Right to recover Equipment. In an event of default you authorise us at your cost to enter upon the property where the Equipment is located for the purpose of removal of the Equipment, and you authorise us at your cost to take possession of any property in, on or attached to the Equipment. You grant us a particular and general lien over property removed from the Equipment as security for any amounts owed by you and authorise us to sell such property and apply the sale proceeds towards any amounts owed by you.

Right to recover Equipment. In an event of default you irrevocably authorise us at your cost to enter upon the property where the Equipment is located for the purpose of removal of any Equipment hired to you, and in doing so you irrevocably authorise us at your cost to take possession of any property in, on or attached to the Equipment. You grant us a particular and general lien over any property removed from the Equipment as security for any amounts owed by you pursuant to this Agreement and authorize us to sell such property and apply the sale proceeds towards any amounts owed by you pursuant to this Agreement or alternatively If, in our reasonable opinion, any property removed is not saleable, fails to sell when offered for sale, may pose a health risk to staff or the public if handled, or are not of sufficient value to warrant the expense of attempting to sell, we may dispose of such property by any means.
Right to recover Equipment. (a) You hereby irrevocably authorise us to enter upon any property occupied by you for the purpose of removal of any Equipment if and when this Agreement expires, terminates or is terminated. (b) In the event that we are not given access to any property upon which the Equipment is located for the purposes of recovering the Equipment and as a consequence incur any costs in gaining such access, you will be liable to pay us for all such costs. (c) We are not liable to make good any premises upon which the Equipment was located unless the damage caused to the premises occurred was not reasonably foreseeable from the removal of the Equipment by us.
Right to recover Equipment. If you commit a breach of these Terms and we elect to retake possession of all or part of the Equipment, you irrevocably authorise us to enter upon any premises where the Equipment are located, and to use such reasonable force as may be necessary, for the purpose of removal of any Equipment sold to you and to do so at your cost.

  • OUR RIGHT TO RECOVER PAYMENT If we make a payment under this policy and the person to or for whom payment was made has a right to recover damages from another we shall be subrogated to that right. That person shall do:

  • TITLE TO RECEIPTS It is a condition of this Receipt, and every successive Holder of this Receipt by accepting or holding the same consents and agrees, that title to this Receipt (and to each ADS evidenced hereby) is transferable by delivery of the Receipt, provided it has been properly endorsed or accompanied by proper instruments of transfer, such Receipt being a certificated security under the laws of the State of New York. Notwithstanding any notice to the contrary, the Depositary may deem and treat the Holder of this Receipt (that is, the person in whose name this Receipt is registered on the books of the Depositary) as the absolute owner hereof for all purposes. The Depositary shall have no obligation or be subject to any liability under the Deposit Agreement or this Receipt to any holder of this Receipt or any Beneficial Owner unless such holder is the Holder of this Receipt registered on the books of the Depositary or, in the case of a Beneficial Owner, such Beneficial Owner or the Beneficial Owner’s representative is the Holder registered on the books of the Depositary.

  • Entitlement to Rebate Upon timely demand, non-members may apply to the Association for an advance reduction/rebate of the fair share fee pursuant to the internal procedure adopted by the Association.

  • RIGHT OF ALLOTTEE TO USE COMMON AREAS AND FACILITIES SUBJECT TO PAYMENT OF TOTAL MAINTENANCE CHARGES The Allottee hereby agrees to purchase the [Apartment/Plot] on the specific understanding that is/her right to the use of Common Areas shall be subject to timely payment of total maintenance charges, as determined and thereafter billed by the maintenance agency appointed or the association of allottees (or the maintenance agency appointed by it) and performance by the Allottee of all his/her obligations in respect of the terms and conditions specified by the maintenance agency or the association of allottees from time to time.

  • Right to Refuse to Cross Picket Lines (a) All employees covered by this Agreement shall have the right to refuse to cross a picket line arising out of a dispute as defined in the appropriate legislation. Any employees failing to report for duty shall be considered to be absent without pay. (b) Failure to cross a picket line encountered in carrying out the Employer's business shall not be considered a violation of this Agreement nor shall it be grounds for disciplinary action.

  • Access to Records The Contractor and its subcontractors, if any, shall maintain all books, documents, papers, accounting records, and other evidence pertaining to all costs incurred under this Contract. They shall make such materials available at their respective offices at all reasonable times during this Contract, and for three (3) years from the date of final payment under this Contract, for inspection by the State or its authorized designees. Copies shall be furnished at no cost to the State if requested.
