Right to Display Advertising. Certain advertising information may be displayed on our Site and/or through our Services in our sole discretion. The display of advertising information shall not entitle you to any advertising fees or revenues from such advertising unless otherwise explicitly agreed to in writing by Evolve. Your correspondence or business dealings with, or participation in promotions of, advertisers found on or through our Services, including payment and delivery of related goods or services, and any other terms, conditions, warranties or representations associated with such dealings, are solely between you and such advertiser. You agree that Evolve shall not be responsible or liable for any loss or damage of any sort incurred as the result of any such dealings or as the result of the presence of such adver- tisers as a part of our Services.

The warning (or a clearly marked hyperlink to the warning using the word “WARNING”) given in conjunction with the online sale of the Products may appear either: (a) prominently placed on a webpage in which the Product’s photograph, price, or “add to cart” section are displayed; (b) on the same webpage as the order form for the Product; or (c) on any webpage displayed to the purchaser during the checkout process and prior to its completion for any purchaser with a California shipping address.
