Common use of Rights of Data Subjects Clause in Contracts

Rights of Data Subjects. 3.1 Data Subject Requests. ClickDimensions shall, to the extent legally permitted, promptly notify Customer if ClickDimensions receives a request from a Data Subject to exercise the Data Subject's right of access, right to rectification, restriction of Processing, erasure (“right to be forgotten”), data portability, object to the Processing, or its right not to be subject to an automated individual decision making (“Data Subject Request”). Taking into account the nature of the Processing, ClickDimensions shall assist Customer by appropriate technical and organizational measures, insofar as this is possible, for the fulfilment of Customer’s obligation to respond to a Data Subject Request under Data Protection Laws and Regulations. In addition, to the extent Customer, in its use of the Services, does not have the ability to address a Data Subject Request, ClickDimensions shall upon Customer’s request provide commercially reasonable efforts to assist Customer in responding to such Data Subject Request, to the extent ClickDimensions is legally permitted to do so and the response to such Data Subject Request is required under Data Protection Laws and Regulations. To the extent legally permitted, Customer shall be responsible for any costs arising from ClickDimensions’ provision of such assistance.

ClickDimensions Cohesity shall, to the extent legally permitted, promptly notify Customer if ClickDimensions Cohesity receives a request from a Data Subject to exercise the Data Subject's right of access, right to rectification, restriction of Processing, erasure (“right to be forgotten”), data portability, object to the Processing, or its right not to be subject to an automated individual decision making or other ‘subject access’ right under applicable law (“Data Subject Request”). Taking into account the nature of the Processing, ClickDimensions Cohesity shall assist Customer by appropriate technical and organizational measures, insofar as this is possiblepossible and commercially practicable, for the fulfilment of Customer’s obligation to respond to a Data Subject Request under Data Protection Laws and Regulations. In addition, to the extent Customer, in its use of the Services, does not have the ability to address a Data Subject Request, ClickDimensions Cohesity shall upon Customer’s request provide commercially reasonable efforts to assist Customer in responding to such Data Subject Request, to the extent ClickDimensions Cohesity is legally permitted to do so and the response to such Data Subject Request is required under Data Protection Laws and Regulations. To the extent legally permitted, Customer shall be responsible for any costs arising from ClickDimensions’ Cohesity’s provision of such assistance.

Taking into account the nature of the Processing, ClickDimensions VTEX shall assist Customer by appropriate technical and organizational measures, insofar as this is possible, for the fulfilment fulfillment of Customer’s obligation to respond to a Data Subject Request under applicable Data Protection Laws and RegulationsLaws. In addition, to the extent Customer, in its use of the Services, does not have the ability to address a Data Subject Request, ClickDimensions shall VTEX shall, upon Customer’s request request, provide commercially reasonable efforts to assist Customer in responding to such Data Subject Request, to the extent ClickDimensions VTEX is legally permitted to do so and the response to such Data Subject Request is required under applicable Data Protection Laws and RegulationsLaws. To the extent legally permitted, Customer shall be responsible for any costs arising from ClickDimensions’ VTEX's provision of such assistance, including any fees associated with provision of additional functionality.

Taking into account the nature of the Processing, ClickDimensions Parsable shall assist Customer by appropriate technical and organizational measures, insofar as this is possible, for the fulfilment of Customer’s obligation to respond to a Data Subject Request under Data Protection Laws and Regulations. In addition, to the extent Customer, in its use of the Services, does not have the ability to address a Data Subject Request, ClickDimensions Parsable shall upon Customer’s request provide commercially reasonable efforts to assist Customer in responding to such Data Subject Request, to the extent ClickDimensions Parsable is legally permitted to do so and the response to such Data Subject Request is required under Data Protection Laws and Regulations. To the extent legally permitted, Customer shall be responsible for any costs arising from ClickDimensions’ Parsable’s provision of such assistance.

In addition, to the extent Customer, in its use of the Services, does not have the ability to address a Data Subject Request, ClickDimensions Impero shall upon Customer’s request provide commercially reasonable efforts to assist Customer in responding to such Data Subject Request, to the extent ClickDimensions Impero is legally permitted to do so and the response to such Data Subject Request is required under Data Protection Laws and Regulations. To the extent legally permitted, Customer shall be responsible for any costs arising from ClickDimensions’ Impero’s provision of such assistance.

