Common use of SAFETY OF PERSONS AND PROPERTY Clause in Contracts

SAFETY OF PERSONS AND PROPERTY. A. The CONTRACTOR shall take all reasonable precautions for the safety of and shall provide all reasonable protection to prevent damage, injury or loss to: 1. All employees, workmen or craftsmen on the Work and all other persons who may be affected thereby with attention to OSHA Sections 1926-C and 1926-E; 2. All the Work and all materials and equipment to be incorporated therein, whether in storage on or off the site, under the care, custody or control of the CONTRACTOR or any of his Subcontractors or Sub-subcontractors; and 3. Other property at the site or adjacent thereto, including trees, shrubs, lawns, walks, pavements, roadways, structures and utilities not designated for removal, relocation or replacement in the course of construction. B. The CONTRACTOR shall give all notices and comply with all applicable laws, ordinances, rules, regulations, and lawful orders of any public authority bearing on the safety of persons or property or their protection from damage, injury or loss. C. The CONTRACTOR shall erect and maintain, as required by existing conditions and progress of the Work, all reasonable safeguards for safety and protection, including posting danger signs and other warnings against hazards, promulgating safety regulations and notifying OWNERs and users of adjacent utilities. D. The CONTRACTOR shall take all reasonable steps to maintain access for all residences and businesses in conformance with Section 102-2.4 of the F.D.O.T. Specifications. E. When the use or storage of explosives or other hazardous materials or equipment is necessary for the execution of the Work, the CONTRACTOR shall exercise the utmost care and shall carry on such activities under the supervision of properly qualified personnel. F. The CONTRACTOR shall promptly remedy all damage or loss (other than damage or loss insured under Article 12 to any property referred to in Paragraphs (2) and (3) of Subsection 11.02 caused in whole or in part by the CONTRACTOR, any Subcontractor, any Sub-subcontractor, or anyone directly or indirectly employed by any of them or by anyone for whose acts any of them may be liable and for which the CONTRACTOR is responsible under Paragraphs (2) and (3) of Subsection 11.02, except damage or loss attributable to the acts or omissions of the OWNER, or anyone directly employed by OWNER and not attributable in any part to the fault or negligence of the CONTRACTOR. The foregoing obligations of the CONTRACTOR are in addition to his obligations under Subsection 8.13. G. The CONTRACTOR shall designate an individual at the site whose duty shall be the prevention of accidents. This person shall be communicated to the OWNER prior to the commencement of the work. H. The CONTRACTOR shall not load or permit any part of the Work to be loaded so as to endanger its safety. I. The performance of services pursuant to this Subsection 11.02 by the CONTRACTOR shall not relieve the subcontractors, suppliers, material men, or anyone furnishing goods and services to the job site of their responsibilities for the safety of persons and property, and for compliance with all federal, state, and local statutes, rules, regulations, and orders applicable to the conduct of the Work.

C. 10.2.3 The CONTRACTOR Contractor shall erect and maintain, as required by existing conditions and the progress of the Work, all reasonable safeguards for safety and protection, including posting danger signs and other warnings against hazards, promulgating safety regulations and notifying OWNERs County’s and users of adjacent utilitiesfacilities. D. The CONTRACTOR shall take all reasonable steps to maintain access for all residences and businesses in conformance with Section 102-2.4 of the F.D.O.T. Specifications. E. 10.2.4 When the use or storage of explosives or other hazardous materials or equipment is necessary for the execution of the Work, the CONTRACTOR Contractor shall exercise the utmost reasonable care and shall carry on such activities under the supervision of properly qualified personnel. F. 10.2.5 The CONTRACTOR Contractor shall promptly remedy all damage or loss (other than damage or loss insured under Article 12 to any property referred to in Paragraphs (2) Clauses 10.2.1.2. and (3) of Subsection 11.02 10.2.1.3 caused in whole or in part by the CONTRACTORContractor, any Subcontractor, any Sub-subcontractor, or anyone directly or indirectly employed by any of them them, or by anyone any one for whose acts any of them may be liable liable, and for which the CONTRACTOR Contractor is responsible under Paragraphs (2) Clauses 10.2.1.2 and (3) of Subsection 11.0210.2.1.3, except damage or loss attributable to the acts or omissions of the OWNERCounty, the Project Manager, or anyone directly or indirectly employed by OWNER any of them, or by anyone for whose acts any of them may be liable, and not attributable in any part to the fault or negligence of the CONTRACTORContractor. The foregoing obligations of the CONTRACTOR Contractor are in addition to his the Contractor's obligations under Subsection 8.13Paragraph 4.17. G. 10.2.6 The CONTRACTOR Contractor shall designate an individual a responsible member of the Contractor's organization at the site whose duty shall be the prevention of accidents. This person shall be communicated the Contractor's superintendent unless otherwise designated by the Contractor in writing to the OWNER prior to County and the commencement of the workProject Manager. H. 10.2.7 The CONTRACTOR Contractor shall not load or permit any part of the Work to be loaded so as to endanger its safety. I. D. The CONTRACTOR shall take all reasonable steps to maintain access for all residences and businesses in conformance with Section 102-2.4 of the F.D.O.T. Specifications. E. 10.2.4 When the use or storage of explosives or other hazardous materials or equipment is or unusual methods are necessary for the execution of the Work, the CONTRACTOR Contractor shall exercise the utmost care and shall carry on such activities under the supervision of properly qualified personnel. F. 10.2.5 The CONTRACTOR Contractor shall promptly remedy all damage or loss (other than damage or loss insured under Article 12 property insurance required by the Contract Documents) to any property referred to in Paragraphs (2) Subparagraphs 10.2.1.2 and (3) of Subsection 11.02 10.2.1.3 caused in whole or in part by the CONTRACTORContractor, any Subcontractor, any Sub-subcontractorSubcontractor, or anyone directly or indirectly employed by any of them them, or by anyone for whose acts any of them they may be liable and for which the CONTRACTOR Contractor is responsible under Paragraphs (2) Subparagraphs 10.2.1.2 and (3) of Subsection 11.0210.2.1.3, except damage or loss attributable to the acts or omissions of the OWNER, Owner or Architect or anyone directly or indirectly employed by OWNER either of them, or by anyone for whose acts either of them may be liable, and not attributable in any part to the fault or negligence of the CONTRACTORContractor. The foregoing obligations of the CONTRACTOR Contractor are in addition to his the Contractor's obligations under Subsection 8.13Section 3.18. G. 10.2.6 The CONTRACTOR Contractor shall designate an individual a responsible member of the Contractor's organization at the site whose duty shall be the prevention of accidents. This person shall be communicated the Contractor's superintendent unless otherwise designated by the Contractor in writing to the OWNER prior to the commencement of the workOwner and Architect. H. 10.2.7 The CONTRACTOR Contractor shall not load or permit any part of the Work construction or site to be loaded so as to endanger its safety. I. 10.2.8 The performance of services pursuant to this Subsection 11.02 by Contractor shall comply with Owner's applicable policies as well as the CONTRACTOR shall not relieve the subcontractors, suppliers, material men, or anyone furnishing goods and services to the job site of their responsibilities for the safety of persons and property, and for compliance with all federal, state, and local statutes, rules, regulations, and orders applicable to the conduct of the WorkContract Documents.

