RULES FOR HABITUALLY DELINQUENT CONTRIBUTING EMPLOYERS. The JTB and its designated Agent shall have the authority to adopt special rules for habitually delinquent Contributing Employers. These rules may include, but are not limited to, requiring the habitually delinquent Contributing Employer to provide a cash or surety bond in favor of the Entities to ensure timely Payment, or to remit Payments on a weekly basis or twice monthly, as determined by the JTB. The determination of whether a particular Contributing Employer is habitually delinquent is within the sole discretion of the JTB or its designated Agent.
