Section 16.2.5. 1. 43 Arbitration proceedings shall be in accordance with the following: 44
Section 16.2.5. 13 Incremental steps, where applicable, shall take effect on September 1, of each year during the 14 term of this Agreement; provided, the employee has been actively employed continuously for at 15 least half of the previous employment year. Section 16.2.5. 26 If no settlement has been reached within the thirty (30) days referred to in the preceding 27 subsection, and the Association believes the grievance to be valid, the employee may demand 28 arbitration of the grievance. Any dispute, claim or grievance arising out of or relating to the 29 interpretation or the application of this Agreement shall then be submitted to arbitration under 30 the regulations of the Public Employment Relations Commission. The arbitrator shall be a staff 31 member and shall render a decision within thirty (30) days of the completion of the hearing, 32 unless such time is extended by the Agreement of the parties. The parties further agree to 33 accept the arbitrator's award as final and binding.

Section 16.2.5. 36 Paraeducators (Class D and E) in the State of Washington must have a secondary school (high 37 school) diploma or its recognized equivalent and meet one of the following options: an 38 Associate of Arts or Science degree; Seventy-two (72) quarter college credits at the one- 39 hundred (100) level or above; or pass a skills test approved by the State of Washington.
Section 16.2.5. 23 Upon mutual agreement of both parties, each individual case may be submitted to the American 24 Arbitration Association for binding arbitration. Both parties must agree on the type of 25 American Arbitration Association arbitration to be used (regular, expedited, or streamlined).
Section 16.2.5. 10 Beginning with the 2013-2014 school year, all longevity steps shall be increased by five ($0.05) 11 cents.