The CONTRACTOR 9.1 Contractor shall take all reasonable precautions for the safety of of, and shall provide all reasonable protection to prevent damage, injury or loss to: 1. 9.1.1 All employees, workmen employees and its Subcontractors and their employees on the Project or craftsmen on performing the Work and all other persons who may be affected thereby with attention to OSHA Sections 1926-C and 1926-Ethereby; 2. 9.1.2 All the Work and all materials and equipment to be incorporated therein, whether in storage on or off the site, Site under the care, custody or control of the CONTRACTOR Contractor or any of his Subcontractors or Sub-subcontractorsits Subcontractors; and 3. 9.1.3 Other property at the site Site or adjacent thereto, including trees, shrubs, lawns, walks, utilities, pavements, roadways, structures and utilities not designated for removal, relocation or replacement in the course of constructionetc. B. The CONTRACTOR 9.2 Contractor shall give all notices and shall comply with all applicable laws, ordinances, rules, regulations, and lawful orders of any public authority Applicable Laws bearing on the safety of persons or property or their protection from damage, injury or loss. Specifically but without limitation, Contractor and its Subcontractors shall thoroughly familiarize themselves with all requirements of Public Law 91-956 enacted by Congress, December 29, 1970, cited as the "Occupational Safety and Health Act of 1970", and all amendments thereto, commonly referred to as OSHA, and Contractor shall have the responsibility to fully enforce and comply with all provisions of this Act. C. The CONTRACTOR 9.3 Contractor shall erect and maintain, as required by existing conditions and the progress of the Work, all reasonable safeguards for safety and protectionprotection of the Work, including posting danger signs and other warnings against hazards, promulgating safety regulations and notifying OWNERs CES and users Customer of adjacent utilities. D. The CONTRACTOR shall take all reasonable steps to maintain access for all residences and businesses in conformance with Section 102-2.4 of the F.D.O.T. Specifications. E. When the use or storage of explosives or other hazardous materials or equipment is necessary for the execution of the Work, the CONTRACTOR shall exercise the utmost care and shall carry on such activities under the supervision of properly qualified personnel. F. The CONTRACTOR 9.4 Contractor shall promptly remedy all damage or loss (other than damage or loss insured under Article 12 to any property referred to in Paragraphs (2) and (3) of Subsection 11.02 caused in whole or in part by the CONTRACTOR, any Subcontractor, any Sub-subcontractor, Contractor or anyone directly or indirectly employed by any of them or by anyone for whose acts any of them may be liable and for which the CONTRACTOR is responsible under Paragraphs (2) and (3) of Subsection 11.02its Subcontractors, except such damage or loss attributable to the negligent acts or omissions of the OWNERCES, Customer, or anyone directly employed by OWNER and not attributable in any part to the fault or negligence of the CONTRACTOR. The foregoing obligations of the CONTRACTOR others for whom they are in addition to his obligations under Subsection 8.13responsible. G. The CONTRACTOR 9.5 In any emergency affecting the safety of persons or property, Contractor shall reasonably act to prevent threatened damage, injury or loss. 9.6 Contractor shall exercise appropriate, reasonable care in carrying out any Work involving explosive or other dangerous methods of construction or hazardous procedures, materials or equipment. Contractor shall use properly qualified individuals to carry out such Work in a safe and reasonable manner so as to reduce the risk of damage, injury or loss. 9.7 Contractor shall designate an individual employee at the site whose Site who shall act as Contractor's designated safety representative with a duty to prevent accidents. Unless otherwise identified in writing, the designated safety representative shall be the prevention of accidents. This person Contractor's project superintendent. 9.8 Contractor shall be communicated not overload the structures or conditions at the Site and shall take reasonable steps not to the OWNER prior to the commencement load any part of the workstructures or Site so as to give rise to an unsafe condition or create an unreasonable risk of damage, injury or loss. Contractor may submit a written request to CES or Customer for loading information concerning the structures at the Site. H. The CONTRACTOR 9.9 Contractor shall give prompt written notice to CES of any accident involving personal injury requiring a physician's care, any property damage exceeding five hundred dollars ($500.00) in value, or any accident or failure that could have resulted in serious personal injury, whether or not load such an injury was sustained. 9.10 Contractor shall establish its own written safety program implementing safety measures, policies and standards conforming to those required or permit recommended by governmental and quasi-governmental authorities having jurisdiction, and by CES and Customer, including, but not limited to, requirements imposed by the Contract Documents and the Customer Agreement. Contractor shall comply with the reasonable recommendations of insurance companies having an interest in the Project, and shall stop any part of the Work which CES deems unsafe until corrective measures satisfactory to be loaded so as CES shall have been taken. CES' failure to endanger its safety. I. The performance of services pursuant to this Subsection 11.02 by the CONTRACTOR stop Contractor's unsafe practices shall not relieve Contractor of the subcontractors, suppliers, material men, responsibility therefor. Contractor shall notify CES immediately following an accident and shall promptly confirm the notice in writing. A detailed written report shall be furnished if requested by CES. Contractor shall indemnify CES and Customer for fines or anyone furnishing goods penalties imposed on CES or Customer as a result of a safety violation by Contractor. 9.11 Material Safety Data (MSD) sheets as required by law and services pertaining to materials or substances used or consumed in the job site performance of their responsibilities for the safety Work shall be submitted to CES by Contractor. MSD sheets obtained by CES from other contractors or sources shall be made available to Contractor. 9.12 Use and handling of persons and property, and for Hazardous Substances by Contractor shall be in compliance with all federal, state, and local statutes, rules, regulations, and orders applicable to the conduct of the WorkApplicable Laws.

