Road Easement. As a condition to Developer’s undertakings set forth in Article 2, the Town will grant Developer an easement (the “Road Easement”) to install portions of the Cable within the boundaries of the roads identified in Appendix C and for access to portions of the Cable that are not located with the boundaries of Town roads. The Road Easement shall establish technical specifications including minimum burial depth and maximum width of the final Cable. Developer will consult with the Town to minimize disturbances to the unpaved areas within the Town-owned rights of way and to restore such areas in accordance with subsection 3.1(e) below. The Road Easement will include temporary easements for purposes of (a) temporary field offices;

Road Easement. A perpetual and assignable easement and right-of-way in, on over and across (the land described in Schedule A) (Tracts Nos. , and ) for the location, construction, operation, maintenance, alteration and replacement of (a) road(s) and appurtenances thereto; together with the right to trim, cut, fell and remove therefrom all trees, underbrush, obstructions and other vegetation, structures, or obstacles within the limits of the right-of-way; (reserving, however, to the owners, their heirs and assigns, the right to cross over or under the right-of-way as access to their adjoining land at the locations indicated in Schedule B); 5/ subject, however, to existing easements for public roads and highways, public utilities, railroads and pipelines.
Road Easement. Owner shall grant a road easement along a portion of the southern boundary of the Property to create a four way intersection at S Xxxxx Xx. and State Highway 33 (the “Easement”). Such easement shall be 30’ wide and shall be between 150’ and 200’ in length measured from State Highway 33, to accommodate a future road design approved by the City Engineer and the Idaho Transportation Department. The Easement is depicted on Exhibit B, a rezone site plan (the “Rezone Site Plan”).
Road Easement. A. Reserve hereby grants to Corporate Center, and its successors and assigns (the owner(s) of the Center Property from time to time are hereinafter collectively referred to as the “Center Owner”) a non-exclusive easement for access, ingress and egress over all of the existing roadways and rights of way now located, or as they may be relocated in accordance with the provisions of this Easement Agreement and any applicable governmental requirements on the Reserve Property described as Master Common Element Arterial Road on Exhibit “D” attached hereto and by this reference incorporated herein, which includes the Reserve Road Extension, as hereinafter defined (hereinafter referred to as the “Road Easement”). The parties hereto agree that the portion of the Road Easement designated as “Abandon Easement” on Exhibit “D” may be relocated to a location depicted on Exhibit “D” and designated as the “Relocation Area” at such time as WCI, at its sole cost and expense, constructs, within the Relocation Area, a substitute road to be constructed to be substantially the same as the existing roads within the Road Easement and in accordance applicable governmental requirements. The Road Easement granted herein shall be perpetual, appurtenant to the Center Property and shall run with the Center Property, provided however, that upon any conveyance of the Road Easement or any portion thereof, to the City of Danbury, Connecticut (hereinafter referred to as the “City”) for permanent use as public streets, and the acceptance of such conveyance of thereof without condition or cost to Center Owner and its successors, the Road Easement shall automatically terminate with respect to any portion of the Road Easement so conveyed. The Road Easement is intended to benefit the owner or owners from time to time of the Center Property, as well as the licensees, invitees, tenants other parties lawfully using or occupying the Center Property.

  • Lessor to Grant Easements, Etc Lessor will, from time to time, so long as no Event of Default has occurred and is continuing, at the request of Lessee and at Lessee’s cost and expense (but subject to the approval of Lessor, which approval shall not be unreasonably withheld or delayed), (a) grant easements and other rights in the nature of easements with respect to the Leased Property to third parties, (b) release existing easements or other rights in the nature of easements which are for the benefit of the Leased Property, (c) dedicate or transfer unimproved portions of the Leased Property for road, highway or other public purposes, (d) execute petitions to have the Leased Property annexed to any municipal corporation or utility district, (e) execute amendments to any covenants and restrictions affecting the Leased Property and (f) execute and deliver to any Person any instrument appropriate to confirm or effect such grants, releases, dedications, transfers, petitions and amendments (to the extent of its interests in the Leased Property), but only upon delivery to Lessor of an Officer’s Certificate stating that such grant, release, dedication, transfer, petition or amendment does not interfere with the proper conduct of the business of Lessee on the Leased Property and does not materially reduce the value of the Leased Property.

  • No Light, Air or View Easement Any diminution or shutting off of light, air or view by any structure which may be erected on lands adjacent to or in the vicinity of the Building shall in no way affect this Lease or impose any liability on Landlord.

