Common use of Scope of Application to Parties Clause in Contracts

Scope of Application to Parties. The Participating Generator and CAISO acknowledge that all Generators, except those specified in Section 2.2.1 of this Agreement, wishing to submit Bids to the CAISO through a Scheduling Coordinator must sign this Agreement in accordance with Section 4.6 of the CAISO Tariff.

Scope of Application to Parties. The Participating Generator and CAISO acknowledge that all Qualifying Facility Generators, except those specified in Section 2.2.1 of this Agreement, wishing to submit Bids Bids, to the CAISO through a Scheduling Coordinator must sign shall first execute this Agreement or the standard Participating Generator Agreement applicable to non-QF Generators. The Parties acknowledge that execution of this Agreement by the Participating Generator satisfies the requirement of a written agreement as set forth in accordance with Section 4.6 of the CAISO Tariff.

The Parties acknowledge that execution of this Agreement by the Participating Generator satisfies the requirement set forth in accordance with Section 4.6 of the CAISO Tariff.