The CONTRACTOR Contractor shall promptly remedy all damage or loss (other than damage or loss insured under Article 12 Paragraph 13.03) to any property referred to in Paragraphs Subparagraphs (2b) and (3c) of Subsection 11.02 Paragraph 12.02 caused in whole or in part by the CONTRACTORContractor, any Subcontractor, any Sub-subcontractor, or anyone directly or indirectly employed by any of them or by anyone for whose acts any of them may be liable and for which the CONTRACTOR contractor is responsible under Paragraphs Subparagraphs (2b) and (3c) of Subsection 11.02Paragraph 12.02, except damage or loss attributable to the acts or omissions of the OWNEROwner, or anyone directly employed by OWNER Owner and not attributable in any part to the fault or negligence of the CONTRACTORContractor. The foregoing obligations of the CONTRACTOR Contractor are in addition to his obligations under Subsection Paragraph 8.13. G. 7. The CONTRACTOR Contractor shall designate an individual a responsible member of his organization at the site whose duty shall be the prevention of accidents. This person shall be communicated designated by the Contractor in writing to the OWNER Owner prior to the commencement of the work. H. 8. The CONTRACTOR Contractor shall not load or permit any part of the Work to be loaded so as to endanger its safety. I. 9. The performance of services pursuant to this Subsection 11.02 Paragraph 12.02 by the CONTRACTOR Contractor shall not relieve the subcontractors, suppliers, material men, or anyone furnishing goods and services to the job site of their responsibilities for the safety of persons and property, and for compliance with all federal, state, and local statutes, rules, regulations, and orders applicable to the conduct of the Work.

All the IDB Work and all materials and equipment to be incorporated therein, whether in storage on or off the site, under the care, custody or control of Xxxxxxx or the CONTRACTOR Consultants or any of his Subcontractors Contractors, or Sub-subcontractorsother person or entity providing services or work for Xxxxxxx; and 3iii. Other other property at the site or adjacent thereto, including such as trees, shrubs, lawns, walks, pavements, roadways, or structures and utilities not designated for removal, relocation or replacement in the course of construction. B. The CONTRACTOR .2 Xxxxxxx shall comply with, and give all notices and comply with all required by, applicable laws, statutes, ordinances, rulescodes, rules and regulations, and lawful orders of any public authority authorities, bearing on the safety of persons or property property, or their protection from damage, injury or loss. C. The CONTRACTOR .3 Xxxxxxx shall erect implement, erect, and maintain, as required by existing conditions and progress performance of the WorkContract, all reasonable safeguards for safety and protection, including posting danger signs and other warnings against hazards, promulgating safety regulations regulations, and notifying OWNERs notify owners and users of adjacent utilitiessites and utilities of the safeguards and protections. D. The CONTRACTOR shall take all reasonable steps to maintain access for all residences and businesses in conformance with Section 102-2.4 of the F.D.O.T. Specifications. E. .4 When the use or storage of explosives or other hazardous materials or equipment is equipment, or unusual methods, are necessary for the execution of the IDB Work, the CONTRACTOR Xxxxxxx shall exercise the utmost care care, and shall carry on such activities under the supervision of properly qualified personnel. F. The CONTRACTOR .5 Xxxxxxx shall promptly remedy all damage or and loss (other than damage or loss insured under Article 12 property insurance required by the Industrial Design-Build Documents) to any property referred to in Paragraphs (2) Sections 10.2.1.2 and (3) of Subsection 11.02 10.2.1.3, caused in whole or in part by the CONTRACTORXxxxxxx, any Subcontractorits architects, any Sub-subcontractorConsultants, contractors, or anyone directly or indirectly employed by any of them them, or by anyone for whose acts any of them they may be liable and for which the CONTRACTOR Xxxxxxx is responsible under Paragraphs (2Sections 13.2.1(ii) and (3) of Subsection 11.02, 13.2.1(iii); except damage or loss attributable to the acts or omissions of the OWNEROwner, or anyone directly or indirectly employed by OWNER the Owner, or by anyone for whose acts the Owner may be liable, and not attributable in any part to the fault or negligence of the CONTRACTORXxxxxxx. The foregoing obligations of the CONTRACTOR Xxxxxxx are in addition to his Xxxxxxx’x obligations under Subsection 8.13Section 8.2. G. The CONTRACTOR .6 Xxxxxxx shall designate an individual a responsible member of Xxxxxxx’x organization, at the site site, whose duty shall be the prevention of accidents. This person shall be communicated Xxxxxxx’x superintendent unless otherwise designated by Xxxxxxx in writing to the OWNER prior to the commencement of the workOwner. H. The CONTRACTOR .7 Xxxxxxx shall not load or permit cause any part of the Work construction or site to be loaded so as to endanger its safetycause damage or create an unsafe condition. I. The performance of services pursuant to this Subsection 11.02 by the CONTRACTOR shall not relieve the subcontractors, suppliers, material men, or anyone furnishing goods and services to the job site of their responsibilities for the safety of persons and property, and for compliance with all federal, state, and local statutes, rules, regulations, and orders applicable to the conduct of the Work.