  • Easements Lessor reserves to itself the right, from time to time, to grant such easements, rights and dedications that Lessor deems necessary or desirable, and to cause the recordation of Parcel Maps and restrictions, so long as such easements, rights, dedications, Maps and restrictions do not unreasonably interfere with the use of the Premises by Lessee. Lessee shall sign any of the aforementioned documents upon request of Lessor and failure to do so shall constitute a material breach of this Lease.

  • Condition of Leased Premises Tenant hereby acknowledges that Xxxxxx has examined the leased premises prior to the signing of this Lease, or knowingly waived said examination. Tenant acknowledges that Tenant has not relied on any representations made by Landlord or Landlord’s agents regarding the condition of the leased premises and that Tenant takes premises in its AS-IS condition with no express or implied warranties or representations beyond those contained herein or required by applicable Georgia law. Xxxxxx agrees not to damage the premises through any act or omission, and to be responsible for any damages sustained through the acts or omissions of Tenant, Xxxxxx’s family or Xxxxxx’s invitees, licensees, and/or guests. If such damages are incurred, Tenant is required to pay for any resulting repairs at the same time and in addition to the next month’s rent payment, with consequences for non-payment identical to those for non- payment of rent described herein. At the expiration or termination of the Lease, Tenant shall return the leased premises in as good condition as when taken by Tenant at the commencement of the lease, with only normal wear-and-tear excepted. Modification Of This Lease Any modification of this lease shall not be binding upon Landlord unless in writing and signed by Landlord or Landlord’s authorized agent. No oral representation shall be effective to modify this Lease. If, as per the terms of this paragraph, any provision of this lease is newly added, modified, or stricken out, the remainder of this Lease shall remain in full force and effect.

  • Condition of Leased Property Tenant acknowledges receipt and delivery of possession of the Leased Property and Tenant accepts the Leased Property in its “as is” condition, subject to the rights of parties in possession, the existing state of title, including all covenants, conditions, restrictions, reservations, mineral leases, easements and other matters of record or that are visible or apparent on the Leased Property, all applicable Legal Requirements, the lien of any financing instruments, mortgages and deeds of trust existing prior to the Commencement Date or permitted by the terms of this Agreement, and such other matters which would be disclosed by an inspection of the Leased Property and the record title thereto or by an accurate survey thereof. TENANT REPRESENTS THAT IT HAS INSPECTED THE LEASED PROPERTY AND ALL OF THE FOREGOING AND HAS FOUND THE CONDITION THEREOF SATISFACTORY AND IS NOT RELYING ON ANY REPRESENTATION OR WARRANTY OF LANDLORD OR LANDLORD’S AGENTS OR EMPLOYEES WITH RESPECT THERETO AND TENANT WAIVES ANY CLAIM OR ACTION AGAINST LANDLORD IN RESPECT OF THE CONDITION OF THE LEASED PROPERTY. LANDLORD MAKES NO WARRANTY OR REPRESENTATION, EXPRESS OR IMPLIED, IN RESPECT OF THE LEASED PROPERTY OR ANY PART THEREOF, EITHER AS TO ITS FITNESS FOR USE, DESIGN OR CONDITION FOR ANY PARTICULAR USE OR PURPOSE OR OTHERWISE, AS TO THE QUALITY OF THE MATERIAL OR WORKMANSHIP THEREIN, LATENT OR PATENT, IT BEING AGREED THAT ALL SUCH RISKS ARE TO BE BORNE BY TENANT. To the maximum extent permitted by law, however, Landlord hereby assigns to Tenant all of Landlord’s rights to proceed against any predecessor in interest or insurer for breaches of warranties or representations or for latent defects in the Leased Property. Landlord shall fully cooperate with Tenant in the prosecution of any such claims, in Landlord’s or Tenant’s name, all at Tenant’s sole cost and expense. Tenant shall indemnify, defend, and hold harmless Landlord from and against any loss, cost, damage or liability (including reasonable attorneys’ fees) incurred by Landlord in connection with such cooperation.

  • Parking Area Developer shall provide a parking area for ADOT for at least 100 vehicles 27 (85 staff/15 visitors). The parking area must be reasonably level (all-weather surface and 28 all-weather access). The parking area must include an additional lockable fenced 29 parking area to accommodate 25 ADOT vehicles.
