RIGHTS OF FACULTY. Except as modified by this agreement, the Employer retains all rights of Management, which in addition to all powers, duties and rights established by constitutional provision or statute, will include but not be limited to, the right to: 4.1. Nondiscrimination: The parties agree that there will be no discrimination against any professor because of race, sex, gender, sexual orientation, age, religion, color, ancestry, or in violation of current state and/or federal law unless on a bona fide occupational qualification, in the administration or application of the terms of this Agreement.