SAFETY OF PERSONS AND PROPERTY. A. 10.2.1 The CONTRACTOR Contractor shall take all reasonable precautions for the safety of of, and shall provide all reasonable protection to prevent damage, injury injury, or loss to: 1. All employees, workmen or craftsmen .1 employees on the Work and all other persons who may be affected thereby with attention to OSHA Sections 1926-C and 1926-Ethereby; 2. All .2 the Work and all materials and equipment to be incorporated therein, whether in storage on or off the site, under the care, custody custody, or control of the CONTRACTOR Contractor or any of his the Contractor’s Subcontractors or Sub-subcontractors; and 3. Other .3 other property at the site or adjacent thereto, including such as trees, shrubs, lawns, walks, pavements, roadways, structures structures, and utilities not designated for removal, relocation relocation, or replacement in the course of construction. B. 10.2.2 The CONTRACTOR Contractor shall give all notices and comply with all applicable laws, ordinances, rules, regulations, and lawful orders of any public authority authorities bearing on the safety of persons or property or their protection from damage, injury injury, or loss. C. 10.2.3 The CONTRACTOR Contractor shall erect and maintain, as required by existing conditions and progress performance of the WorkContract, all reasonable safeguards for safety and protection, including posting danger signs and other warnings against hazards, promulgating safety regulations regulations, and notifying OWNERs owners and users of adjacent sites and utilities. D. The CONTRACTOR shall take all reasonable steps to maintain access for all residences and businesses in conformance with Section 102-2.4 of the F.D.O.T. Specifications. E. 10.2.4 When the use or storage of explosives or other hazardous materials or equipment is or unusual methods are necessary for the execution of the Work, the CONTRACTOR Contractor shall exercise the utmost care and shall carry on such activities under the supervision of properly qualified personnel. F. 10.2.5 The CONTRACTOR Contractor shall promptly remedy all damage or and loss (other than damage or loss insured under Article 12 property insurance required by the Contract Documents) to any property referred to in Paragraphs (2) Clauses 10.2.1.2 and (3) of Subsection 11.02 10.2.1.3 caused in whole or in part by the CONTRACTORContractor, any a Subcontractor, any a Sub-subcontractor, or anyone directly or indirectly employed by any of them them, or by anyone for whose acts any of them they may be liable and for which the CONTRACTOR Contractor is responsible under Paragraphs (2) Clauses 10.2.1.2 and (3) of Subsection 11.0210.2.1.3, except damage or loss attributable to the acts or omissions of the OWNER, Owner or Architect or anyone directly or indirectly employed by OWNER either of them, or by anyone for whose acts either of them may be liable, and not attributable in any part to the fault or negligence of the CONTRACTORContractor. The foregoing obligations of the CONTRACTOR Contractor are in addition to his the Contractor’s obligations under Subsection 8.13Paragraph 3.18. G. 10.2.6 The CONTRACTOR Contractor shall designate an individual a responsible member of the Contractor’s organization at the site whose duty shall be the prevention of accidents. This person shall be communicated the Contractor’s superintendent unless otherwise designated by the Contractor in writing to the OWNER prior to the commencement of the workOwner and Architect. H. 10.2.7 The CONTRACTOR Contractor shall not load or permit any part of the Work construction or site to be loaded so as to endanger its safety. I. The performance of services pursuant to this Subsection 11.02 by the CONTRACTOR shall not relieve the subcontractors, suppliers, material men, or anyone furnishing goods and services to the job site of their responsibilities for the safety of persons and property, and for compliance with all federal, state, and local statutes, rules, regulations, and orders applicable to the conduct of the Work.

SAFETY OF PERSONS AND PROPERTY. A. 10.2.1 The CONTRACTOR Contractor shall take all reasonable precautions for the safety of of, and shall provide all reasonable protection to prevent damage, injury or loss to: 1. All employees, workmen employees and subcontractors and subcontractors and their employees of the Project or craftsmen on performing the Work and all other persons who may be affected thereby with attention to OSHA Sections 1926-C and 1926-Ethereby; 2. All the Work and all materials and equipment to be incorporated therein, whether in storage on or off the site, under the care, custody or control of the CONTRACTOR Contractor or any of his Subcontractors or Subsub-subcontractors; and 3. Other property at the site or adjacent thereto, including trees, shrubs, lawns, walks, pavements, roadways, structures and utilities not designated for removal, relocation or replacement in the course of construction. B. 10.2.2 The CONTRACTOR Contractor shall give all notices and comply with all applicable laws, ordinancesordinances , rules, regulations, rules regulations and lawful orders of any public authority bearing on the safety of persons or property or their protection from damage, injury or loss. Specifically but without limitation, Contractor and all of his Subcontractors shall thoroughly familiarize themselves with all requirements of Public Law 91-956 enacted by Congress, December 29, 1970, cited as the "Occupational Safety and Health Act of 1970", and all amendments thereto, commonly referred to as OSHA, and it shall be the responsibility of the Contractor to fully enforce and comply with all of the provisions of this Act. C. 10.2.3 The CONTRACTOR Contractor shall erect and maintain, as required by existing conditions and progress of the Work, all reasonable safeguards for safety and protection, including posting danger signs and other warnings against hazards, promulgating safety regulations and notifying OWNERs owners and users of adjacent utilities. D. The CONTRACTOR shall take all reasonable steps to maintain access for all residences and businesses in conformance with Section 102-2.4 of the F.D.O.T. Specifications. E. 10.2.4 When the use or storage of explosives or other hazardous materials or equipment is necessary for the execution of the Work, the CONTRACTOR Contractor shall exercise the utmost care and shall carry on such activities under the supervision of properly qualified personnel. F. 10.2.5 The CONTRACTOR Contractor shall promptly remedy all damage or loss (other than damage or loss insured under Article 12 to any property referred to in Paragraphs (2) and (3) of Subsection 11.02 this Paragraph 10.2 caused in whole or in part by the CONTRACTORContractor, any Subcontractor, any Sub-subcontractor, or anyone directly or indirectly employed by any of them them, or by anyone for whose acts any of them may be liable and for which the CONTRACTOR Contractor is responsible under Paragraphs (2) and (3) of Subsection 11.02Paragraph 10.2.1, except damage or loss attributable solely to the negligent acts or omissions of the OWNER, Owner or Architect or anyone directly or indirectly employed by OWNER and not attributable in any part to the fault either of them, or negligence by anyone for whose acts either of the CONTRACTORthem may be liable. The foregoing obligations of the CONTRACTOR Contractor are in addition to his obligations under Subsection 8.13Paragraph 4.1.6. G. 10.2.6 The CONTRACTOR Contractor shall designate an individual a responsible member of his organization at the site whose duty shall be the prevention of accidents. This person shall be communicated the Contractor's superintendent unless otherwise designated by the Contractor in writing to the OWNER prior to Owner and the commencement of the workArchitect. H. 10.2.7 The CONTRACTOR Contractor shall not load or permit any part of the Work to be loaded so as to endanger its safety. I. The performance of services pursuant to this Subsection 11.02 by the CONTRACTOR shall not relieve the subcontractors, suppliers, material men, or anyone furnishing goods and services to the job site of their responsibilities for the safety of persons and property, and for compliance with all federal, state, and local statutes, rules, regulations, and orders applicable to the conduct of the Work.

