Right to Use/Street Lights and Trees. USPS has agreed to sell the Property to Buyer upon the condition that Buyer continues to provide roads from 000xx Xxxxxx to the USPS facility located on the Larger Parcel and from Municipal Drive to the USPS facility located on the Larger Parcel (“Roads”), in substantially the same form as such Roads exist at Closing. Specifically, it is the intent of Buyer and USPS that (a) a majority of the Property operate as a road designated as public by Buyer; (b) Buyer continue to provide a road for the use of USPS and the public between Municipal Drive and the USPS facility located on the Larger Parcel (c) Buyer maintain the subject Roads consistent with its practice of maintaining other public roads within its inventory; (d) the public and USPS shall continue at all times to enjoy unobstructed use of the Roads, except that limited access may be afforded during times of maintenance and construction related to the Roads upon three (3) days’ written notice to USPS; (e) the public and USPS, including specifically, USPS’ trucks, shall continue at all times to enjoy unobstructed access to and use of the Roads, 116th Street, and Municipal Drive, except that limited access may be afforded during times of maintenance and construction related to 000xx Xxxxxx xxx Xxxxxxxxx Xxxxx upon three (3) days’ written notice to USPS;

  • Right to Use City shall not be limited in any way in its use or reuse of the Documents and Data or any part of them at any time for purposes of this Project or another project, provided that any such use not within the purposes intended by this Agreement or on a project other than this Project without employing the services of Consultant shall be at City’s sole risk. If City uses or reuses the Documents & Data on any project other than this Project, it shall remove the Consultant’s seal from the Documents & Data and indemnify and hold harmless Consultant and its officers, directors, agents and employees from claims arising out of the negligent use or re-use of the Documents & Data on such other project. Consultant shall be responsible and liable for its Documents & Data, pursuant to the terms of this Agreement, only with respect to the condition of the Documents & Data at the time they are provided to the City upon completion, suspension, abandonment or termination. Consultant shall not be responsible or liable for any revisions to the Documents & Data made by any party other than Consultant, a party for whom the Consultant is legally responsible or liable, or anyone approved by the Consultant.

  • System Agency Right to Use Contractor agrees that System Agency has the right to use, produce, and distribute copies of and to disclose to System Agency employees, agents, and contractors and other governmental entities all or part of this Contract or any related Solicitation Response as System Agency deems necessary to complete the procurement process or comply with state or federal laws.

  • Street Lighting 4.4.1 The Developer shall provide streetlights for the entire Subdivision at his sole expense. The type of lighting standard, pole spacing, and installation shall be per Memphis Light, Gas and Water standards. Memphis Light Gas and Water shall bill the City for installation of street lighting per its standards.

  • Freedom to Use Ideas Subject to Section 9 and Client’s rights in Client Information and notwithstanding anything to the contrary contained in this Agreement or an Order Form, the ideas, methods, concepts, know-how, structures, techniques, inventions, developments, processes, discoveries, improvements and other information and materials developed in and during the course of any Order Form may be used by Red Hat, without an obligation to account, in any way Red Hat deems appropriate, including by or for itself or its clients or customers.

  • Right to Refuse to Cross Picket Lines All employees covered by this Agreement shall have the right to refuse to cross a picket line arising out of a dispute as defined in the Labour Relations Code of British Columbia. Any employee failing to report for duty shall be considered to be absent without pay. Failure to cross a picket line encountered in carrying out the Employer's business shall not be considered a violation of this Agreement nor shall it be grounds for disciplinary action.
