RIGHT OF THIRD PARTIES. A person or entity who is not a party to this Agreement shall have no right under the Contracts (Rights of Third Parties) Act, chapter 53B of Singapore to enforce any term of this Agreement, regardless of whether such person or entity has been identified by name, as a member of a class or as answering a particular description, Provided that EZL shall have the right to enforce any term of this Agreement insofar as such term expressly or impliedly confers any right, benefit or privilege on EZL. For the avoidance of doubt, nothing in this paragraph shall affect the rights of any permitted assignee or transferee of this Agreement.
RIGHT OF THIRD PARTIES. This XXXX is not made for the benefit of, nor shall any of its provisions be enforceable by any person other than the parties to this Agreement and their respective successors and permitted assignees.
RIGHT OF THIRD PARTIES. Unless expressly stated no party other than DBS and Vendor shall be entitled to enforce the terms of the PO, and any law purporting to grant such rights to third parties (including the Contracts (Rights of Third Parties) Act 2001) shall be excluded to the furthest extent permissible.
RIGHT OF THIRD PARTIES. This Agreement is personal to the Parties. The provisions of the Contracts (Rights of Third Parties) Act 1999 do not apply to this Agreement. No person who is not a party to this Agreement (whether or not such person is named, referred to, or otherwise identified, or form part of a class of persons so named, referred to, or identified in this Agreement) shall have any right under the Contracts (Rights of Third Parties) Act 1999 to enforce this Agreement or to enjoy the benefit of any term of this Agreement.
RIGHT OF THIRD PARTIES. A person who is not a party to this Agreement has no right under the Contracts (Right of Third Parties) Ordinance to enforce any term of this Agreement but this does not affect any right or remedy of a third party which exists or is available apart from the Contracts (Right of Third Parties) Ordinance, and to the extent otherwise set out in this Clause 19.12:
19.12.1 Indemnified Parties may enforce and rely on Clause 9 to the same extent as if they were a party to this Agreement;
19.12.2 An assignee pursuant to Clause 19.1 may enforce and rely on this Agreement as if it were a party; and
19.12.3 This Agreement may be terminated or rescinded and any term may be amended, varied or waived without the consent of the persons referred to in sub-clause 19.12.
RIGHT OF THIRD PARTIES. Except for White Beach Holiday, a person who is not a party to the Agreement may not enforce any of its terms under the Contracts (Rights of Third Parties) Xxx 0000.
RIGHT OF THIRD PARTIES. These TERMS OF SERVICE is not made for the benefit of, nor shall any of its provisions be enforceable by any person other than the parties to this Agreement and their respective successors and permitted assignees.
RIGHT OF THIRD PARTIES. Nothing in this Policy is intended to confer a direct enforceable benefit on any party other than the Insured Persons and the Company, whether pursuant to the Contracts (Rights of Third Parties) Ordinance or otherwise. It is hereby noted and agreed, however, that the Company and the Insured Person named in the Schedule alone have the right to amend this Policy by agreement or (if any such rights exist in the Policy) to cancel or terminate the Policy, without giving notice, or requiring the consent of any other person.
RIGHT OF THIRD PARTIES. These Covenants shall be recorded for the benefit of Developer, the Association, the Owners and their respective Mortgagees and by such recording, no other adjoining property owner or third party shall have any right, title or interest whatsoever in the Property or, the Development or the operation and continuation of either, in the enforcement of any of the provisions of these Covenants or the right to consent to or approve any amendment or modification to these Covenants.
RIGHT OF THIRD PARTIES. No term of this agreement is enforceable under the Contracts (Rights of Third Parties) Ordinance (Chapter 623 of the Laws of Hong Kong) by a person who is not a party to this agreement, but this does not affect any right or remedy of a third party which exists or is available apart from the Contracts (Rights of Third Parties) Ordinance (Chapter 623 of the Laws of Hong Kong). Notwithstanding any provision of this agreement, this agreement may be terminated or rescinded and any term may be amended, varied or waived without the consent of any third party.