SAFETY OF PERSONS AND PROPERTY. A. The CONTRACTOR 10.2.1 Contractor shall take all reasonable precautions for the safety of of, and shall provide all reasonable protection to prevent damage, injury or loss to: 1. All employees, workmen or craftsmen (i) Employees on the Work and all other persons who may be affected thereby with attention to OSHA Sections 1926-C and 1926-Ethereby; 2. All the (ii) The Work and all materials and equipment to be incorporated therein, whether in storage on or off the job site, under the care, custody or control of the CONTRACTOR Contractor or any of his Subcontractors Contractor’s subcontractors or Sublower-tier subcontractors; and 3. (iii) Other property at the job site or adjacent thereto, including such as trees, shrubs, lawns, walks, pavements, roadways, structures and utilities not designated for removal, relocation or replacement in the course of construction. B. The CONTRACTOR 10.2.2 Contractor shall give all notices and comply with all and give notices required by applicable laws, statutes, ordinances, rulescodes, rules and regulations, and lawful orders of any public authority authorities bearing on the safety of persons or property or their protection from damage, injury or loss. Contractor shall give written notice to Owner of any injury to persons and/or damage to property occurring on the job site within forty-eight (48) hours from discovery or notice of the injury or damage. C. The CONTRACTOR 10.2.3 Contractor shall erect and maintain, as required by existing conditions and progress of the Work, all reasonable safeguards for safety and protection, including posting danger signs and other warnings against hazards, promulgating safety regulations and notifying OWNERs owners and users of adjacent sites and utilities. D. The CONTRACTOR shall take all reasonable steps to maintain access for all residences and businesses in conformance with Section 102-2.4 of the F.D.O.T. Specifications. E. 10.2.4 When the use or storage of explosives or other hazardous materials or equipment is or unusual methods are necessary for the execution of the Work, the CONTRACTOR Contractor shall exercise the utmost care and shall carry on such activities under the supervision of properly qualified personnel. F. The CONTRACTOR 10.2.5 Contractor shall promptly remedy all damage or and loss (other than damage or loss insured under Article 12 property insurance required by the Contract Documents) to any property referred to in Paragraphs (2) and (3) of Subsection 11.02 Articles 10.2.1 caused in whole or in part by the CONTRACTORContractor, any Subcontractora subcontractor, any Suba lower-tier subcontractor, or anyone directly or indirectly employed by any of them, or by anyone for whose acts they may be liable and for which Contractor is responsible, except damage or loss solely attributable to acts or omissions of Owner or Architect or anyone directly employed by either of them and not attributable to the fault or negligence of Contractor or its subcontractors of any tier. The foregoing obligations of Contractor are in addition to, and shall in any way modify or limit, Contractor’s obligations under Article 3.19. 10.2.6 Contractor shall designate a responsible member of Contractor’s organization at the job site whose duty shall be the prevention of accidents. This person shall be Contractor’s superintendent unless otherwise designated by Contractor in writing to the Project Manager. 10.2.7 Contractor shall not permit any part of the construction or job site to be loaded so as to cause damage or create an unsafe condition. 10.2.8 Contractor shall secure the Work and materials and equipment to be incorporated thereon, whether in storage on or off-site, under care, custody or control of Contractor or any subcontractors, against theft or damage by anyone directly or indirectly employed by Contractor or anyone for whose acts Contractor may be liable, including those persons under the control of any subcontractor. 10.2.9 Contractor shall protect adjoining private or municipal property and provide barricades, temporary fences, and covered walkways required to protect the safety of passers-by, as required by prudent construction practices, local building codes, ordinances or other laws, or the Contract Documents. 10.2.10 Contractor shall secure the Work and materials and equipment to be incorporated thereon, whether in storage on or off-site, under care, custody or control of Contractor or any subcontractors, against theft or damage by anyone directly or indirectly employed by Contractor or anyone for whose acts Contractor may be liable, including those persons under the control of any subcontractor. 10.2.11 In addition to its other obligations set forth in Article 10, Contractor shall, at its sole cost and expense, promptly repair any damage or disturbance to walls, utilities, sidewalks, curbs and the property of third parties (including municipalities) resulting from Contractor’s operations in Contractor’s performance of the Work, whether by it or by its lower tier subcontractors or anyone directly or indirectly employed by any of them, or by anyone for whose acts any of them may be liable and for which the CONTRACTOR Contractor is responsible under Paragraphs (2) and (3) of Subsection 11.02, except damage or loss attributable to the acts or omissions of the OWNER, or anyone directly employed by OWNER and not attributable responsible. Contractor shall maintain streets in any part to the fault or negligence of the CONTRACTOR. The foregoing obligations of the CONTRACTOR are in addition to his obligations under Subsection 8.13good repair. G. The CONTRACTOR shall designate an individual at the site whose duty shall be the prevention of accidents. This person shall be communicated to the OWNER prior to the commencement of the work. H. The CONTRACTOR shall not load or permit any part of the Work to be loaded so as to endanger its safety. I. The performance of services pursuant to this Subsection 11.02 by the CONTRACTOR shall not relieve the subcontractors, suppliers, material men, or anyone furnishing goods and services to the job site of their responsibilities for the safety of persons and property, and for compliance with all federal, state, and local statutes, rules, regulations, and orders applicable to the conduct of the Work.

