Common use of Retainer Clause in Contracts

Retainer. 1.1.1. COUNTY does hereby retain A-E to perform the PROJECTS/SERVICES as required by this CONTRACT. 1.1.2. A professional, duly registered in the State of California, who shall be assigned to PROJECTS/SERVICES and whose services are offered by A-E and accepted by COUNTY is Xxx Xxxxx, PE. 1.1.3. A-E may employ special consultants/contractors for the accomplishment of the PROJECTS/SERVICES specified; and, it is agreed that only the following firms or independent consultants/contractors are to be employed to provide these PROJECTS/SERVICES, and that the aggregate money value of their PROJECTS/SERVICES shall not constitute more than forty-nine percent (49%) of the total amount of PROJECTS/SERVICES required under this CONTRACT: x. A-E's employment of independent consultants/contractors shall not relieve A-E from the performance of its own responsibilities pursuant to this CONTRACT. However, all consultants/contractors independently contracting with COUNTY shall be independently liable to COUNTY for the performance of the work pursuant to their agreements, and A- E shall have no liability for work by contractors independently contracting with COUNTY.

Retainer. 1.1.1. 1.1.1 COUNTY does hereby retain A-/E to perform the PROJECTS/SERVICES as required by this CONTRACT. 1.1.2. 1.1.2 A professional, duly registered in the State of California, who shall be assigned to PROJECTS/SERVICES and whose services are offered by A-/E and accepted by COUNTY is Xxx Xxxxx, PEXxxx Xxxxxx. 1.1.3. 1.1.3 A-/E may employ special consultants/contractors for the accomplishment of the PROJECTS/SERVICES specified; and, it is agreed that only the following firms or independent consultants/contractors are to be employed to provide these PROJECTS/SERVICES, and that the aggregate money value of their PROJECTS/SERVICES shall not constitute more than forty-nine percent (49%) of the total amount of PROJECTS/SERVICES required under this CONTRACT: x. Xxxx Xxxxxxx, Inc. - H&H (Dam Inundation and Levee Certification), Flood Control Engineering and PS&E Support 1.1.4. 1.1.4 Consultants/contractors may be substituted and/or added by mutual CONTRACT agreement of A-/E and the Director, County of Orange, OC Public Works or his designee, hereinafteror Chief Real Estate Officer, hereinafter referred to as “DIRECTOR”. 1.1.5. 1.1.5 A-/E's employment of independent consultants/contractors shall not relieve A-/E from the performance of its own responsibilities pursuant to this CONTRACT. However, all consultants/contractors independently contracting with COUNTY shall be independently liable to COUNTY for the performance of the work pursuant to their agreements, and A- A/E shall have no liability for work by contractors independently contracting with COUNTY.
