Common use of Rights of Data Subjects Clause in Contracts

Rights of Data Subjects. 12.1 Data Subject Requests. Pleo shall, to the extent legally permitted, promptly notify Customer if Pleo receives a request from a Data Subject to exercise the Data Subject's right of access, right to rectification, restriction of Processing, erasure (“right to be forgotten”), data portability, object to the Processing, or its right not to be subject to an automated individual decision making (“Data Subject Request”). Taking into account the nature of the Processing, Pleo shall assist Customer by appropriate technical and organizational measures, insofar as this is possible, for the fulfilment of Customer’s obligation to respond to a Data Subject Request under Data Protection Laws and Regulations. In addition, to the extent Customer, in its use of the Services, does not have the ability to address a Data Subject Request, Pleo shall upon Customer’s request provide commercially reasonable efforts to assist Customer in responding to such Data Subject Request, to the extent Pleo is legally permitted to do so and the response to such Data Subject Request is required under Data Protection Laws and Regulations. To the extent legally permitted, Customer shall be responsible for any costs arising from Pleo’s provision of such assistance.

Pleo WorkSpan shall, to the extent legally permitted, promptly notify Customer if Pleo it receives a request from a Data Subject to exercise the their rights in Customer Personal Data Subject's right of access, right to rectification, restriction of Processing, erasure (“right to be forgotten”), data portability, object to the Processing, or its right not to be subject to an automated individual decision making under Data Protection Laws and Regulations (“Data Subject Request”). WorkSpan shall not respond to a Data Subject Request without Customer’s prior written consent except to confirm that such request relates to Customer. Taking into account the nature of the Processing, Pleo WorkSpan shall assist Customer by appropriate technical and organizational measures, insofar as this is possible, for the fulfilment of Customer’s obligation to respond to a Data Subject Request under Data Protection Laws and Regulations. In addition, to the extent Customer, in its use of the Services, does not have the ability to address a Data Subject Request, Pleo WorkSpan shall upon Customer’s request provide commercially reasonable efforts to assist Customer in responding to such Data Subject Request, to the extent Pleo WorkSpan is legally permitted to do so and the response to such Data Subject Request is required under Data Protection Laws and Regulations. To the extent legally permitted, Customer shall be responsible for any costs and expenses arising from PleoWorkSpan’s provision of such assistance.

To the extent legally permitted, Customer shall be responsible for any costs arising from Pleo’s provision of such assistance. 12.2 Notwithstanding the foregoing, Customer understands that Pleo may retain Customer Data if required by law, and such data will remain subject to the requirements of this Agreement.

Taking into account the nature of the Processing, Pleo AllCloud shall assist Customer by appropriate technical and organizational measures, insofar as this is reasonably possible, for the fulfilment of Customer’s obligation to respond to a Data Subject Request under Applicable Data Protection Laws and RegulationsLaws. In addition, to the extent Customer, Customer in its use of the Services, Services does not have the ability to address a Data Subject Request, Pleo AllCloud shall upon Customer’s request provide commercially reasonable efforts to assist Customer in responding to such Data Subject Request, to the extent Pleo AllCloud is legally permitted to do so and the response to such Data Subject Request is required under Applicable Data Protection Laws and RegulationsLaws. To the extent legally permitted, Customer shall be responsible for any costs arising from PleoAllCloud’s provision of such assistance.

In addition, to the extent CustomerClient, in its use of the Services, does not have the ability to address a Data Subject Request, Pleo CP shall upon CustomerClient’s request provide commercially reasonable efforts to assist Customer Client in responding to such Data Subject Request, to the extent Pleo CP is legally permitted to do so and the response to such Data Subject Request is required under Data Protection Laws and Regulations. To the extent legally permitted, Customer Client shall be responsible for any costs arising from PleoCP’s provision of such assistance.

In addition, to the extent Customer, in its use of the Services, does not have the ability to address a Data Subject Request, Pleo Company shall upon Customer’s request provide commercially reasonable efforts to assist Customer in responding to such Data Subject Request, to the extent Pleo Company is legally permitted to do so and the response to such Data Subject Request is required under Data Protection Laws and Regulations. To the extent legally permitted, Customer shall be responsible for any costs arising from PleoCompany’s provision of such assistance.

Taking into account the nature of the Processing, Pleo Xxxx shall assist the Customer by appropriate technical and organizational measures, insofar as this is possible, for the fulfilment of the Customer’s obligation to respond to a Data Subject Request under Data Protection Laws and Regulations. In addition, to the extent the Customer, in its use of the Services, does not have the ability to address a Data Subject Request, Pleo shall upon Customer’s request provide commercially reasonable efforts to assist the Customer in responding to such Data Subject Request, to the extent Pleo is legally permitted to do so and the response to such Data Subject Request is required under Data Protection Laws and Regulations. To the extent legally permitted, the Customer shall be responsible for any costs arising from Pleo’s provision of such assistance. 12.2 Notwithstanding the foregoing, the Customer understands that Pleo may retain Customer Data if required by law, and such data will remain subject to the requirements of this Agreement.

In addition, to the extent Customer, in its use of the Services, does not have the ability to address a Data Subject Request, Pleo Oveo shall upon Customer’s request provide commercially reasonable efforts to assist Customer in responding to such Data Subject Request, to the extent Pleo Oveo is legally permitted to do so and the response to such Data Subject Request is required under Data Protection Laws and Regulations. To the extent legally permitted, Customer shall be responsible for any costs arising from PleoOveo’s provision of such assistance.