SAFETY OF PERSONS AND PROPERTY. Other .3 other property at the site or adjacent thereto, including treessuch as frees, shrubs, lawns, walks, pavements, roadways, structures and utilities not designated for removal, relocation or replacement in the course of construction. B. 10.2.2 The CONTRACTOR Contractor shall give all notices and comply with all applicable laws, ordinances, rules, regulations, regulations and lawful orders of any public authority authorities bearing on the safety of persons or property or their protection from damage, injury or loss.. Genera I Conditions C. 10.2.3 The CONTRACTOR Contractor shall erect and maintain, as required by existing conditions and progress performance of the WorkContract, all reasonable safeguards for safety and protection, including posting danger signs and other warnings against hazards, promulgating safety regulations and notifying OWNERs owners and users of adjacent sites and utilities. D. The CONTRACTOR shall take all reasonable steps to maintain access for all residences and businesses in conformance with Section 102-2.4 of the F.D.O.T. Specifications. E. 10.2.4 When the use or storage of explosives explosive or other hazardous materials or equipment is necessary for the execution of the Workor unusual methods are necessary, the CONTRACTOR Contractor shall give the Owner ten (10) days' notice in advance of such use, storage or unusual methods. All hazardous or toxic materials used or stored at the Project site shall be used, stored, transported and disposed of in strict conformity with applicable laws, codes, rules, regulations and orders of governmental authorities having jurisdiction. The Contractor shall exercise the utmost care and shall carry on such activities under the supervision of properly qualified personnel. F. 10.2.5 The CONTRACTOR Contractor shall promptly remedy all be liable for any damage or and loss (other than damage or loss insured under Article 12 property insurance required by the Contract Documents) to any property referred to in Paragraphs (2) Clauses 10.2.1.2 and (3) of Subsection 11.02 10.2.1.3 caused in whole or in part by the CONTRACTORContractor, any a Subcontractor, any a Sub-subcontractor, or anyone directly or indirectly employed by any of them them, or by anyone for whose acts any of them they may be liable and for which the CONTRACTOR Contractor is responsible under Paragraphs (2) Clauses 10.2.1.2 and (3) of Subsection 11.0210.2.1.3, except damage or loss attributable to the acts or omissions of the OWNER, Owner or Architect or anyone directly or indirectly employed by OWNER either of them, or by anyone for whose acts either of them may be liable, and not attributable in any part to the fault or negligence of the CONTRACTORContractor. The foregoing obligations of the CONTRACTOR Contractor are in addition to his the Contractor's obligations under Subsection 8.13Paragraph 3.18. G. The CONTRACTOR shall designate an individual at the site whose duty shall be the prevention of accidents. This person shall be communicated to the OWNER prior to the commencement of the work. H. The CONTRACTOR shall not load or permit any part of the Work to be loaded so as to endanger its safety. I. The performance of services pursuant to this Subsection 11.02 by the CONTRACTOR shall not relieve the subcontractors, suppliers, material men, or anyone furnishing goods and services to the job site of their responsibilities for the safety of persons and property, and for compliance with all federal, state, and local statutes, rules, regulations, and orders applicable to the conduct of the Work.

SAFETY OF PERSONS AND PROPERTY. Other and .3 other property at the site or adjacent thereto, including such as trees, shrubs, lawns, walks, pavements, roadways, structures structures, and utilities not designated for removal, relocation relocation, or replacement in the course of construction. B. 10.2.2 The CONTRACTOR Contractor shall give all notices and comply with all applicable laws, ordinances, rules, regulations, and lawful orders of any public authority authorities bearing on the safety of persons or property or their protection from damage, injury injury, or loss. C. 10.2.3 The CONTRACTOR Contractor shall erect and maintain, as required by existing conditions and progress performance of the WorkContract, all reasonable safeguards for safety and protection, including including, but not limited to, posting danger signs and other warnings against hazards, promulgating safety regulations regulations, and notifying OWNERs owners and users of adjacent sites and utilities. D. The CONTRACTOR shall take all reasonable steps to maintain access for all residences and businesses in conformance with Section 102-2.4 of the F.D.O.T. Specifications. E. 10.2.4 When the use or storage of explosives or other hazardous materials or equipment is or unusual methods are necessary for the execution of the Work, the CONTRACTOR Contractor shall exercise the utmost highest degree of care and shall carry on such activities under the supervision of properly qualified personnel. F. 10.2.5 The CONTRACTOR Contractor shall promptly remedy all damage or and loss (other than damage or loss insured under Article 12 property insurance required by the Contract Documents) to any property referred to in Paragraphs (2) and (3) of Subsection 11.02 Article 10 caused in whole or in part by the CONTRACTORContractor, a Subcontractor of any Subcontractor, any Sub-subcontractortier, or anyone directly or indirectly employed by any of them them, or by anyone for whose acts any of them they may be liable liable, and for which the CONTRACTOR Contractor is responsible under Paragraphs (2) and (3) of Subsection 11.02Article 10, except damage or loss attributable solely to the acts or omissions of Owner or the OWNER, Engineer or anyone directly or indirectly employed by OWNER and not attributable in any part to the fault or negligence either of the CONTRACTOR. The foregoing obligations of the CONTRACTOR are in addition to his obligations under Subsection 8.13. G. The CONTRACTOR shall designate an individual at the site whose duty shall be the prevention of accidents. This person shall be communicated to the OWNER prior to the commencement of the work. H. The CONTRACTOR shall not load or permit any part of the Work to be loaded so as to endanger its safety. I. The performance of services pursuant to this Subsection 11.02 by the CONTRACTOR shall not relieve the subcontractorsthem, suppliers, material men, or anyone furnishing goods and services to the job site of their responsibilities for the safety of persons and property, and for compliance with all federal, state, and local statutes, rules, regulations, and orders applicable to the conduct of the Work.or