Taking into account the nature of the Processing, ClickDimensions ITG shall assist Customer by appropriate technical and organizational measures, insofar as this is possible, for the fulfilment of Customer’s obligation to respond to a Data Subject Request under Data Protection Laws and Regulations. In addition, to the extent Customer, in its use of the Services, does not have the ability to address a Data Subject Request, ClickDimensions shall ITG shall, upon Customer’s request request, provide commercially reasonable efforts to assist Customer in responding to such Data Subject Request, to the extent ClickDimensions ITG is legally permitted to do so and the response to such Data Subject Request is required under Data Protection Laws and Regulations. To the extent legally permitted, Customer shall be responsible for any costs arising from ClickDimensions’ ITG’s provision of such assistance.

In addition, to the extent Customer, in its use of the Services, does not have the ability to address a Data Subject Request, ClickDimensions essensys shall upon Customer’s request provide commercially reasonable efforts to assist Customer in responding to such Data Subject Request, to the extent ClickDimensions essensys is legally permitted to do so and the response to such Data Subject Request is required under Data Protection Laws and Regulations. To the extent legally permitted, Customer shall be responsible for any costs arising from ClickDimensionsessensys’ provision of such assistance.

ClickDimensions CVI shall, to the extent legally permitted, promptly notify Customer if ClickDimensions CVI receives a request from a Data Subject to exercise the Data Subject's ’s right of access, right to rectification, restriction of Processing, erasure (“right to be forgotten”), data portability, object to the Processing, or its right not to be subject to an automated individual decision making making, solely to the extent each such request is available to the Data Subject under Data Protection Laws (each such request being a “Data Subject Request”). Taking into account the nature of the Processing, ClickDimensions CVI shall assist Customer by appropriate technical and organizational measures, insofar as this is possible, for the fulfilment of Customer’s obligation to respond to a Data Subject Request under Data Protection Laws and RegulationsLaws. In addition, to the extent Customer, in its use of the Services, does not have the ability to address a Data Subject Request, ClickDimensions CVI shall upon Customer’s request provide commercially reasonable efforts to assist Customer in responding to such Data Subject Request, to the extent ClickDimensions CVI is legally permitted to do so and the response to such Data Subject Request is required under Data Protection Laws and RegulationsLaws. To the extent legally permitted, Customer shall be responsible for any costs arising from ClickDimensions’ CVI’s provision of any such assistanceassistance described in this Section.

Rights of Data Subjects. 3.1 Data Subject Requests. ClickDimensions Strigo shall, to the extent legally permitted, promptly notify Customer if ClickDimensions Strigo receives a request any requests from a Data Subject to exercise the following Data Subject's right of Subject rights in relation to Personal Data: access, right to rectification, restriction of Processing, erasure (“"right to be forgotten”"), data portability, object objection to the Processing, or its right to not to be subject to an automated individual decision making (“each, a "Data Subject Request”"). Taking into account the nature of the Processing, ClickDimensions Strigo shall assist Customer by appropriate technical and organizational measures, insofar as this is possible, for the fulfilment of Customer’s 's obligation to respond to a Data Subject Request under applicable Data Protection Laws and RegulationsLaws. In addition, to the extent Customer, in its use of the Services, does not have the ability to address a Data Subject Request, ClickDimensions shall Strigo shall, upon Customer’s request 's request, provide commercially reasonable efforts to assist Customer in responding to such Data Subject Request, to the extent ClickDimensions Strigo is legally permitted to do so and the response to such Data Subject Request is required under applicable Data Protection Laws and RegulationsLaws. To the extent legally permitted, Customer shall be responsible for any costs arising from ClickDimensions’ Strigo's provision of such assistance, including any fees associated with provision of additional functionality.

