Common use of Sales Tariffs Clause in Contracts

Sales Tariffs. No Party’s sales tariff shall apply to any Transaction unless specifically so stated in the Confirmation. In the event that the Confirmation stipulates that a tariff applies, each Party agrees that it shall not amend any such tariff in any way that may adversely affect the rights or obligations of the other Party, without the prior written consent of the other Party, and each Party further agrees that it will not assert, or defend itself, on the basis that any applicable tariff is inconsistent with this Agreement.
