REVIEW OF THE SERVICES. 4.1 The Council will review the adult’s care needs at intervals of not more than twelve (12) months to assess that the outcomes for the adult as agreed in the care and support plan are being achieved. 4.2 The Council may vary the amount of the direct payments based upon the result of the review or at any time throughout the agreement period, on giving the adult or their nominated or authorised person at least seven (7) days written notice, where the Council identifies a change in circumstances that affects the current level of direct payments due. 4.3 You must inform the Council immediately if at any time you have difficulty in providing services or managing the direct payment account. 4.4 You must ensure that arrangements are in place to notify the Council immediately if there are any changes in circumstances which may affect entitlement to direct payments. Examples of changes are: if the adult is admitted to hospital, is going to be away for periods beyond four (4) weeks, no longer requires the service or there are changes in the adult’s financial situation. 4.5 It is your responsibility to check with the Council if you are unsure if a change in circumstances will affect eligibility to continue to receive directs payments. This is important, because it may mean that the Council needs to vary the arrangements or temporarily suspend payments. A failure to notify may also result in termination of this agreement and may also lead to civil or criminal action against you.