Rights of Data Subjects. 3.1 Data Subject RequestsRequest. ClickDimensions Data Processor shall, to the extent legally permitted, promptly notify Customer if ClickDimensions Data Processor receives a request from a Data Subject to exercise the Data Subject's right of access, right to rectification, restriction of Processing, erasure (“right to be forgotten”), restriction of Processing, data portability, object right to the Processingobject, or its right not to be subject to an automated individual decision making (“Data Subject Request”). Taking into account the nature of the Processing, ClickDimensions Data Processor shall assist Customer by appropriate technical and organizational measures, insofar as this is possible, for the fulfilment of Customer’s obligation to respond to a Data Subject Request under Data Protection Laws and Regulations. In addition, to the extent Customer, in its use of the Services, does not have the ability to address a Data Subject Request, ClickDimensions Data Processor shall upon Customer’s request provide commercially reasonable efforts to assist Customer in responding to such Data Subject Request, to the extent ClickDimensions Data Processor is legally permitted to do so and the response to such Data Subject Request is required under Data Protection Laws and Regulations. To the extent legally permitted, Customer shall be responsible for any costs arising from ClickDimensions’ Data Processor’s provision of such assistance.

ClickDimensions ConnectWise shall, to the extent legally permitted, promptly notify Customer Client if ClickDimensions ConnectWise receives a request from a Data Subject to exercise the Data Subject's ’s right of access, right to rectification, restriction of Processing, erasure (“right to be forgotten”), data portability, object to the Processing, or its right not to be subject to an automated individual decision making (making, each such request being a “Data Subject Request”). Taking into account the nature of the Processing, ClickDimensions ConnectWise shall assist Customer Client by appropriate technical and organizational measures, insofar as this is possible, for the fulfilment of CustomerClient’s obligation to respond to a Data Subject Request under Data Protection Laws and Regulations. In addition, to the extent CustomerClient, in its use of the Services, does not have the ability to address a Data Subject Request, ClickDimensions ConnectWise shall upon CustomerClient’s request provide commercially reasonable efforts to assist Customer Client in responding to such Data Subject Request, Request to the extent ClickDimensions ConnectWise is legally permitted to do so and the response to such Data Subject Request is required under Data Protection Laws and Regulations. To the extent legally permitted, Customer Client shall be responsible for any costs arising from ClickDimensions’ ConnectWise’s provision of such assistance.

ClickDimensions shallConvercent will, to the extent legally permitted, promptly notify Customer if ClickDimensions Convercent receives a request from a Data Subject to exercise the Data Subject's right of access, right to rectification, restriction of Processing, erasure (“right to be forgotten”), data portability, object objection to the Processing, or its right not to be subject to an automated individual decision making (“Data Subject Request”). Taking into account the nature of the Processing, ClickDimensions shall Convercent will assist Customer by appropriate technical and organizational measures, insofar as this is possiblepossible and to the extent that the Services do not already provide such measures for Customer, for the fulfilment of Customer’s obligation to respond to a Data Subject Request under Applicable Data Protection Laws and RegulationsLaws. In addition, to the extent Customer, in its use of the Services, does not have the ability to address a Data Subject Request, ClickDimensions shall Convercent will, upon Customer’s request and at Customer’s expense, provide commercially reasonable efforts to assist Customer in responding to such Data Subject Request, to the extent ClickDimensions Convercent is legally permitted to do so and the response to such Data Subject Request is required under Data Protection Laws and Regulations. To the extent legally permitted, Customer shall will be responsible for any reasonable costs arising from ClickDimensions’ Convercent’s provision of such assistance.

Rights of Data Subjects. 3.1 Data Subject RequestsRequest. ClickDimensions PassFort shall, to the extent legally permitted, promptly notify Customer if ClickDimensions PassFort receives a request from a Data Subject to exercise the Data Subject's ’s right of access, right to rectification, restriction of Processing, erasure (“right to be forgotten”), data portability, object to the Processing, or its right not to be subject to an automated individual decision making (making, each such request being a “Data Subject Request”). Taking into account the nature of the Processing, ClickDimensions PassFort shall assist Customer by appropriate technical and organizational organisational measures, insofar as this is possible, for the fulfilment of Customer’s obligation to respond to a Data Subject Request under Data Protection Laws and Regulations. In addition, to the extent Customer, in its use of the Services, does not have the ability to address a Data Subject Request, ClickDimensions PassFort shall upon Customer’s request provide commercially reasonable efforts to assist Customer in responding to such Data Subject Request, to the extent ClickDimensions PassFort is legally permitted to do so and the response to such Data Subject Request is required under Data Protection Laws and Regulations. To the extent legally permitted, Customer shall be responsible for any costs arising from ClickDimensions’ PassFort’s provision of such assistance.