SAFETY OF PERSONS AND PROPERTY. A. 7.1.1 The CONTRACTOR Contractor shall initiate, maintain and supervise all safety precautions and programs in connection with the performance of the Work. 7.1.2 The Contractor shall take all reasonable precautions for the safety of and shall provide all reasonable protection to prevent damage, injury or loss to: 1. All employees, workmen or craftsmen on .1 Employees working under the Work Contract and all other persons who may be affected thereby with attention to OSHA Sections 1926-C and 1926-Ethereby; 2. All the .2 The Work and all materials and equipment to be incorporated therein, whether in storage on or off the Project site, under the care, custody or control of the CONTRACTOR Contractor or any of his the Contractor's Subcontractors or Sub-subcontractors; and 3. .3 Other property at the site Project site, or adjacent thereto, including such as trees, shrubs, lawns, walks, pavements, roadways, structures and utilities not designated for removalutilities, relocation except as otherwise noted or replacement in the course of constructionspecified. B. 7.1.3 The CONTRACTOR Contractor shall give all notices and comply with all applicable laws, ordinances, rules, regulations, regulations and lawful orders of any public authority authorities bearing on the safety of persons or property property, or their protection from damage, injury or loss. C. 7.1.4 The CONTRACTOR Contractor shall erect and maintain, as required by existing conditions and progress performance of the WorkContract, all reasonable safeguards for safety and protection, including posting danger signs and other warnings against hazards, promulgating safety regulations and notifying OWNERs the State, other owners and users of adjacent sites and utilities. D. 7.1.5 The CONTRACTOR Contractor shall take comply with all reasonable steps to maintain access for all residences applicable laws, ordinances, rules, regulations and businesses in conformance with Section 102-2.4 lawful orders of public authorities regarding the F.D.O.T. Specifications. E. When the storage and/or use or storage of explosives or other hazardous materials or equipment is necessary for execution of Work. The Contractor shall designate the execution Work Superintendent, or some other responsible member of the Contractor’s organization who is at the Site, to be the person responsible for the prevention of accidents and the monitoring of the safety of the Work, the CONTRACTOR shall exercise the utmost care and shall carry on such activities under the supervision of properly qualified personnel. F. 7.1.6 The CONTRACTOR Contractor shall promptly remedy all damage or and loss (other than damage or loss insured under Article 12 to any property referred to in Paragraphs (2) Clauses 7.1.2.2 and (3) of Subsection 11.02 10.1.2.3 caused in whole or in part by the CONTRACTORContractor, any a Subcontractor, any a Sub-subcontractor, or anyone directly or indirectly employed by any of them them, or by anyone for whose acts any of them they may be liable and for which the CONTRACTOR Contractor is responsible under Paragraphs (2) Clauses 7.1.2.2 and (3) of Subsection 11.02, except damage or loss attributable to the acts or omissions of the OWNER, or anyone directly employed by OWNER and not attributable in any part to the fault or negligence of the CONTRACTOR. The foregoing obligations of the CONTRACTOR are in addition to his obligations under Subsection 8.137.1.2. G. The CONTRACTOR shall designate an individual at the site whose duty shall be the prevention of accidents. This person shall be communicated to the OWNER prior to the commencement of the work. H. The CONTRACTOR shall not load or permit any part of the Work to be loaded so as to endanger its safety. I. The performance of services pursuant to this Subsection 11.02 by the CONTRACTOR shall not relieve the subcontractors, suppliers, material men, or anyone furnishing goods and services to the job site of their responsibilities for the safety of persons and property, and for compliance with all federal, state, and local statutes, rules, regulations, and orders applicable to the conduct of the Work.

SAFETY OF PERSONS AND PROPERTY. A. The CONTRACTOR 10.2.1 Precaution shall be exercised at all times for the protection of persons and property. Contractor shall have available at the Site, copies or suitable extracts of "Construction Safety Orders" and "General Industrial Safety Orders" issued by the State Division of Industrial Safety. Contractor shall comply with provisions of these and all other applicable laws, ordinances, and regulations. 10.2.2 Contractor shall immediately respond to notice from District of unsafe conditions, shall take all reasonable adequate precautions for the safety of persons on the Site, and shall provide all reasonable adequate protection to prevent damage, injury or loss toLoss to the following: 1. All employees, workmen or craftsmen on (i) Employees involved in the Work and all other persons who may be affected thereby with attention to OSHA Sections 1926-C thereby. (ii) The Work in place and 1926-E; 2. All the Work and all materials and equipment to be incorporated therein, whether in storage on or off the siteSite, under the care, custody custody, or control of Contractor, Subcontractors, or Sub-subcontractors. (iii) Other property at the CONTRACTOR Site and adjoining property(ies). 10.2.3 Contractor shall promptly remedy damage and Loss (other than damage or any of his Loss insured under property insurance required by the Contract Documents) to property caused in whole or in part by Contractor or its Subcontractors or Sub-subcontractors; and 3, of any Tier, or anyone for whose acts they may be liable and for which Contractor is responsible. B. The CONTRACTOR shall give all notices and comply with all applicable laws, ordinances, rules, regulations, and lawful orders of any public authority bearing on the safety of persons or property or their protection from damage, injury or loss. C. The CONTRACTOR 10.2.4 Contractor shall erect and maintain, as required by existing conditions and progress performance of the Work, all reasonable adequate safeguards for safety and protection, including providing adequate lighting and ventilation, posting danger signs and other warnings against hazards, promulgating safety regulations and notifying OWNERs owners and users of adjacent sites and utilities. D. The CONTRACTOR shall take all reasonable steps to maintain access for all residences and businesses in conformance with Section 102-2.4 of the F.D.O.T. Specifications. E. When the use or storage of explosives or other hazardous materials or equipment is necessary for the execution of the Work, the CONTRACTOR shall exercise the utmost care and shall carry on such activities under the supervision of properly qualified personnel. F. The CONTRACTOR shall promptly remedy all damage or loss (other than damage or loss insured under Article 12 to any property referred to in Paragraphs (2) and (3) of Subsection 11.02 caused in whole or in part by the CONTRACTOR, any Subcontractor, any Sub-subcontractor, or anyone directly or indirectly employed by any of them or by anyone for whose acts any of them may be liable and for which the CONTRACTOR is responsible under Paragraphs (2) and (3) of Subsection 11.02, except damage or loss attributable to the acts or omissions of the OWNER, or anyone directly employed by OWNER and not attributable in any part to the fault or negligence of the CONTRACTOR. The foregoing obligations of the CONTRACTOR are in addition to his obligations under Subsection 8.13. G. The CONTRACTOR shall designate an individual at the site whose duty shall be the prevention of accidents. This person shall be communicated to the OWNER prior to the commencement of the work. H. The CONTRACTOR shall not load or permit any part of the Work to be loaded so as to endanger its safety. I. The performance of services pursuant to this Subsection 11.02 by the CONTRACTOR shall not relieve the subcontractors, suppliers, material men, or anyone furnishing goods and services to the job site of their responsibilities for the safety of persons and property, and for compliance with all federal, state, and local statutes, rules, regulations, and orders applicable to the conduct of the Work.

