Scope of Mandatory Subcontract Works. In terms of the latest Preferential Procurement Regulations (2017), prequalification must be used in identified tenders to advance designated groups on the basis of B-BBEE Status Level of contributor, EME or QSE or on the basis of subcontracting with EMEs or QSEs which are 51% owned by either of the following: Blacks; Black Youth; Black Women; Black people with disabilities; Black people living in rural or underdeveloped areas or townships; cooperatives owned by Black people; Black people who are Military Veterans. It is therefore a contractual requirement in this case that at least 15% of the value of work to be sub-contracted to qualifying EME/s and / or QSE/s with as many as can practically be engaged from the immediate area (Xxxx) and, only if there aren’t sufficient qualifying contractors, can subcontractors be sourced from outside the Xxxx (but within the O. R. Tambo District Municipality). The local Community Leadership will propose prospective subcontractors to the successful Contractor (no negotiations with Tenderers at tender stage). It is deemed that the accepted tender allows for paying the local subcontractor’s rates (including a reasonable subcontractor P&G amount) and for supervising them. Once the Contract is awarded, the Contractor is to prepare a BoQ for calling for Quotes from the local potential subcontractors. The Employer’s ISD Department and the ISD Consultant appointed for this Contract will assist with this process and the subsequent evaluations and approvals.

The local Community Leadership will propose prospective subcontractors to the preferred bidder and contractual arrangements finalised by negotiation before final award (no negotiations with Tenderers at tender stage). Approved local sub-contractors shall be invited to price a BoQ for a specific section of the pipeline (~ 2km of the pipeline). The Employer and ISD Consultant will assist in the evaluation process.

  • Solicitations for Subcontractors, Including Procurements of Materials and Equipment In all solicitations either by competitive bidding or negotiation made by the contractor for work to be performed under a subcontract, including procurements of materials or leases of equipment, each potential subcontractor or supplier shall be notified by the contractor of the contractor's obligations under this contract and the Regulations relative to nondiscrimination on the grounds of race, color, or national origin, sex, age, and disability/handicap.

  • Critical Infrastructure Subcontracts For purposes of this Paragraph, the designated countries are China, Iran, North Korea, Russia, and any countries lawfully designated by the Governor as a threat to critical infrastructure. Pursuant to Section 113.002 of the Business and Commerce Code, Contractor shall not enter into a subcontract that will provide direct or remote access to or control of critical infrastructure, as defined by Section 113.001 of the Texas Business and Commerce Code, in this state, other than access specifically allowed for product warranty and support purposes to any subcontractor unless (i) neither the subcontractor nor its parent company, nor any affiliate of the subcontractor or its parent company, is majority owned or controlled by citizens or governmental entities of a designated country; and (ii) neither the subcontractor nor its parent company, nor any affiliate of the subcontractor or its parent company, is headquartered in a designated country. Contractor will notify the System Agency before entering into any subcontract that will provide direct or remote access to or control of critical infrastructure, as defined by Section 113.001 of the Texas Business & Commerce Code, in this state.