ClickDimensions Roambee shall, to the extent legally permitted, promptly notify Customer if ClickDimensions Roambee receives a request from a Data Subject to exercise the Data Subject's right of access, right to rectification, restriction of Processing, erasure (“right to be forgotten”), data portability, object to the Processing, or its right not to be subject to an automated individual decision making (making, each such request being a “Data Subject Request”). Taking into account the nature of the Processing, ClickDimensions Roambee shall assist Customer by appropriate technical and organizational measures, insofar as this is possible, for the fulfilment of Customer’s obligation to respond to a Data Subject Request under Data Protection Laws and Regulations. In addition, to the extent Customer, in its use of the Services, does not have the ability to address a Data Subject Request, ClickDimensions Roambee shall upon Customer’s request provide commercially reasonable efforts to assist Customer in responding to such Data Subject Request, to the extent ClickDimensions Roambee is legally permitted to do so and the response to such Data Subject Request is required under Data Protection Laws and Regulations. To the extent legally permitted, Customer shall be responsible for any costs arising from ClickDimensions’ Roambee’s provision of such assistance.

Rights of Data Subjects. 3.1 Data Subject Requests. ClickDimensions UChat shall, to the extent legally permitted, promptly notify Customer if ClickDimensions UChat receives a request any requests from a Data Subject to exercise Data Subject rights afforded to the Data Subject's right of Subject under applicable Data Protection Law in relation to Personal Data, including, as applicable, the following: access, right to rectification, restriction of Processing, erasure (“right to be forgotten”), data portability, object objection to the Processing, or its right to not to be subject to an automated individual decision making (each, a “Data Subject Request”). Taking into account the nature of the Processing, ClickDimensions UChat shall assist Customer by appropriate technical and organizational measures, insofar as this is possible, for the fulfilment of Customer’s obligation to respond to a Data Subject Request under as required by applicable Data Protection Laws and RegulationsLaws. In addition, to the extent Customer, in its use of the Services, does not have the ability to address a Data Subject Request, ClickDimensions shall UChat shall, upon Customer’s request request, provide commercially reasonable efforts to assist Customer Cus- tomer in responding to such Data Subject Request, to the extent ClickDimensions UChat is legally permitted to do so and the response to such Data Subject Request is required under applicable Data Protection Laws and RegulationsProtec- tion Laws. To the extent legally permitted, Customer shall be responsible for any costs arising from ClickDimensions’ UChat’s provision of such assistance, including any fees associated with provision of ad- ditional functionality.

ClickDimensions Company shall, to the extent legally permitted, promptly notify Customer if ClickDimensions Company receives a request from a Data Subject to exercise the Data Subject's valid right of access, right to rectification, restriction of Processing, erasure (“right to be forgotten”), data portability, object to the Processing, or its right not to be subject to an automated individual decision making making, to the extent that such Data Subject is entitled to such rights under applicable Data Protection Laws and Regulations (“Data Subject RequestInquiry”). Taking into account the nature of the Processing, ClickDimensions Company shall assist Customer by appropriate technical and organizational measures, insofar as this is possible, for the fulfilment of Customer’s obligation to respond to a Data Subject Request Inquiry under Data Protection Laws and Regulations. In addition, to the extent Customer, in its use of the Subscription Services, does not have the ability to address a Data Subject RequestInquiry, ClickDimensions Company shall upon Customer’s request provide commercially reasonable efforts to assist Customer in responding to such Data Subject RequestInquiry, to the extent ClickDimensions Company is legally permitted to do so and the response to such Data Subject Request Inquiry is required under Data Protection Laws and Regulations. To the extent legally permitted, Customer shall be responsible for any costs arising from ClickDimensions’ Company’s provision of such assistance.

