Sales to Visibly Intoxicated Persons. Retailer agrees to make a good faith effort to prevent a visibly intoxicated person from playing Lottery Games. For purposes of this Subsection 4.3, a “good faith effort” means that Retailer will make an oral request to a player to stop playing if the player is observed to be visibly intoxicated and shall refuse to sell Tickets or Shares to a person who is visibly intoxicated.
