Review of Termination Decisions. An employee’s employment may be terminated under section 29 of the PS Act. Termination of, or a decision to terminate employment cannot be reviewed under this Agreement. The sole and exhaustive rights and remedies of an employee in relation to termination of employment are: the FW Act; other Commonwealth laws (including the Constitution); and at common law.

Review of Termination Decisions. An employee’s employment may be terminated under section 29 of the PS Act. Termination of, or a decision to terminate employment cannot be reviewed under this Agreement. The sole and exhaustive rights and remedies of an employee in relation to termination of employment are: a) the FW Act; b) other Commonwealth laws (including the Constitution); and c) at common law. 9.2 Nothing in this Agreement prevents the Secretary from terminating the employment of an employee for serious misconduct, without further notice or payment in lieu, in accordance with s 123 of the FW Act, subject to compliance with the procedures established by the Secretary for determining whether an employee has breached the Code of Conduct under s 15 of the PS Act. 9.3