Supplier shall not respond to a Data Subject Request itself, except that Customer authorizes Supplier to redirect the Data Subject Request as necessary to allow Customer to respond directly. Taking into account the nature of the Processing, ClickDimensions Supplier shall assist Customer by appropriate technical and organizational measures, insofar as this is possible, for the fulfilment of Customer’s obligation to respond to a Data Subject Request under Data Protection Laws and RegulationsLaws. In addition, to the extent Customer, in its use of the Services, does not have the ability to address a Data Subject Request, ClickDimensions Supplier shall upon Customer’s request provide commercially reasonable efforts to assist Customer in responding to such Data Subject Request, to the extent ClickDimensions Supplier is legally permitted to do so and the response to such Data Subject Request is required under Data Protection Laws and RegulationsLaws. To the extent legally permitted, Customer shall be responsible for any costs arising from ClickDimensions’ Supplier’s provision of such assistance.

ClickDimensions MapAnything shall, to the extent legally and technically permitted, promptly notify Customer if ClickDimensions MapAnything receives a request from a Data Subject to exercise the Data Subject's right of access, right to rectification, restriction of Processing, erasure (“right to be forgotten”), data portability, object to the Processing, or its right not to be subject to an automated individual decision making (“Data Subject Request”). Taking into account the nature of the Processing, ClickDimensions MapAnything shall not respond to Data Subject requests directly. MapAnything will assist Customer by appropriate technical and organizational measures, insofar as this is possible, for the fulfilment of Customer’s obligation to respond to a Data Subject Request under Data Protection Laws and RegulationsApplicable Laws. In addition, to the extent CustomerMapAnything shall, in its use of the Services, does not have the ability to address a Data Subject Request, ClickDimensions shall upon Customer’s request request, provide commercially reasonable efforts to assist Customer in responding to such Data Subject Request, to the extent ClickDimensions MapAnything is legally and technically permitted to do so and the response to such Data Subject Request is required under Data Protection Laws and RegulationsApplicable Laws. To the extent legally permitted, Customer shall be responsible for any costs arising from ClickDimensions’ MapAnything’s provision of such assistance.

ClickDimensions Medius shall, to the extent legally permitted, promptly notify Customer if ClickDimensions Medius receives a request from a Data Subject to exercise the Data Subject's right of access, right to rectification, restriction of Processing, erasure (“right to be forgotten”), data portability, object to the Processing, or its right not to be subject to an automated individual decision making making, or any other right under the Data Protection Laws and Regulations (“Data Subject Request”). Taking into account the nature of the Processing, ClickDimensions Medius shall assist Customer by appropriate technical and organizational measures, insofar as this is possible, for the fulfilment of Customer’s obligation to respond to a Data Subject Request under Data Protection Laws and Regulations. In addition, to the extent Customer, in its Customer’s use of the Services, does do not have the ability to address a Data Subject Request, ClickDimensions Medius shall upon Customer’s request provide commercially reasonable efforts to assist Customer in responding to such Data Subject Request, to the extent ClickDimensions Medius is legally permitted to do so and the response to such Data Subject Request is required under Data Protection Laws and Regulations. To the extent legally permitted, Customer shall be responsible for any costs arising from ClickDimensions’ Medius’s provision of such assistance.. SECURITY AND CONFIDENTIALITY

ClickDimensions SafePaaS shall, to the extent legally permitted, promptly notify Customer if ClickDimensions SafePaaS receives a request from a Data Subject to exercise the Data Subject's right of access, right to rectification, restriction of Processing, erasure (“right to be forgotten”), data portability, object to the Processing, or its right not to be subject to an automated individual decision making (making, each such request being a “Data Subject Request”). Taking into account the nature of the Processing, ClickDimensions SafePaaS shall assist Customer by appropriate technical and organizational measures, insofar as this is possible, for the fulfilment of Customer’s obligation to respond to a Data Subject Request under Data Protection Laws and Regulations. In addition, to the extent Customer, in its use of the Services, does not have the ability to address a Data Subject Request, ClickDimensions SafePaaS shall upon Customer’s request provide commercially reasonable efforts to assist Customer in responding to such Data Subject Request, to the extent ClickDimensions SafePaaS is legally permitted to do so and the response to such Data Subject Request is required under Data Protection Laws and Regulations. To the extent legally permitted, Customer shall be responsible for any costs arising from ClickDimensions’ SafePaaS’s provision of such assistance.