SAFETY OF PERSONS AND PROPERTY. A. The CONTRACTOR Contractor shall take all reasonable precautions for the safety of and shall provide all reasonable protection to prevent damage, injury or loss to: 1. All all employees, workmen or craftsmen on the Work and all other persons who may be affected thereby with attention to OSHA Sections 1926-C and 1926-E; 2. All all the Work and all materials and equipment to be incorporated therein, whether in storage on or off the site, under the care, custody or control of the CONTRACTOR Contractor or any of his Subcontractors or Sub-subcontractors; and 3. Other other property at the site or adjacent thereto, including trees, shrubs, lawns, walks, pavements, roadways, structures and utilities not designated for removal, relocation or replacement in the course of construction. B. The CONTRACTOR Contractor shall give all notices and comply with all applicable laws, ordinances, rules, regulations, and lawful orders of any public authority bearing on the safety of persons or property or their protection from damage, injury or loss. C. The CONTRACTOR Contractor shall erect and maintain, as required by existing conditions and progress of the Work, all reasonable safeguards for safety and protection, including posting danger signs and other warnings against hazards, promulgating safety regulations and notifying OWNERs owners and users of adjacent utilities. D. The CONTRACTOR Contractor shall take all reasonable steps to maintain access for all residences and businesses in conformance with Section 102-2.4 5.5 of the F.D.O.T. FDOT Specifications. E. When the use or storage of explosives or other hazardous materials or equipment is necessary for the execution of the Work, the CONTRACTOR Contractor shall exercise the utmost care and shall carry on such activities under the supervision of properly qualified personnel. F. The CONTRACTOR Contractor shall promptly remedy all damage or loss (other than damage or loss insured under Article 12 to any property referred to in Paragraphs (2) and (3) of Subsection 11.02 caused in whole or in part by the CONTRACTORContractor, any Subcontractor, any Sub-subcontractor, or anyone directly or indirectly employed by any of them or by anyone for whose acts any of them may be liable and for which the CONTRACTOR Contractor is responsible under Paragraphs (2) and (3) of Subsection 11.02responsible, except damage or loss attributable to the acts or omissions of the OWNEROwner, or anyone directly employed by OWNER Owner and not attributable in any part to the fault or negligence of the CONTRACTOR. The foregoing obligations of the CONTRACTOR are in addition to his obligations under Subsection 8.13Contractor. G. The CONTRACTOR Contractor shall designate an individual a responsible member of his organization at the site whose duty shall be the prevention of accidents. This person shall be communicated designated by the Contractor in writing to the OWNER Owner prior to the commencement of the work. H. The CONTRACTOR Contractor shall not load or permit any part of the Work to be loaded so as to endanger its safety. I. The performance of services pursuant to this Subsection 11.02 Article by the CONTRACTOR Contractor shall not relieve the subcontractors, suppliers, material men, or anyone furnishing goods and services to the job site of their responsibilities for the safety of persons and property, and for compliance with all federal, state, and local statutes, rules, regulations, and orders applicable to the conduct of the Work.

SAFETY OF PERSONS AND PROPERTY. A. 10.1.1 The CONTRACTOR Contractor shall initiate, maintain and supervise all safety precautions and programs in connection with the performance of the Work. 10.1.2 The Contractor shall take all reasonable precautions for the safety of and shall provide all reasonable protection to prevent damage, injury or loss to: 1. All employees, workmen or craftsmen on .1 Employees working under the Work Contract and all other persons who may be affected thereby with attention to OSHA Sections 1926-C and 1926-Ethereby; 2. All the .2 The Work and all materials and equipment to be incorporated therein, whether in storage on or off the Project site, under the care, custody or control of the CONTRACTOR Contractor or any of his the Contractor's Subcontractors or Sub-subcontractors; and 3. .3 Other property at the site Project site, or adjacent thereto, including such as trees, shrubs, lawns, walks, pavements, roadways, structures and utilities not designated for removalutilities, relocation except as otherwise noted or replacement in the course of constructionspecified. B. 10.1.3 The CONTRACTOR Contractor shall give all notices and comply with all applicable laws, ordinances, rules, regulations, regulations and lawful orders of any public authority authorities bearing on the safety of persons or property property, or their protection from damage, injury or loss. C. 10.1.4 The CONTRACTOR Contractor shall erect and maintain, as required by existing conditions and progress performance of the WorkContract, all reasonable safeguards for safety and protection, including posting danger signs and other warnings against hazards, promulgating safety regulations and notifying OWNERs the AOC, other owners and users of adjacent sites and utilities. D. 10.1.5 The CONTRACTOR Contractor shall take comply with all reasonable steps to maintain access for all residences applicable laws, ordinances, rules, regulations and businesses in conformance with Section 102-2.4 lawful orders of public authorities regarding the F.D.O.T. Specifications. E. When the storage and/or use or storage of explosives or other hazardous materials or equipment is necessary for execution of Work. The Contractor shall designate the execution Work Superintendent, or some other responsible member of the Contractor’s organization who is at the Site, to be the person responsible for the prevention of accidents and the monitoring of the safety of the Work, the CONTRACTOR shall exercise the utmost care and shall carry on such activities under the supervision of properly qualified personnel. F. 10.1.6 The CONTRACTOR Contractor shall promptly remedy all damage or and loss (other than damage or loss insured under Article 12 to any property referred to in Paragraphs (2) Clauses 10.1.2.2 and (3) of Subsection 11.02 10.1.2.3 caused in whole or in part by the CONTRACTORContractor, any a Subcontractor, any a Sub-subcontractor, or anyone directly or indirectly employed by any of them them, or by anyone for whose acts any of them they may be liable and for which the CONTRACTOR Contractor is responsible under Paragraphs (2) Clauses 10.1.2.2 and (3) of Subsection 11.02, except damage or loss attributable to the acts or omissions of the OWNER, or anyone directly employed by OWNER and not attributable in any part to the fault or negligence of the CONTRACTOR. The foregoing obligations of the CONTRACTOR are in addition to his obligations under Subsection 8.1310. G. The CONTRACTOR shall designate an individual at the site whose duty shall be the prevention of accidents. This person shall be communicated to the OWNER prior to the commencement of the work. H. The CONTRACTOR shall not load or permit any part of the Work to be loaded so as to endanger its safety. I.
