Common use of Review of this Agreement Clause in Contracts

Review of this Agreement. (a) The parties must review this Agreement every two years, and otherwise if either party is of the opinion that any change of circumstance has occurred, or is imminent, that materially affects the operation of this Agreement. (b) For the purposes of this clause 19.20, the relevant changes include (but are not limited to) any change to a law that restricts or prohibits or enables the Council or any other planning authority to restrict or prohibit any aspect of the Development. (c) For the purposes of addressing any matter arising from a review of this Agreement, the parties must use all reasonable endeavours to agree on and implement appropriate amendments to this Agreement. (d) A failure by a party to agree to take action requested by the other Party as a consequence of a review referred to in clause 19.20(a) is not a breach of this Agreement and is not able to be dealt with under clause 18.
