SECTION A - Seniority. 1. Seniority, except in relation to awarding overtime, shall be defined as the total length of continuous service with the Board. Seniority shall be district-wide and shall be effective from the date of last employment. Time off for Board approved long term leave of absence without pay shall not count toward seniority but such leaves shall not be considered as an interruption of service. Seniority in relation to overtime shall be defined as the total length of continuous service in a particular job coupled with the qualifications and ability to perform the required task(s). Seniority for employees hired on the same date shall be determined based on alphabetical order using the last name of the employee on the Form #18 on the date of hire. 2. Seniority, qualifications, and evaluations will be considered in: a. Promotions b. Work Assignments 3. Seniority will take precedence in: a. Shift assignments, as vacancies occur b. Overtime, exception if an employee is working on a project, that employee receives the overtime in order to complete the task. Overtime can be awarded without seniority taking precedence upon prior supervisor approval if the supervisor determines that (i) an employee has already begun working on a project (ii) completing the project is mission critical c. SECTION A - Seniority. The term seniority as used in this article shall be length of continuous service with the Xxxxxx Area school district in the bargaining unit. The accrual of seniority shall begin from the last date of hire which shall be the first day the employee reported for work from which there has been continuous employment. Time on approved voluntary leaves or transfer to a non-bargaining unit position shall not count toward accrued seniority. Time on medical leave shall count towards the accrual of seniority. All seniority is lost when employment is severed by resignation, retirement or discharge for cause or failure to be recalled within (2) two years of layoff. In the event of two or more employees have the same date of hire; the employees shall participate in a mutual, agreed-upon tie-breaking drawing with the Association present. A drawing will be held among each classification of tied employees for purposes of establishing seniority ranking on the seniority list. Any employee leaving employment as defined above will be dropped from the seniority list without affecting the relative order of the remaining employees. Notification of all drawings shall be made to participants and the Association at least five (5) days in advance. "Unit seniority" shall be defined as the length of continuous service as a bargaining unit member from the first day of work. Time worked as a substitute shall not count toward seniority or completion of the probationary period. A substitute is a person doing unit work in place of a person on sick or personal leave or other. Authorized or unauthorized absence.

SECTION A - Seniority. As used hereinafter the term "seniority" shall be defined as the length of an employee’s continuous service with the Board from date of hire. Continuous service is defined as service rendered as a full-time employee and member of the bargaining unit except as specified below. Seniority shall not accrue or be deemed interrupted during any unpaid leave of absence except for FMLA leave or otherwise agreed upon by the parties hereto. Tenured teachers reduced to part time shall accrue seniority in proportion to their employment status. Classified staff reduced to part time shall accrue seniority in proportion to their employment status.

  • Super Seniority For purposes of layoff and recall only, the President shall head the seniority list, provided however, that such officer must have the necessary skill and experience to perform the required work. The Sheriff agrees that this section shall not be applied in an arbitrary manner.

  • Classification Seniority Classification Seniority" is defined as the length of service in a specific job classification within the bargaining unit, beginning with the date an employee starts to serve a probationary appointment. Classification Seniority shall be interrupted only by separation because of resignation, discharge for just cause, failure to return upon expiration of a leave of absence, failure to respond to a recall from layoff, or retirement.

  • Equal Seniority If two (2) or more employees subject to layoff have equal class seniority, the determination as to who shall be laid off will be made on the basis of the greater hire date seniority, and if that be equal, then the determination shall be made by lot.

  • SENIORITY (a) Newly hired full-time employees shall be considered on a probationary basis for a period of three (3) months from the date of hiring. Employees' names and classifications shall appear on the seniority list in order of their respective dates of employment. Additions and deletions shall be forwarded to the Union as they occur. (b) The Employer and Union agree to place employees on a seniority list as per Article 11; however, in the event that employees share the same seniority date the following process for placement on the seniority list, in order, will be used: i) date of hire ii) date probation is completed as per article 11.01 iii) first to complete their next scheduled shift iv) time of clock in if worked same shift 11.03 In all cases of lay-off due to lack of work or recall following a lay-off, the employee with the greatest amount of seniority will be retained in employment or recalled to work, whichever is applicable, provided he/she is qualified to perform the work available. 11.04 Seniority previously accumulated will be lost whenever an employee: (a) quits his/her employment, or retires; (b) is discharged and not reinstated; (c) is absent from work without reasonable explanation; (d) she/he is a part-time employee who has not been available for three (3) consecutive calendar months and is not on an approved absence as per the provisions of this agreement; (e) is laid off for twelve (12) consecutive months or time equal to the employee's length of service, whichever is greater; (f) fails to return from lay-off within six (6) days of work after being notified to do so; the employee to be recalled must keep the Employer informed of his/her current address and telephone number. Notice of recall may be by telephone, but in all cases a registered letter shall be used either as notice or confirmation. 11.05 The selection or appointment of employees for supervisory positions, or for any position not subject to this Agreement, is not governed by this Agreement. However, if any employee is or has been transferred or appointed, and later transferred back to a position which is governed by this Agreement, then the seniority which he/she has accumulated under this Agreement shall be credited to the employee. Subject to the time period set out in 11.04 (e) any time spent working outside the bargaining unit shall be deemed a lay-off for the purpose of this article.

  • Determination of Seniority Seniority records shall be maintained by the University and shall be based on the employee's seniority date. The University shall maintain current records on seniority for use in the application of these provisions and they shall be available whenever a Union representative shall raise a question of seniority. Such lists and records shall also show the job title and latest employment date with the University for each person, and a copy of the list shall be furnished to the Union every six (6) months, upon request.

  • Retention of Seniority (a) Any employee, other than a probationary employee, whose employment ceases through no fault of his own, shall retain seniority and shall be recalled on the following basis: (i) An employee with less than one year's continuous service shall retain these rights for six (6) months from the date of lay-off. (ii) An employee with one or more year's continuous service shall retain these rights for twelve (12) months from the date of lay-off, plus two (2) additional months for each year's service up to an additional twenty-four (24) months. (b) Failure of the employee to report for work within one (1) week of notice by registered mail at their last address reported to and received by the mill shall result in his termination of employment with the Company. Bona fide reasons for failure to report shall not deprive an employee of his recall rights.

  • Department Seniority Department seniority is defined as continuous length of service in calendar days within the employee’s department and where applicable, shall be used for internal department processes, such as vacation and schedule bids.

(l) Long-term disability or Income Replacement Benefits under the Automobile Insurance Act. (m) If an Employee’s hours of work are reduced due to a disability, full-time Employees shall maintain their pre- disability accrual rate. Other than full-time Employees shall accrue seniority as follows: (i) For those who have worked one (1) year or more: Paid Hours in Previous 52 Weeks = Seniority Hours Per 52 Week of Leave (ii) For other than full-time Employees who have worked for less than one (1) year:
