Common use of Return from Military Leave of Absence Clause in Contracts

Return from Military Leave of Absence. An employee returning from military service shall be eligible to take available PTO/vacation for the current year as provided by Section 1 of this Article after combining Company and military service, unless the employee was paid at the straight-time rate a PTO/vacation allowance ("cashed out") for the current year before going on such leave. The premium pay (paid at time and one-half) provision of Section 3 of this Article for PTO/vacation not taken shall apply only to those veterans returning prior to April 1 of the current year.