Rights of Data Subjects. 3.1 Data Subject RequestsRequest. ClickDimensions Wasabi Technologies shall, to the extent legally permitted, promptly notify Customer if ClickDimensions Wasabi Technologies receives a request from a Data Subject to exercise the Data Subject's right of access, right to rectification, restriction of Processing, erasure (“right to be forgotten”), data portability, object to the Processing, or its right not to be subject to an automated individual decision making (“Data Subject Request”). Taking into account the nature of the Processing, ClickDimensions Wasabi Technologies shall assist Customer by appropriate technical and organizational measures, insofar as this is possible, for the fulfilment of Customer’s obligation to respond to a Data Subject Request under Data Protection Laws and Regulations. In addition, to the extent Customer, in its use of the Services, does not have the ability to address a Data Subject Request, ClickDimensions Wasabi Technologies shall upon Customer’s request provide commercially reasonable efforts to assist Customer in responding to such Data Subject Request, to the extent ClickDimensions Wasabi Technologies is legally permitted to do so and the response to such Data Subject Request is required under Data Protection Laws and Regulations. To the extent legally permitted, Customer shall be responsible for any costs arising from ClickDimensions’ Wasabi Technologies provision of such assistance.

Rights of Data Subjects. 3.1 Data Subject RequestsRequest. ClickDimensions OpenExchange shall, to the extent legally permitted, promptly notify Customer if ClickDimensions it receives a request from a Data Subject to exercise the Data Subject's right of access, right to rectification, restriction of Processing, erasure (“right to be forgotten”), data portability, object to the Processing, or its right not to be subject to an automated individual decision making (“Data Subject Request”). Taking into account the nature of the Processing, ClickDimensions OpenExchange shall assist Customer by appropriate technical and organizational measures, insofar as this is possible, for the fulfilment of Customer’s obligation to respond to a Data Subject Request under Data Protection Laws and Regulations. In addition, to the extent Customer, in its use of the Services, does not have the ability to address a Data Subject Request, ClickDimensions OpenExchange shall upon Customer’s request provide commercially reasonable efforts to assist Customer in responding to such Data Subject Request, to the extent ClickDimensions OpenExchange is legally permitted to do so and the response to such Data Subject Request is required under Data Protection Laws and Regulations. To the extent legally permitted, Customer shall be responsible for any costs arising from ClickDimensions’ OpenExchange’s provision of such assistance.

Taking into account the nature of the Processing, ClickDimensions Miso shall assist Customer by appropriate technical and organizational measures, insofar as this is possible, for the fulfilment of Customer’s obligation to respond to a Data Subject Request under Data Protection Laws and Regulations. In addition, to the extent Customer, in its use of the Services, does not have the ability to address a Data Subject Request, ClickDimensions Miso shall upon Customer’s request provide commercially reasonable efforts to assist Customer in responding to such Data Subject Request, to the extent ClickDimensions Miso is legally permitted to do so and the response to such Data Subject Request is required under Data Protection Laws and Regulations. To the extent legally permitted, Customer shall be responsible for any costs arising from ClickDimensionsMiso’ provision of such assistance.

Taking into account the nature of the Processing, ClickDimensions Asana shall assist Customer by appropriate technical and organizational measures, insofar as this is possible, for the fulfilment of Customer’s obligation to respond to a Data Subject Request under applicable Data Protection Laws and RegulationsLaws. In addition, to the extent Customer, in its use of the ServicesService, does not have the ability to address a Data Subject Request, ClickDimensions shall Asana shall, upon Customer’s request request, provide commercially reasonable efforts to assist Customer in responding to such Data Subject Request, to the extent ClickDimensions Asana is legally permitted to do so and the response to such Data Subject Request is required under applicable Data Protection Laws and RegulationsLaws. To the extent legally permitted, Customer shall be responsible for any costs arising from ClickDimensions’ Asana’s provision of such assistance, including any fees associated with provision of additional functionality.
