Remedy of Damage. The Design/Builder shall promptly remedy damage and loss (other than damage or loss covered under Builder’s Risk property insurance required to be carried by the Owner) to property referred to in Section 10.2.1.2 and 10.2.1.3 to the extent caused in whole or in part by the Design/Builder or anyone directly employed by or in control of Design/Builder and for whose acts Design/Builder may be liable and for which the Design/Builder is responsible under Sections 10.2.1.2 and 10.2.1.3, except to the extent damage or loss attributable to acts or omissions of the Owner, Separate Contractors or anyone directly or indirectly employed by either of them, or by anyone for whose acts either of them may be liable. The foregoing obligations of the Design/Builder are in addition to the Design/Builder's obligations under Section 9.4. All costs incurred by the Design/Builder in connection with its obligations under this Section shall be Cost of the Work, but shall not increase the GMP.

Remedy of Damage. Contractor shall promptly remedy all damage or loss to any property at the site or at the Property if such damage or loss is caused by Contractor, its subcontractor or anyone performing the Services through Contractor.
Remedy of Damage. CONTRACTOR shall promptly remedy damage and loss to property referred to in Sections 10.2.1.2 and 10.2.1.3 caused in whole or in part by CONTRACTOR, or anyone employed by or in control of CONTRACTOR, or any Subcontractor. All costs incurred by CONTRACTOR in connection with its obligations under this Section shall be cost of the Work, but shall not increase the GMP.
Remedy of Damage. The Design/Builder shall promptly remedy damage and loss to property caused in whole or in part by the Design/Builder or anyone directly employed by or in control of Design/Builder and for whose acts Design/Builder may be liable and for which the Design/Builder is responsible, except damage or loss attributable to acts or omissions of the Owner or anyone directly or indirectly employed by either of them, or by anyone for whose acts either of them may be liable, and not attributable in whole or in part to the fault or negligence of the Design/Builder. The foregoing obligations of the Design/Builder are in addition to the Design/Builder's obligations under Section7.3; provided, however, that the Design/Builder's obligations hereunder shall include only those costs necessary to repair property damaged or lost (except to the extent professional liability insurance proceeds are available and actually paid by the respective carrier therefore pursuant to the provisions of Section 7.1). All costs incurred by the Design/Builder in connection with its obligations under this Section shall be Cost of the Work, but shall not increase the GMP.
Remedy of Damage. The Design-Builder shall promptly remedy damage and loss to property caused in whole or in part by the Design-Builder or anyone directly employed by or in control of Design-Builder and for whose acts Design-Builder may be liable and for which the Design-Builder is responsible. The foregoing obligations of the Design-Builder are in addition to the Design-Builder's other obligations. All costs incurred by the Design-Builder in connection with its obligations under this Section shall be included in the Contract Price.

  • Exclusion of Damages TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT WILL EITHER PARTY BE LIABLE UNDER OR IN CONNECTION WITH THIS AGREEMENT OR ITS SUBJECT MATTER UNDER ANY LEGAL OR EQUITABLE THEORY, INCLUDING BREACH OF CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY, AND OTHERWISE, FOR ANY: (a) LOSS OF PRODUCTION, USE, BUSINESS, REVENUE, OR PROFIT OR DIMINUTION IN VALUE; (b) IMPAIRMENT, INABILITY TO USE OR LOSS, INTERRUPTION OR DELAY OF THE SERVICES; (c) LOSS, DAMAGE, CORRUPTION OR RECOVERY OF DATA, OR BREACH OF DATA OR SYSTEM SECURITY; (d) COST OF REPLACEMENT GOODS OR SERVICES; (e) LOSS OF GOODWILL, LOSS OF BUSINESS OPPORTUNITY OR PROFIT, OR LOSS OF REPUTATION; OR (f) CONSEQUENTIAL, INCIDENTAL, INDIRECT, EXEMPLARY, SPECIAL, ENHANCED, OR PUNITIVE DAMAGES, REGARDLESS OF WHETHER SUCH PERSONS WERE ADVISED OF THE POSSIBILITY OF SUCH LOSSES OR DAMAGES OR SUCH LOSSES OR DAMAGES WERE OTHERWISE FORESEEABLE, AND NOTWITHSTANDING THE FAILURE OF ANY AGREED OR OTHER REMEDY OF ITS ESSENTIAL PURPOSE.

  • Notice of Damage Upon the loss of, destruction of, or damage to any of the property, Contractor shall notify the HCA Contract Manager thereof within one (1) Business Day and shall take all reasonable steps to protect that property from further damage.

  • Mitigation of Damages Executive shall not be required to mitigate damages or the amount of any payment provided for under this Agreement by seeking other employment or otherwise after the termination of his employment hereunder.

  • Payment of Damages The indemnification required hereunder shall be made by periodic payments of the amount thereof during the course of the investigation or defense, within 10 days as and when reasonably specific bills are received or loss, liability, claim, damage or expense is incurred and reasonable evidence thereof is delivered. In calculating any amount to be paid by an indemnifying party by reason of the provisions of this Agreement, the amount shall be reduced by all reimbursements (including, without limitation, insurance proceeds) credited to or received by the other party related to the Damages.

ST AND ITS AFFILIATES AGGREGATE AND CUMULATIVE LIABILITY UNDER THIS PLLA SHALL NOT EXCEED 100 USD (ONE HUNDRED USD). THE LIMITATIONS SET FORTH IN THIS ARTICLE 8 SHALL ONLY APPLY TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW.
