SALE OF PURCHASER'S PROPERTY. A. □ This offer is not contingent upon the sale or close of property owned by Purchaser. B. □ This offer is contingent upon the sale and close of Purchaser’s property located at (address, including city & state) □ within days or □ within the time specified for closing the Seller’s property. Seller shall have the right to continue to offer the property for sale and accept any offers subject to the rights of Purchaser. If Seller accepts another offer, Seller will give Purchaser written notice of that fact. Within days of receipt of the notice, Purchaser will provide a written waiver of the contingency on the sale and close of Purchaser’s property or this agreement will terminate without further notice and deposits will be returned according to paragraph 15 of this agreement. Upon waiver of this contingency, Purchaser warrants and will provide proof that the funds needed for closing will be available and Purchaser’s ability to obtain financing is not contingent upon the sale and/or close of any property.

SALE OF PURCHASER'S PROPERTY. 18.1. This entire agreement is subject to the sale of certain existing immovable property situated at within a period of 30 days from date of this agreement; the fulfillment of all and any suspensive conditions to be contained in such sale within a period of 21 days from date of the sale; and the successful conclusion of such sale (registration of transfers of ownership) within a period of three-months from date of the sale or the date of fulfillment of the suspensive conditions contained in the such sale, whichever event occurs last. It is recorded that the Seller shall have the right, in the Seller’s sole discretion, to extend in writing any of the aforesaid periods once for each period and for no longer than 20 days for each period. OR (if Property already sold) 18.2. It is recorded that the Purchaser has sold certain existing immovable property situated at and that this agreement is subject to the fulfillment of all and any suspensive conditions contained in such sale within a period of 21 days from date of this agreement and the successful conclusion of such sale (registration of transfer of ownership) within a period of three-months from date of this agreement or the date of fulfillment of the suspensive conditions contained in the such sale, whichever event occurs last. It is recorded that the Seller shall have the right, in the Seller’s sole discretion, to extend in writing any of the aforesaid periods once for each period and for no longer than 20 ordinary days for each period. 18.3. It is recorded that in the event of the suspensive condition referred to in this paragraph being fulfilled, it is the understanding and agreement between the parties that notwithstanding anything elsewhere provided for in this agreement the parties will endeavour to cause the registration of the transfer of the Property purchased in terms of this agreement to be registered at the same time as the transfer of the Purchaser's property. The Purchaser accordingly agrees to pay the transfer duty on this transaction (if any) to the Seller's conveyancers when required so to do, so as to enable the simultaneous registration to occur.
SALE OF PURCHASER'S PROPERTY. 20.1 In the event that Item E4 of the Schedule of Details has been completed, then this Agreement is, in addition to any applicable conditions under clause 4.1 above, subject to the Purchaser conclusively selling his property for an amount and by the date as reflected in Item E4 of the Schedule of Details, failing which this Agreement shall be of no force and effect. 20.2 If the Purchaser conclusively sells his property in accordance with clause 20.1 above read in conjunction with Item E4 of the Schedule of Details, then the Purchaser shall, within 30 (thirty) calendar days of that conclusive sale, deliver guarantees to the Conveyancers, in a form acceptable to the Conveyancers and expressed to be payable on the Date of Transfer, for the amount of the proceeds of that sale and which proceeds shall be paid toward the balance of the purchase price in terms of this Agreement. 20.3 If the Purchaser has already conclusively sold the property reflected in Item E4 of the Schedule of Details prior to the Date of Signature of this Agreement, then the guarantees, in a form acceptable to the Conveyancers and expressed to be payable on the Date of Transfer for the amount of the proceeds of that sale and which proceeds shall be paid toward the balance of the purchase price in terms of this Agreement, shall be delivered to the Conveyancers within 30 (thirty) calendar days from the Date of Signature of this Agreement.
SALE OF PURCHASER'S PROPERTY. This agreement is further subject to the PURCHASER successfully selling the property situated at ............................... by no later than ..................... or such extended period as the SELLER in his sole discretion may allow by notice in writing to the PURCHASER at a purchase price of R or such lesser amount as the PURCHASER may accept. It is specifically recorded that this suspensive condition shall not be regarded as having been fulfilled until all suspensive conditions to which such sale is in turn subject are fulfilled.
