opinion;
C. in a way that infringes, derogates, dilutes or impairs the rights of Yahoo in the Yahoo Brand Features;
D. as part of a name of a product or service of a company other than Yahoo, except as expressly provided in a written agreement by Yahoo.
RESTRICTIONS UPON USE. The Yahoo! Brand Features will not be presented or used: a) in a manner that suggests that editorial content has been authored by, or represents the views or opinions of, Yahoo! or any Yahoo! personnel or affiliate; b) in a manner that is misleading, defamatory, libelous, obscene, infringing or otherwise objectionable; c) in connection with any material that infringes the trademark, copyright or any other rights of any third party; d) as part of a name of a product or service of a company other than Yahoo!; or e) in a manner that infringes, derogates, dilutes, or impairs the rights of Yahoo! in the Brand Features. Yahoo! shall have complete discretion to evaluate Licensee’s use and to decide whether that use violates any of the foregoing restrictions.
RESTRICTIONS UPON USE. Concessionaire agrees that, in connection with the use and operation of the Premises, it will not:
a. Use or permit the use of any objectionable advertising medium such as, without limitation, loudspeakers, phonographs, public address systems, sound amplifiers, radios or broadcasts within the Premises in such a manner that any sounds reproduced, transmitted or produced will not be transmitted beyond the building interior of the Premises, and will keep all mechanical apparatus free of vibration and noise which may be transmitted beyond the interior of the Premises. Musical entertainment may be provided if approved in advance by the Harbor Manager.
b. Permit any use of the Premises or any part thereof in a manner likely to injure the reputation of Landlord, its officials or employees.
c. Permit accumulations of garbage, trash, rubbish, oil or other hazardous or flammable products or any other refuse to occur on or off the Premises.
d. Use the Premises or permit any use of the Premises to occur, which might cause a cancellation of any insurance policy covering the Landlord's facilities, or any part thereof, or any building or improvements thereon.
e. Permit the placement of any dispenser of publications (such as newspaper, magazines, brochures, racks etc) outside the building. Placement of such dispensers shall be permitted inside the building only; however, from time to time and when requested in writing and approved by the Harbor Manager, the Concessionaire may place a brochure dispenser on the exterior of the building, as long as said dispenser is constructed in such a manner as to ensure the containment of all paper within the dispenser, and to ensure that the contents of the dispenser do not become litter able to enter the ocean or surrounding area.
f. Permit the posting of any advertisement, handbill or notice on the exterior of the Premises building, including but not limited to posts, handrails, other exterior fixtures, etc. Such advertising may be posted on the inside of the Premises building on windows or walls only.
g. Commit or allow any action or omission on or about the Premises or Water Area in a manner that might constitute a violation of any federal, state or local statute, law, rule, regulation, ordinance, directive order, permit, license or authorization. This includes, but is not limited to existing and future Port San ▇▇▇▇ Harbor District Ordinances.
h. Allow any use or activity on or about the Premises or Water Area that interferes with ...

A. in a manner that could be reasonably interpreted to suggest that any editorial content other than the Yahoo Service has been authored by, or represents the views or opinions of, Yahoo or any Yahoo personnel;
B. in a manner that is misleading, defamatory, libelous, obscene or otherwise objectionable, in Yahoo's reasonable opinion;
C. in a way that infringes, derogates, dilutes or impairs the rights of Yahoo in the Yahoo Brand Features;
D. for the purposes of promoting the sale, license or other transfer for value of property or services, other than in connection with the promotion of the sale and use of ▇▇▇▇▇.▇▇; or

RESTRICTIONS UPON USE. Since the I-House facilities are being operated for the purpose of promoting cultural exchange and intellectual cooperation between the peoples of Japan and those of other countries, a few restrictions apply. Its facilities may not be used for the following occasions:
(1) Exhibitions which are to be held mainly for purposes of sale or other profit-making activities
(2) Political party meetings, and other political activities
(3) Propagation of religion or worship
(4) Gatherings of minors
(5) Any other meetings which are deemed inappropriate by the I-House

NNA shall have complete discretion to evaluate Dealer’s use of the Internet Certified Logo and to decide whether that use violates any of the foregoing restrictions and otherwise is in compliance with NNA’s branding standards.
